Each case study contains: a synopsis and details of the case in question, and important bibliographical references; these are followed by a summary of the facts and procedure, claims of the parties, findings of the panel, issues raised in the appeal, conclusions of the appellate body and scholarly observations. Each case is analyzed by a different scholar in the field, so as to ensure the involvement in the series of the widest range of (English and French speaking) scholars and practitioners. This approach to the case-law gives the reader a complete and objective account of the reasoning of the dispute resolution mechanism, including numerous quotes (in italics when they are extracted from the case in question, for ease of reference), while at the same time offering a critical perspective, which analyses the reasoning adopted and places it in a global perspective. The volumes are organized chronologically, and the cases of a particular year are usually covered in two consecutive volumes. The very existence of these procedures, and the manner in which the adjudicative bodies accomplish their task, give evidence of the fact that compliance with judgments in the international legal order does not inevitably lie outside the realm of the law. The WTO system thereby expresses but also fulfills a strong ambition, unique when considered through the lens of international law: strengthening the rule of law by vesting the adjudicative bodies with the task of supervising, reviewing, and ultimately contributing to inducing and enforcing compliance with their own judgments.

The notion of boundary is universal as boundaries are also an important part of human social organization. Through the ages, boundaries have remained the container by which national space is delineated and contained. For as long as there has been human society based on territoriality and space, there have been boundaries. With their dual character of exclusivism and inclusivism, states have proven to adopt a more structural approach to the respect of the former in consciousness of the esteem of international law governing sovereignty and territorial integrity. However, frontier peoples and their realities have often opted for the latter situation, imposing a more functionalist perception of these imaginary lines and prompting a border opinion shift to a more blurring form of representation and meaning in most African communities. This collective multidisciplinary effort of understanding how tangible and intangible borders have influenced Africas attitude and existence for ages is worthy in its own rights. The difference between what borders are and what they are not to a people is the mere product of their own estimations and practices, a disposition that leads the contributors to this book to study borders beyond states or nations and how borders are crossed or transferred from one point to the other for the convenience of their histories and being.

Les actes de ce colloque sont consacrés dans un premier temps au droit positif des brevets d'invention et de leur valorisation. Dans un second temps, sont examinées les évolutions, positives ou négatives, que l'économie mondialisée risque de produire ou a déjà commencé de produire sur le droit actuel, de même que les réactions qu'elle suscite, ou devrait susciter, à tort ou à raison. Pour mener ces réflexions, les Académies ont fait appel aussi bien à des intervenants issus du monde de l'industrie qu'à des chercheurs et universitaires, mais également à des représentants de cabinets de brevets, de l'Office européen des brevets et de la Commission européenne. D'élément d'une stratégie d'entreprise à une stratégie d'État, le droit des brevets, souvent encore national, est confronté à cette économie mondialisée. De celle-ci découle également la multiplication des acteurs intervenant dans ce champ d'action traditionnellement restreint aux relations entre inventeurs et employeurs d'une part, brevetés et licenciés d'autre part. Le monopole accordé par le brevet est-il à remettre en cause ou doit-il être modifié du fait de cette évolution ? Autant de questions auxquelles le présent ouvrage contribue à répondre.
