Excerpt: ... that if the landlord refuses to recognize the transfer and ejects the transferee, there is nothing to 'pI'eVCnt the tenant from suing to regain possession of his holding and that, if the facts proved negative a deliberate intention of abandonment he is entitled to succeed. In a very recent case (Bansidas vs, Jagdip Narain Chowdhri I. L. R. XXIV Calc. 152) it was held that an alienation ol a part of his holding by a raiyat did not work a forfeiture and' that the landlord was only entitled to a declaration that the alienation was not binding upon him. In Kallinath Chakraverti vs Upendra Chunder Chowdhry (1, LR, XXIV Calc, 212) the suit was against the transferees only. The original tenants were not made parties to the suit and no objection was taken to the suit proceeding in their absence. Starting then with the admitted fact that the onus of proving abandoment was on the landlord, I have no hesitation in holding that in the present case that onus has not been discharged, The finding of the Lower Appellate Court is based upon the facts (1) that no rent was paid or offered after I890-91, (2) that in her sale deed Mt. Anto agreed to transler all the rights which she possessed, and (3) that iii the Bjectment suit _ it was pleaded, on behalf of the minor defendant Qhotelal_ (the present plaintiff) that the transfer was not only complete in itself but had been formally recognized by the landlord I am unable to see that these facts justify the cents0nclusi0n that there was any abandonment on the holding, Non-payment of rent does not work a forfeiture; and when the landlords had once made up their minds to avoid the transfer and get the land into their own possession it was not to be expected that they would agree to accep

Grants by the sovereign power to a person governed by the mitakshara are often sel/'acquisitions, but this would not be case where the grant is made in return for services which have been rendered at the ewpense of the joint family. Property acquired by a grant under such circumstances would be family property, overywhich the grantee would have no power of disposition by will as against his joint son. This was a suit brought by a Hindu widow against her step-son to recover arrears of maintenance due to her under the will of her husband. _ It was pleaded in the first Court that the property of the husband was joint and ancestral, and that therefore he could not make any cl1arge on it by his will. The Plaintiff did not contest the allegation that the property was joint and ancestral and merely urged that the husband had power under the mitakshara to make a will.
