Book Property s Boundaries

Download or read book Property s Boundaries written by James Toomey and published by . This book was released on 2023 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: “Property law has a boundary problem. Courts are routinely called upon to decide whether certain kinds of things can be owned—cells, genes, organs, gametes, embryos, corpses, personal data and more. Under prevailing contemporary theories of property law, questions like these have no justiciable answers. Because property has no conceptual essence, they maintain, its boundaries are arbitrary—a flexible normative choice more properly legislative than judicial. This Article instead offers a straightforward descriptive theory of property’s boundaries. The common law of property is legitimated by its basis in the concept of ownership, a descriptive relationship of absolute control that exists outside of the law. Ownership’s limits thus lie at the limits of absolute control—that which cannot in principle be the subject of human dominion cannot be owned. In short, the Article offers a comprehensive explanation for why a conceptual theory of property’s limits matters and how one can be possible, and defends a substantive theory of the concept of ownership as control. Under this theory, cells, organs, gametes, embryos and corpses can be owned. But information—like genes and personal data—that cannot be controlled cannot be owned. Viewed through this lens, intellectual property—a challenge for any theory of property and which appears to entail ownership in information—can be understood either as a statutory analogy or a rough approximation of the real but temporary control of information exercised by those who create or discover it.”

Book Setting Boundaries Will Set You Free

Download or read book Setting Boundaries Will Set You Free written by Nancy Levin and published by Hay House, Inc. This book was released on 2021-01-12 with total page 258 pages. Available in PDF, EPUB and Kindle. Book excerpt: Do you feel like you're a "pushover"? Do you let other people make all the plans--letting them pick the movie, the restaurant, or the vacation destination? Does self-care feel selfish to you? And do you find yourself feeling resentful toward others because they don't seem to take your needs into consideration? Can you relate? If the answer is yes, this is the book for you! In this book, master coach, speaker, and author Nancy Levin will help you establish clear and healthy boundaries. This isn't easy; many of us don't want to "rock the boat." We assume setting boundaries will lead to conflict. And, unfortunately, by avoiding conflict and not setting limits, we tend to choose long-term unhappiness instead of short-term discomfort. This book includes exercises and practical tools to help even the most conflict-averse, people-pleasing readers learn new habits. You'll learn how to recognize and take inventory of your boundaries, view your boundaries differently by creating a Boundary Pyramid, learn how to say "no" effectively, and set your Bottom-Line Boundary. As your supportive guide, Nancy will show you how to gather the courage to live a life of "boundary badassery." "This work was life-changing for me, and if you're someone who has avoided boundaries for years, it can change your life, too." -- Nancy Levin

Book Illinois Boundary Law

Download or read book Illinois Boundary Law written by Jeffery N. Lucas and published by . This book was released on 2012 with total page 628 pages. Available in PDF, EPUB and Kindle. Book excerpt: Illinois Boundary Law is the essential reference book for anyone who needs to understand real property boundaries under Illinois law. Written primarily for land surveyors, this book is also a valuable tool for real estate professionals, attorneys, and landowners. Arranged in eleven chapters, the subject matter includes the origination of real property title in the State of Illinois, how real property boundaries are established on the ground, deeds, conveyances, surveying systems, easements, and rights-of-way. Written in a similar fashion to a law school casebook, there are plenty of court opinions, excerpts from cases and citations to actual lawsuits involving boundary disputes, adverse possession, negligence actions, trespass issues and slander of title, to name a few. Cases from other jurisdictions have been included on points where Illinois' courts have been silent. This book is an intriguing read for anyone interested in the history and development of real property boundaries in Illinois.
