It was a member of the League of Nations. Albania became independent on November 28, 1912, after centuries of Ottoman domination. Its existence was recognized internationally after the First Balkan War on July 28, 1913, and an international control commission drew up a constitution in 1914, providing for a monarchy with a National Assembly most of whose members were elected by the people. 4 Albania Although a neutral state, Albania became involved in the First World War, after which, in January 1920, the Albanian chiefs drew up a new constitution providing for a monarchy. In 1925, Albania was proclaimed a republic and a new constitution, based on the United States constitution, was promulgated. In 1928, the President became King and a new consti tution followed. On April 7, 1939, Italy occupied Albania and imposed a constitution providing that Albania was a monarchy under the House of Savoy. On April6, 1941, martial law was proclaimed throughout the country. After the Italian capitulation in 1943, Albania was occupied by Germany. The Albanian Communist Party was founded in November 1941, and the bases of the communist regime were laid at the second national confer ence in July 1943 of the Movement for National Liberation, created by the Party to unite and control all the forces opposing foreign occupation. This conference created Councils of National Liberation.

How can you repeal a law that interferes with your sphere of rights? These are some of the questions that any citizen in a democratic country should know in order to enjoy his/her freedom and rights. Even a small country like Albania is no exception. New and modern Constitutions, aim to regulate the exercise of state power, based on the principle of separation of powers and to the respect for human rights and fundamental freedoms. Despite the fact that this important principle helps to control the activity between different state institutions, the history has shown that this has not always been an efficient solution. So, the world is full of examples where a parliamentary majority, that have come to power through democratic processes, has used its power to control the others power of a country and had violated the human rights and fundamental freedoms. For this reason, the drafters of the constitution after the Second World War in Western Europe and after the fall of communism in Eastern European countries, have established and regulated the creation of the Constitutional Court as an institution which can defend the sphere of the competencies of other institutions with constitutional nature and the protection of human rights and fundamental freedoms. This possibility can only be realized using procedural means, through which the Constitutional Court is put into motion. The purpose of this book is precisely, to analyze these procedural mechanisms with regard to the principles of the constitutional process, the jurisdictions, the admissibility of the applications, the procedural position of the parties, the terms and their calculation, procedural acts and evidence that can be used, as well as, procedural characteristics for each constitutional process. A good knowledge of these principles and rules of procedure helps the different applicants who presented themselves to the Constitutional Court to have higher chances to succeed and to be accepted instead of being dismissing because of procedural deficiencies. This book show all of this aspects in the content of the Albanian experience.

Book excerpt: The nonviolent revolution of Albania reinforced the belief in the West that democracy is an exportable good if Western democracies implement a right combination of pressure and aid in collaboration with internal political actors. Western pressure, coupled with technical and economic assistance was domestically understood as a conditio sine qua non for the successful implementation of the first phase of democratic reforms. However, efforts to establish a democracy in Albania raised the following question. Will the framing of the appropriate constitution and economic system - building democratic institutions and developing positive attitudes towards them - take place among Albanians through ongoing familiarization? Accordingly, the failure of the 1994 referendum on the new constitution, the overnight changes of the 1998 constitution in 2008 and the permanent stagnant economy strengthened the belief among Albanians that a democratic constitution and a functioning market economy cannot flourish if they are not rooted in an environment pervaded by a democratic culture. Furthermore, if democracy has to persist and become consolidated, it is not enough just to skillfully engineer institutions without taking into account the effect of political culture. Ultimately, this book attempts to show that the efforts made by the Western countries to export democracy to Albania and to promote consolidation through political tools generalized from other alien realities, without taking into consideration Albania’s internal political culture values, have turned out to be in the long run a ‘political abortion’. On the other hand, this book should be construed neither as a critique of democracy nor as a defense of it; it is also not a balance sheet of the success or failure of democracy and democratization processes in Albania, but rather it aims at presenting an alternative approach to democratic consolidation through Albania's authentic cultural heritage.
