An amending statute, the Act reformed the MHA 1983 and reshaped the law governing the compulsory care and treatment of people suffering from mental disorders. Primarily driven by concerns about risk, it sought to remove legalistic obstacles to civil commitment and extend the law's coercive reach into the community. At the time of its introduction, the 2007 Act was written off as a retrograde step and a missed opportunity for radical, rights-focused reform. Despite this, little attention has been paid to its impact in the years since. Published to coincide with the tenth anniversary of the 2007 Act, this book offers a timely evaluation of mental health law and policy in England. It argues that the current MHA defies easy categorisation within any of the descriptive models which have customarily narrated the mechanics of civil commitment, namely 'legalism', 'new legalism', and 'medicalism'. It therefore makes the case for a new model – new medicalism – to account for the 2007 Act's enhancement of the discretion of mental health professionals for the express purposes of facilitating the management of situations of risk. In doing so, the book: critically examines the problems inherent in civil commitment frameworks organised around the concept of risk; explores the theoretical foundations of new medicalism; considers the challenges facing proponents of future reform in the era of the UN Convention on the Rights of Persons with Disabilities; and, reflects on the 2007 Act's practical impact.

Firstly, with regards to thinking about what inequalities operate in later life there has been an excessive preoccupation with economic resources. On the other hand, less attention has been paid to cultural norms and values, other resources, wider social processes, political participation and community engagement. Secondly, in terms of thinking about the ‘who’ of inequality, this has so far been limited to a very narrow range of minority populations. Finally, when considering the ‘how’ of inequality, social gerontology’s theoretical analyses remain under-developed. The overall effect of these issues is that social gerontology remains deeply embedded in normative assumptions which serve to exclude a wide range of older people. Ageing, Diversity and Equality aims to challenge and provoke the above described normativity and offer an alternative approach which highlights the heterogeneity and diversity of ageing, associated inequalities and their intersections. The Commission has since been working with the Department to implement significant changes, under a three-year transformation programme between 2013-14 and 2015-16.

When these factors are not optimal in a community, it does not mean they are intractable: such inequities can be mitigated by social policies that can shape health in powerful ways. In the mental health context, the CRPD directs governments to ensure people with mental impairments are treated equally before the law, including ensuring people have access to the resources necessary to enjoy their rights. But what this means in practice remains unclear. In addition, current domestic laws that authorise involuntary psychiatric interventions stand at cross-purposes with the CRPD, which requires respect for the 'will, preference and rights' of persons with disabilities 'on an equal basis with others'. This book explores the implications of the CRPD for law, policy and practice that respond to the complex issues raised by mental health impairment and disability. It argues that the support framework of the CRPD holds the potential to address persistent shortcomings in mental health law and policy.

Book excerpt: Following its annual review of the work of the Care Quality Commission (CQC), the Health Committee reports that the bias of the work in the CQC away from its core function of inspection and towards the essentially administrative task of registration, represents a significant distortion of priorities. The Committee reports that: the CQC was established without sufficiently clear and realistic definition of its priorities and objectives; the timescales and resource implications of the functions of the CQC were not properly analysed; the registration process itself was not properly tested and proven before it was rolled out; the CQC failed to draw the implications of these failures adequately to the attention of ministers, Parliament and the public. Consequently, the Committee welcomes the government's decision to postpone registration of GP practices, and recommends that proper planning, including piloting of the model for registration, should be undertaken before the revised date of April 2013 is confirmed. The Committee also welcomes recent announcements that the CQC intends to undertake annual visits of all NHS and social care providers. It goes on to stress the importance of the role of inspectors in assessing the culture in care providers, especially concerning the obligation which rests on all healthcare professionals to raise concerns if they recognise, or ought to have recognised, evidence of failure of professional standards. Each provider organisation should recognise and respect this professional obligation and provide proper security to those professional staff who discharge it effectively.
