Book Newcomers Navigating the Welfare State

Download or read book Newcomers Navigating the Welfare State written by Hanne Vandermeerschen and published by Leuven University Press. This book was released on 2023-12-15 with total page 318 pages. Available in PDF, EPUB and Kindle. Book excerpt: The topic of social assistance for migrant newcomers often sparks heated public debate and remains a prominent concern on the policy agenda. Society has experienced a growing level of diversity. This reality gives rise to new demands and changing profiles of individuals who benefit from welfare services. Welfare institutions, which are responsible for providing social assistance, play a crucial role in granting access to social benefits for newcomers. Moreover, the provision of social assistance can significantly influence the settlement and integration processes of migrants. This book provides empirical insights into the alignment between the needs of newcomers and the service provided to them. It examines the accessibility of social assistance for newcomers from a comprehensive perspective, encompassing aspects such as gaining access (including equal access for all) and service availability. By focusing on the Belgian Public Centres for Social Welfare as a case study, the authors explore the policies and practices related to social assistance and labour market activation for newcomers and the factors that influence individuals’ access to their rights. By incorporating the perspectives of all the relevant stakeholders involved, drawing on the insights of social workers and managers as well as the experiences of newcomers themselves, this book offers a unique understanding of the interactions between immigrants, the welfare state, and street-level bureaucrats. It provides valuable insights for enhancing service provision, striving for a more inclusive approach.

Download or read book International Social Security Law written by Jean-Michel Servais and published by Kluwer Law International B.V.. This book was released on 2020-12-20 with total page 257 pages. Available in PDF, EPUB and Kindle. Book excerpt: Although a sophisticated body of international social security law is active and growing, a number of States still appear unable to honour it. This thorough, well-researched survey and analysis of existing international social security - its sources, its content, its historical development - is thus especially valuable for its informed consideration of the barriers to the law’s full effectiveness. Part of the renowned multi-volumeEncyclopaedia of Laws, the book focuses on the analysis of the International Labour Organization (ILO)Conventions and Recommendations on Social Security. It examines the most recent public debates on social protection (dealing with health insurance, unemployment benefits, pension age, minimum income, social security benefits in case of expatriation, parental leave, and much more), includes an updated bibliography, and opens some perspectives for the future work of the global institutions. It integrates the latest instruments, in particular ILO Recommendation No. 202 concerning national floors of social protection. Even in the absence of ratification and therefore of legal force, international social security standards are invaluable benchmarks in comparative law. Indeed, ILO standards are both useful instruments of analysis and excellent yardsticks for identifying common denominators among national systems. For these reasons this book will be welcomed by legislators, government officials, employers’ organizations, trade unions, and the judiciary, as well as by human resources managers and academics.

Book Law and Migration in a Changing World

Download or read book Law and Migration in a Changing World written by Marie-Claire Foblets and published by Springer Nature. This book was released on 2022-04-05 with total page 843 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume comprises national reports on migration and migration law from 17 countries representing all continents. The vast majority of these are countries of immigration, which means they face specific challenges in terms of managing migratory flows that are increasingly linked with climate change and scarce natural resources worldwide, and they need to find viable ways to integrate humanitarian migration. Unlike so many recent publications in the field of international migration law, this book brings together reports on diverse countries that are rarely regarded as part of one and the same picture, depicting globalized migration in the contemporary era that to a large extent challenges state sovereignty. The contributions delineate the legal regimes that individual states are continually developing and modifying with a view to managing and controlling access of individual persons to their respective territories. They also show how the restrictive measures that states resort to in the event of failure to manage migration could have a lasting legal impact. The General Report preceding the country reports provides a comparative overview of the national reports, and is divided into two parts. The first, more technical in nature, addresses the classic questions relating to admission to and residence in a country. The second, more reflective section, examines the relationship between laws and migration in a wider and multidisciplinary perspective. To allow a robust comparison, the country reports all follow a similarly wide-ranging structure; to the extent possible, they also cover the historical, sociological and demographic factors that help explain legal regimes and migratory flows in each country. Each country report includes analyses of recent legislative developments and delicate questions that are still awaiting adequate (legal) responses as well as perspectives for the future.

Book The Reality of Human Dignity in Law and Bioethics

Download or read book The Reality of Human Dignity in Law and Bioethics written by Brigitte Feuillet-Liger and published by Springer. This book was released on 2018-11-19 with total page 318 pages. Available in PDF, EPUB and Kindle. Book excerpt: Adopting an interdisciplinary perspective, this volume explores the reality of the principle of human dignity – a core value which is increasingly invoked in our societies and legal systems. This book provides a systematic overview of the legal and philosophical concept in sixteen countries representing different cultural and religious contexts and examines in particular its use in a developing case law (including of the European Court of Human Rights and of the Inter-American Court of Human Rights). Whilst omnipresent in the context of bioethics, this book reveals its wider use in healthcare more generally, treatment of prisoners, education, employment, and matters of life and death in many countries. In this unique comparative work, contributing authors share a multidisciplinary analysis of the use (and potential misuse) of the principle of dignity in Europe, Africa, South and North America and Asia. By revealing the ambivalence of human dignity in a wide range of cultures and contexts and through the evolving reality of case law, this book is a valuable resource for students, scholars and professionals working in bioethics, medicine, social sciences and law. Ultimately, it will make all those who invoke the principle of human dignity more aware of its multi-layered character and force us all to reflect on its ability to further social justice within our societies.
