It draws conclusions on why progress has been slow on introducing competitive public managements systems and practices in the new member states. This report proposes an agenda for reform as well as alternatives to traditional approaches to strengthening public management systems.

More specifically, it studies member states’ ability to exert control over the European Commission during trade negotiations. But what determines administrative capacity and how do member states ensure their preferences are defended during trade negotiations? A combination of qualitative fieldwork and survey-analysis provides the answer. Interviews in Belgium, Poland, Estonia and Spain offer a privileged insight into the functioning of national trade administrations and its effects on their behavior in the Council of Ministers. Through survey data, these findings are further corroborated. The book is aimed at a readership interested in EU decision-making, negotiation theory, comparative public administration and the international political economy of trade.

Book excerpt: The chapter focuses on administrative capacity and domestic EU-coordination structures in new member states. It analyzes data from 65 semi-structured interviews with Brussels officials and confronts them with primary data and review of the existing research on EU member states. It is argued that the Central and Eastern European states in the EU are predominantly influenced by the length of their membership, their size and their human resources management in EU affairs. The length of the membership influences member states' knowledge about inner workings of the EU and their ability to build and sustain institutional relations and networks with and within EU institutions. Being mostly small countries, new member states (NMS) have used prioritization of issues and EU presidency as a contra-strategy, but have had only limited success in uploading their preferences to the EU level so far. In the personnel policy, several NMS revised their conditionality-influenced legislation on civil service after becoming EU members, which seems to have influence on a high level of turnover in EU bureaucratic positions, and is directly connected to NMS' ability to establish and defend their national positions in the EU affairs.

Book excerpt: Is there a European administration, are we witnessing a new order in administration, or only a mechanism aiming at ensuring co-operation between national administrations? The trend of enlargement of the European Union bears the influence of public administration that behaves as an inner actor, finding itself in the process of becoming a federal State. The direct impact of the EU on the administrative systems of member States is quite limited. In fact, EU does not have any direct competence in this field. Administrative organization of member States is a matter that falls under the competence of member States. Anyhow, there are numerous ways of indirect influence upon member States and those States that desire the integration. Existing administrative structures and national characteristics of member States, the fact that those structures are closer to the newly created situations (after the revolutions), and to the people they are responsible for and also the structural framework of the EU, were those elements that led to reforms in administration. Taking into account the problems occurring in the process towards integration, Romania was among those countries the most severely criticized. The poor quality of administration is considered to be a major element when explaining the political and economic crisis. Too much corruption, present in administration, is one of those elements destroying the development of a professional, stable and impartial public administration. Generally speaking, the ability of public administration to implement the acquis communautaire is quite small, and this is the factor that restricted the possibilities of negotiations for Romania's integration to EU. The trend of evolution of the Reform in the public sector followed a winding line. We must say it that none of the models used so far has not produced the expected results. Political factors and administration showed a permanent confusion in the measures they have taken. Lack of decision, instability, improvisation and lack of coherence in the decisions taken led to a mistrust of Romanian people and foreign organizations in Romania's capability to self-governing.

A significant upshot of these issues is that the concept of European identity - defined in terms of such factors as culture, history and economics - has supplanted the long-dominant theme of 'widening and deepening, ' particularly since the Union's expansion has become primarily eastward. The major contribution of this important book lies in its analysis of the conceptualization and perception of enlargement from various points of view, focusing on the concerns of stakeholders and the 'identity' conflicts and uncertainties incurred by enlargement initiatives. In the course of its presentation, it details the actual pre-accession Europeanization process and its complex history. Among the key elements discussed are the following: the conflict between 'widening' and 'deepening' and the effect on EU institutional reform; institutional requirements on candidate countries; pre-accession criteria and negotiations; administrative capacity, judicial capacity, and legal approximation in accession states; capacity of the EU to absorb new Member States; and EC law as part of European identity. Also covered are specific historical details of particular pre-accession negotiations (e.g., Greece, Spain, Portugal, Malta, and Cyprus), the still inconclusive negotiations with Turkey and the Western Balkan states, and political factors involved in the non-accession of Norway, Iceland and Switzerland. Assembling powerful evidence and applying incisive analysis, the author's conclusion shows that, absent further (and major) EU institutional reform, it will be difficult for an enlarging Union to continue to 'deliver the goods.' A watershed in the continuing great debate on the fulfilment of the EC Treaty's determination to foster and promote 'an ever closer union of the peoples of Europe, ' this book will prove invaluable to anybody interested in the European integration project, particularly lawyers, academics, officials and policymakers in the EU Member States.

Book excerpt: It has become apparent that a clear gap exists between European Union (EU) level policymaking and Member State implementation. Previous research has neglected to fully define factors that encourage or prevent implementation processes and instead focused on upstream decision making processes or downstream effects of policy. Simona Milio here proposes a shift in analytical focus towards policy-implementation since this constitutes a crucial common pathway that determines whether a policy actually becomes effective or not. EU implementation deficits appear to be influenced by problems related to the multi-level structure of European policy making. Successful implementation will only occur if relevant policy actors at national and sub-national levels are persuaded to co-operate with EU policy goals. Furthermore, this co-operation is not possible unless all parties manage the complex policy networks and implementation regimes responsible for putting European policies into force. Within this framework, this book answers three important questions: 1 Is the EU multi-level governance system weakening the implementation of policies? 2 Are national and sub-national governments capable of dealing with the challenges imposed by multi-level governance? 3 Which factors account for differences in implementation performance among Member States? In order to answer these questions, Simona Milio's research explores the influence of two variables on implementation processes: Administrative Capacity and Political Stability. Cohesion Policy is chosen as the focus of this study since it has demonstrated a dramatically different implementation pace among EU Member States over the past 20 years. Three EU Member States are chosen to test the hypothesis. Italy appears to be a pertinent example, given its constant struggle to conform to EU directives and to implement Cohesion Policy. Spain is chosen since, in contrast to the Italian scenario, it represents the best performing Member State in terms of implementation. Finally Poland is studied, as a case where a shift from centralization towards decentralization has occurred in order to implement Cohesion Policy and integrate the multi-level governance system.

Among the many uncertainties, anxieties and tensions, it is, however, the cumulative challenge of fiscal austerity, demographic developments, and climate change that presents the key test for contemporary states. Debates abound regarding the state's ability to address these and other problems given increasingly dispersed forms of governing and institutional vulnerabilities created by politico-administrative and economic decision-making structures. This volume advances these debates, first, by moving towards a cross-sectoral perspective that takes into account the cumulative nature of the contemporary challenge to governance focusing on the key governance areas of infrastructure, sustainability, social welfare, and social integration; second, by considering innovations that have sought to add problem-solving capacity; and third, by exploring the kind of administrative capacities (delivery, regulatory, coordination, and analytical) required to encourage and sustain innovative problem-solving. This book provides the first extended account of how effective they are at addressing 'wicked' policy problems which simultaneously demand greater levels of horizontal and vertical coordination. Taking, as an example, the thirty year struggle to integrate environmental thinking into all areas and levels of EU policy making, it offers a stark reminder that networked governance is not and is unlikely ever to be a panacea.
