Book excerpt: Dans les enseignements en anthropologie du professeur Yan Vansina, à l'Université de Lovanium, actuellement Université de Kinshasa, les pouvoirs dans les souches culturelles africaines sont au nombre de cinq, au lieu de trois cités par Montesquieu. De ma part, j'y ai apporté la lecture en référence à la Palabre africaine, une institution hautement démocratique. La modernisation de cette culture dans le contexte étatique actuel se veut plus scientifique, au lieu de continuer à copier, paraphraser et compiler uniquement les Constitutions de l'Occident. Ainsi, en plus de l'Exécutif, du Législatif et de la Justice, le pouvoir de l'Information doit être composée de la recherche scientifique et de la presse, et le pouvoir du Support, en démocratie dont les souches sont africaines, est composé de la population personnifiée par le Chef de l'Etat, président de la République, dans un régime politique qui n'est ni parlementaire ni présidentiel, mais arbitral. Le caractère arbitral étant incompatible avec le système parlementaire et partisan, irréversiblement, le régime arbitral dans un Etat, comme dans une Palabre africaine, ignore le Parlement et tout ce qui est parti politique. Il s'agit d'arrondir le Droit constitutionnel par les notions nouvelles comme ce fut le cas en mai 1787 aux Etats-Unis d'Amérique, cas de fédéralisme, de Congrès, de président de la République, de Constitution écrite, de régime présidentiel et autres. La question est démocratique et référendaire, en vue d'élaborer les Constitutions telles qu'elles doivent être dans les Etats africains, et de trouver la solution à la cessation des guerres déroutantes de démocratisation en Afrique. Pour y parvenir, la démarche est celle de restaurer d'abord et d'élaborer ensuite, la Constitution d'un Etat africain. Les notions ''nouvelles'' dans le contexte étatique actuel telles que le régime arbitral, l'Assemblée Nationale Arbitral, et autres arrondiront le Droit constitutionnel longtemps tronqué par la colonisation.

La première section, qui étudie la variabilité intra- et interculturelle des œuvres du patrimoine oral africain, recherche dans l'instabilité des énoncés, aussi bien les traces des énonciateurs que les différents systèmes culturels concernés. C'est ce facteur déterminant de l'activité créatrice qui est pris en compte dans la troisième section, tandis que les conditions de " l'émergence d'œuvres nouvelles et de genres nouveaux " est à la fois le titre et l'objet de la quatrième section. La réflexion se clôt sur une cinquième section intitulée " Création, identité et développement " qui étudie comment la littérature orale africaine peut adapter les savoirs traditionnels à de nouvelles réalités politiques et sociales. Cet ouvrage, qui publie les actes du congrès de l'ISOLA (International Society for Oral Literature in Africa), tenu à Chambéry en 2002, se compose de la combinaison indissociable d'un livre et d'un cédérom, structurés selon les mêmes cinq parties. Les 43 contributions, réparties dans chacune de ces sections et rédigées dans l'une des deux langues du colloque, français (22) ou anglais (21), se retrouvent donc soit dans le livre, soit dans le cédérom, avec toujours un équivalent dans l'autre langue sous la forme d'un résumé et pour dix-huit d'entre elles d'une traduction intégrale.

Si les Twas dans leur ensemble souffrent de discrimination, de marginalisation et d’extrême pauvreté, combien plus les femmes twas en souffrent-elles. Cette situation a été récemment exacerbée par le violent conflit qui a secoué la région. Dorothy Jackson possède de nombreuses années d’expérience et de travail aux côtés des communautés twas de la région et des femmes twas en particulier. On devine clairement les voix des femmes twas dans ce rapport, qui plaident pour des changements et la reconnaissance de leurs droits – en tant qu’autochtones et en tant que femmes. Malgré la discrimination et la pauvreté qui sont leur lot quotidien, elles sont pleines d’énergie, d’idées et de courage, ce que ce rapport suffit à démontrer. La question foncière est aujourd’hui de premier ordre pour les femmes comme pour les communautés twas. Les Twas étaient traditionnellement dépendants des forêts et des territoires sur lesquelles ils vivaient. Or aujourd’hui, la plupart des Twas sont sans terre. Leur culture et leur existence même sont en danger. Qui plus est, les changements profonds qui affectent aujourd’hui leurs sociétés sont en train de remettre en question le statut traditionnel d’égalité entre hommes et femmes. Ce rapport présente les politiques gouvernementales et les instruments juridiques internationaux relatifs aux droits humains que les Twas et les organisations qui les soutiennent pourraient utiliser au Burundi, en Ouganda, en République démocratique du Congo et au Rwanda. En guise de conclusion, le rapport offre des recommandations aux gouvernements de ces Etats et aux organisations de développement.
