Book excerpt: Excerpt from Cases on the Law of Equity Jurisprudence and Trusts: Selected From American and English Decisions The first of these suits was a bill in equity alleging that the Stockbridge Iron Company conveyed land to the Hudson Iron Company, by deed reserving to themselves certain rights of taking ore for their use, and that the Hudson Iron Company obstructed them in the exercise of these reserved rights. The second suit was a cross bill by the Hudson Iron Com pany, alleging' that the language of the reservation in the deed of the Stockbridge Iron Company to them was inserted in the deed by the common mistake of all parties thereto, and defeated the intention of all said parties, which was, that said rights should be restricted to taking ore for use only of certain furnaces; and the Hudson Iron Company were entitled to have the mistake corrected, and the language of the deed and of the reservation therein, reformed SO as to conform to the true intent and meaning of all parties thereto. In both cases the Hudson Iron Company moved the court to order an issue to be framed for trial by jury whether the clause restricting the right of taking ore to a right of taking it only for certain furnaces had not been agreed upon by the parties as a term of their contract, and whether such clause had not been Omitted from the deed by common mistake. It ought to embrace the law on that subject as established in Thirty four sovereign States, each State having so altered and modified the common law doctrine asseemed best adapt ed to their circumstances. These statutory changes in the several States have made necessary corresponding changes or modifications of the common law doctrine of trusts, which appear in the decisions of their courts. These decisions, becoming precedents, tend to mislead the American student, and will do so, unless he becomes acquainted with the statutory provisions upon which they are based. It therefore became necessary to pre sent the common law doctrine of trusts, the modification of the same by the statutes of the several States, and the decisions of the courts of these States on questions arising out of these modifications. This has been done as extensively as the limits of this work would permit. It is hoped that it may prove acceptable to the profes sion, and be an aid to them in their study of the Law of Trusts, as administered in England and America. This book is far more than a mere collee tion of cases. In its analysis of the subject and in its exten sive annotations it has been a notable contribution to legal scholarship. It has frequently been the guide of courts and of legal writers. It has determined the scope of the course on Trusts as it is taught today in the law schools of the United States. More than a quarter of a century, however, has elapsed since the appearance of the second edition of Professor Ames's book. There has been a considerable development of the sub ject in this time. Certain changes in emphasis and in arrange ment have become necessary. The subjects of resulting and constructive trusts, which were not treated in the second edi tion of Ames's Cases, and the subject of charitable trusts, which was not treated in either edition, are of great importance. In these subjects, and indeed in all the subjects treated herein, there has been during the last twenty-five years a wealth of new material from which to draw. The editor cannot adequately express the great debt that he owes to Professor Ames under whom he had the privilege of studying for three years. Only those who have had the same privilege can realize the extent of that debt. The matter con tained in Ames's Cases and also the invaluable ms. Notes which Professor Ames was accustomed to take with him to the class room have been put at the editor's disposal. The editor has reprinted many notes contained in Ames's Cases, as corrected and supplemented by his ms. Annotations, chiefly those notes which are of historical interest, or which relate to controverted points. The source of these notes is duly indicated. It is impossible to indicate the extent to which many of the other notes are due to suggestions derived from Professor Ames. Book excerpt: Excerpt from Leading and Select Cases on Trusts This work has its origin mainly in two circumstances: First, in there being heretofore no special compilation of authorities on the subject of Trusts; and, secondly, a desire to economize labor in the preparation of the Covington and Lexington Railroad case for trial. In default of being beneficial in that case, it was desired to put the result of this work in such form as to renew, in the attention of the profession and the reading public, the great rules for the administration of trusts. In their actual application, they have recently been so disregarded as to lead, in many cases, to the erroneous opinion that practice had established these rules adversely to the principles. As is well known to many, the labor indicated has been made almost the exclusive business of the author of this compilation, from the inception of the suit, in 1864-5, to the present time. In the selection of Leading Cases, I have taken such as have been the result of the most deliberate consideration and labor of the judicial minds whose opinions have given shape and weight to the laws of England and America.
