It is natural that, under such circumstances, there should be many variances in their institutions, customs, laws, and polity', and that these variances should result sometimes from accident, and sometimes from design, sometimes from superior skill and knowledge of local interests, and sometimes from a choice founded in ignorance and supported by the prejudices of imperfect civilization. Climate and geographical position, and the physical adaptations springing from them, must at all times have had a powerful influence in the organization of each society, and have given a peculiar complexion and character to many of its arrangements. The bold, intrepid, and hardy natives of the north of Europe, whether civilized or barbarous, would scarcely desire or tolerate the indolent inactivity and luxurious indulgences of the Asiatics. Nations inhabiting the borders of the ocean, and accustomed to maritime intercourse with other nations, would naturally require institutions and laws adapted to their pursuits and enterprises, which would be wholly unfit for those who should be placed in the interior of a continent, and should maintain very different relations with their neighbors, both in peace and war. Accordingly we find that, from the earliest records of authentic history, there has been (as far at least as we can trace them) little uniformity in the laws, usages, policy, and institutions either of contiguous or of distant nations. The Egyptians, the Medes, the Persians, the Greeks, and the Romans differed not more in their characters and employments from each other, than in their institutions and laws. For all the purposes of the present commentaries it will be sufficient to treat the subject under the heads of personal or movable property, and real or immovable property, since the class of mixed property appertains to the latter. "Terms of Foreign Law"--We have already had occasion to state that in the civil law the term 'bona' includes all sorts of property, movable and immovable; as the corresponding word 'biens' in French, also does. But there are many cases in which a broad distinction is taken by foreign jurists between movable property and immovable property, as to the operation of foreign law. "Doctrine concerning Movables"--According to this distribution all laws respecting property, whether it be movable or immovable, would fall under the denomination of real laws; and of course, upon the principles of the leading foreign jurists, would seem to be limited in their operation to the territory where the property is situate. This however is a conclusion which upon a larger examination will be found to be erroneous, the general doctrine held by nearly all foreign jurists being that the right and disposition of movables is to be governed by the law of the domicil of the owner, and not by the law of their local situation. Book excerpt: Russias transition towards a market economy in the early 1990s called for new approaches to the regulation of employment relations in the post-Soviet period in order to strike a balance between employers interests and employees rights in changed conditions. The adoption of the Labour Code of the Russian Federation (LC RF) in 2001 contributed to solving the issue only partly, as, in reality, it was passed as a compromise between different political forces, and consists of both provisions which can be implemented in the new context of the market economy and restrictions inherited from the planned economy. The recent and ever-changing socio-economic conditions, and the increasing complexity of the employer-employee relationship, which is a result of both globalization and technological progress, required the further development of Russian employment legislation. This resulted in substantial amendments being made to the original LC RF in 2006, with the majority of its provisions being profoundly revised. Nevertheless, a thorough analysis of the changes currently under way shows that many aspects concerning employment relations have still not been addressed sufficiently. The papers collected in the present volume of the ADAPT Labour Studies Book Series consider the recent developments of the legal regulation of employment relations as well as some closely related aspects from a historical and comparative perspective, in order to provide some insights into these issues and to examine current challenges.
