Explanatory footnotes in English. The Kitab al-Athar was the first book composed in Islam after the generation of the Companions. Al-Imam al-Azam Abu Hanifah Numan ibn Thabit wrote it. It comprises Ahadith that connect directly back to the Messenger of Allah sallallahu ‘alayhi wasallam (marfu), those which stop short at a Companion or one of the Followers (mawquf) and those which are attributed to the Messenger sallallahu ‘alayhi wasallam directly by one of the Followers or Followers of the Followers without attribution to a Companion (mursal). His companions Imam Abu Yusuf, Imam Zufar, Imam Muhammad, Imam al-Hasan ibn Ziyad, Imam Hammad ibn Abi Hanifah the Imams son, Hafs ibn Ghiyath and others narrated it from him. In the version before us, Imam Muhammad, himself a mujtahid, narrated each tradition from Imam Abu Hanifah and then followed each with some explanatory material, sometimes confirming and occasionally differing with his Imam. Imam Abu Hanifah Imam Abu Hanifah was from Kufa and was one of the Followers (taabioon). He was born in 80 AH in a family of Persian ancestry. Imam Abu Hanifah was a trader in fabrics. He studied with the great scholars of Kufa who transmitted the schools of Ibn Masud and Ali ibn Abi Talib in particular, but he also travelled further afield in search of hadith and fiqh. He was noted for his exceptional grasp of fiqh, and is said to have laid its foundations. He died in 150 AH in Baghdad. His list of teachers is very extensive, and his list of pupils a roll-call of honour. Sahl ibn Muzahim said, Abu Hanifahs knowledge was universal knowledge. Ash-Shafiee said, In fiqh people are the needy dependents of Abu Hanifah. Imam Muhammad He is Abu Abdillah Muhammad ibn al-Hasan ibn Farqad ash-Shaybani. Muhammad was born in Wasit in 132 AH, and grew up in Kufa. He was a pupil of Abu Hanifah. Ash-Shafiee said, I have not seen anyone more eloquent than him. I used to think when I saw him reciting the Quran that it was as if the Quran had been revealed in his language. He also said, I have not seen anyone more intelligent than Muhammad ibn al-Hasan. He introduced criteria to differentiate between the Prophetic traditions that were meant to be part of Islamic law and the Prophetic actions/ sayings that were meant to be for the sake of specific purposes such as political leadership, court judgment, friendly advice, and conflict resolution. But Ibn Ashur’s most significant contribution in this book has been the development of new Maqasid by coining new, contemporary, terminology that were never formulated in traditional usul al-fiqh. For example, Ibn Ashur developed the theory of the ‘preservation of lineage’ into ‘the preservation of the family system’, the ‘protection of true belief’ into ‘freedom of beliefs’, etc. He also introduced the concepts of ‘orderliness’, ‘natural disposition’, ‘freedom’, ‘rights’, ‘civility’, and ‘equality’ as Maqasid in their own right, and upon which the whole Islamic law is based. This development opens great opportunities for Islamic law to address current and real challenges for Muslim societies and Muslim minorities.

(Farīd al-Anṣārī Mafhūm al-'Ālimiyyah) The works of Ibn Juzayy partake of a particular miraculous quality of the last of the Messengers of Allah, may Allah bless him and them and grant them peace: they unite concision and comprehensiveness. Comprehensively, the author presents both the range of judgments within the school of the People of Madīnah as well as the range of judgments among the madhhabs at large, but with concision in a single modest Arabic volume. He covers not only 'aqīdah and 'ibādāt but also mu'āmalāt, other matters of taṣawwuf, and yet others pertaining to history, i.e. the sīrah of the Messenger ﷺ, the khulafā' and Andalus. His main concern is to say with clarity what the dīn IS, and then to note the legitimate differences, and sometimes the illegitimate ones in order to dismiss them. To show the spectrum of valid differences is vitally important in the age of literalism that says "tell me the ṣaḥīḥ hadith so that I can act on it" or in its Mālikī version, "tell me the well-known judgment (mashhūr)." The author carefully lets the reader know the well-known judgments (mashhūr) but sets them within the spectrum of valid judgments from the luminaries among Mālik's students, such as Ibn al-Qāsim, Ashhab, Aṣbagh, Ibn Wahb and Ibn al-Mājishūn et al, who, it is well to remember, may simply be acting on what they learnt from Mālik himself. Following Ibn Juzayy's own division of his work into two parts, we here publish Volume 1 containing the chapters on 'aqīdah and 'ibādāt, reserving mu'āmalāt for Volume 2. Ibn Juzayy was Abu-l-Qāsim Muḥammad ibn Aḥmad ibn Muḥammad ibn 'Abdullāh ibn Yaḥyā ibn 'Abd ar-Raḥmān ibn Yūsuf ibn Sa'īd ibn Juzayy al-Kalbī. He was born on the 19th Rabī' al-Awwal in 693 AH/1294 CE. He mastered the essential sciences of the dīn, and wrote significant works on tafsīr, hadith, 'aqīdah, taṣawwuf, qirā'āt (recitations and rescensions of the Qur'ān) and uṣūl al-fiqh. He died as a shahīd in the Battle of Tareef on Monday 7th Jumāda-l-Ūlā 741 AH/30th October 1340 CE. Dr. Asadullah Yate (Cantab.) has translated works from Arabic, Persian, German and French, and, in collaboration with others, from Turkish. He teaches Arabic and Fiqh at the Weimar Institute, and is Imam al-Khateeb at the mosque of Stralsund, Germany.
