Book Selected Cases on the Law of Contracts Classic Reprint

Download or read book Selected Cases on the Law of Contracts Classic Reprint written by Ernest W. Huffcut and published by Forgotten Books. This book was released on 2018-02-08 with total page 800 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Selected Cases on the Law of Contracts The arrangement of topics follows that of Sir William Anson in his Principles of the English Law of Contracts, whose general plan has served as a model for some other treatises on the subject. This case book, however, covers some topics not dealt with in his book; and some that are treated there are not included here. Two chap ters appearing in the former editions of this book, namely, Capacity of Parties, and Impairing the Obligation of Contract, are omitted in this edition, as these are topics which are commonly discussed in the courses on Persons and Constitutional Law in the usual law school curriculum. In many of the cases the statement of facts has, for the sake of brev ity, been either re-written or abridged, without calling special attention to the matter. For the same reason, the practice, now common, of omitting unnecessary portions of the Opinions, has been followed; but such omissions are always indicated. In this as in the preceding editions, the principal text consists of American cases, although English cases are represented in the notes and in the discussions in the Opinions. Book Cases on Damages Selected From Decisions of English and American Courts Classic Reprint

Download or read book Cases on Damages Selected From Decisions of English and American Courts Classic Reprint written by Floyd R. Mechem and published by . This book was released on 2015-07-10 with total page 662 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Cases on Damages Selected From Decisions of English and American Courts For years past the science of law has been taught by lectures, the use of text-books and more recently by the detailed study, in the class-room, of selected cases. Each method has its advocates, but it is generally agreed that the lecture system should be discarded because in it the lecturer docs the work and the student is either a willing receptacle or offers a passive resistance. It is not too much to say that the lecture system is doomed. Instruction by the means of text-books as a supplement or substitute for the formal lecture has made its formal entry into the educational world and obtains widely; but the system is faulty and must pass away as the exclusive means of studying and teaching law. It is an improvement on the formal lecture in that the student works, but if it cannot be said that he works to no purpose, it is a fact that he works from the wrong end. The rule is learned without the reason, or both rule and reason are stated in the abstract as the resultant rather than as the process. If we forget the rule we cannot solve the problem; if we have learned to solve the problem it is a simple matter to formulate a rule of our own. The text-book method may strengthen the memory; it may not train the mind, nor does it necessarily strengthen it. A text, if it be short, is at best a summary, and a summary presupposes previous knowledge. If, however, law be considered as a science rather than a collection of arbitrary rules and regulations, it follows that it shouldbe studied as a science. Thus to state the problem is to solve it; the laboratory method has displaced the lecture, and the text yields to the actual experiment. The law reports are in more senses than one books of experiments, and, by studying the actual case, the student co-operates with the judge and works out the conclusion however complicated the facts or the principles involved. A study of cases arranged historically develops the knowledge of the law, and each case is seen to be not an isolated fact but a necessary link in the chain of development. The study of the case is clearly the most practical method, for the student already does in his undergraduate days what he must do all his life; it is curiously the most theoretical and the most practical. Download or read book A Selection of Cases on Agency Classic Reprint written by Eugene Wambaugh and published by Forgotten Books. This book was released on 2017-11-03 with total page 1084 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Selection of Cases on Agency IN selecting and arranging these cases. The purpose has been to furnish material for the study of the principal topics of Agency. Including some topics frequently classed under the head of Master and Servant. S far as practi cable, use has been made of those famous cases with which it is peculiarly important that the student should become acquainted. The order of the chapters and of the sections has been determined. Not by the views of analytical jurists or of codificrs, but by the supposed convenience of stu dents; and consequently the plan has been to place in close juxtaposition topics that throw light upon one another, and to present the easiest and the most fundamental topics as early as possible. The cases as to each topic have been arranged chronologically. The statements by the report ers, and the Opinions of the judges. Have been reprinted in full, with exceptions indicated in the foot-notes; but the arguments of counsel have usually been omitted. The citations in the foot notes have been intended to include only such cases as may profitably be examined by students. Download or read book A Selection of Cases on the Law of Private Corporations Classic Reprint written by Leslie Jay Tompkins and published by Forgotten Books. This book was released on 2017-10-31 with total page 1184 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Selection of Cases on the Law of Private Corporations A collection of cases for class-room work has passed beyond the experimental stage and needs no explanation of its purpose. But a set of cases upon this subject, in the face of a most exhaustive and complete set by Professor Wilgus of Michigan University Law School, and other excellent sets by Professor Smith of the Harvard Law School, and Professors Keener and Cummings of Columbia University Law School, needs a word of extenuation. The editor has taught the subject for a number of years, and has, at different times, used all of the above-named sets, and found it impossible to cover them properly in the time allotted to the sub jcet. The publishers requested a revision of Keener's Cases, but it was deemed advisable to arrange a new set and bring it within the limits of one volume. Obviously, a large number of the cases reported herein appear in the volumes already mentioned, and, in part, the general arrangement of them must be along the same lines. Book A Selection of Cases on Trial Practice

Download or read book A Selection of Cases on Trial Practice written by Edward Wilcox Hinton and published by Forgotten Books. This book was released on 2017-09-16 with total page 802 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Selection of Cases on Trial Practice: At Common Law and Under Modern Statutes When the editor undertook to organize a course in practice some years ago, it soon became apparent to him that the same methods of study and instruction, which had proved satisfactory in other branches of the law, should be applied to this perplexing topic. As there was no collection of cases, it was necessary to send the students to the original reports, an unsatisfactory method even with small classes, because it is impracticable to have the material under the student's eye during discussion in the class room. An increasing number of students made it impossible to rely on the library, and hence the present selection of cases has been prepared to meet the needs of students. The material has been collected during the last ten years for class room use. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Download or read book Illustrative Cases on the Law of Domestic Relations Classic Reprint written by Joseph R. Long and published by Forgotten Books. This book was released on 2018-03-21 with total page 206 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Illustrative Cases on the Law of Domestic Relations This collection of cases on the Law of Domestic Relations does not by any means purport to embody a complete exposition of the subject. The cases are intended to be merely illustrative of a text-book setting forth the subject fully. The cases have been selected with special reference to the importance and need of illustration of the several points covered. Obsolete, simple, or relatively unimportant matters have been omitted. Care has been taken to include only cases of real value for teaching purposes, and it is contemplated that there should be no selec tion from among the cases but that the student should read them all. In most instances the opinion of the court has been printed in full. Wherever omissions occur this fact is indicated. The preliminary statements have been prepared by the compiler. This collection was prepared more particularly for use with the compiler's own text-book on the subject, and references are given with each case to the appropriate sections of that work. It is believed, however, that these cases will be found equally useful with any other text-book on the subject. This criticism applies with greater force to long cases. In the present volume the cases are short and confined to the points of Evidence involved. All matter contained in the reported cases not pertaining to Evidence has been eliminated. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books.
