Book excerpt: Since its foundation, the Council of Europe has established a common legal system for European states, based on democracy, the rule of law and human rights. Its standard-setting texts have helped its members meet the challenges of changing societies and now apply all over Europe given the organisation¿s unprecedented geographical enlargement since 1989. In this connection, the Council of Europe has played a key role in the accession of the new member states to the European Union. The first section of the book deals with the "constitutional" law of the Council of Europe, or its internal statutes in the broad sense. It covers the 1949 Statute, which, along with related texts, lays down the Council¿s aims and determines its membership and operating methods. The second section concerns the role played by the Council of Europe - which has always been very active in standard-setting - in the harmonisation of European states¿ domestic law. The third section situates Council of Europe law in the European context. For instance, it studies the extent to which Council of Europe conventions have been incorporated in domestic law and how Council of Europe law and European Union law co-exist.

Book excerpt: The implementation of the recommendations of the 3rd Summit of Heads of State and Government of the Council of Europe (Warsaw, May 2005) resulted in the launch in 2006 of a number of European campaigns, in particular "Building a Europe for and with children"; the "Campaign to combat trafficking in human beings"; "All different, All equal"; "Stop domestic violence against women"; and the 'Dosta!" awareness-raising campaign to end prejudice against the Roma. Kosovo was a major political concern for the Council of Europe. Through its Venice Commission, it provided expert input for the preparation of the future status of the region and continued to provide expert advice on the implementation of European standards in such fields as the protection of human rights, minority rights, decentralisation, cultural heritage protection and constitutional law. The Republic of Montenegro applied for membership of the Council of Europe following the 21 May referendum, which paved the way for its independence. Serbia, on the other hand, succeeded the former State Union of Serbia and Montenegro as a member state of the Organisation. The Council of Europe was the first organisation to look into the allegations of secret detentions and unlawful transfers of suspected terrorists in the member states. The Parliamentary Assembly and the Secretary General each carried out investigations which revealed that Council of Europe member states have not set up effective legal safeguards against such practices, which violate the European Convention on Human Rights.

Book excerpt: In a world of increasing dependence on information technology, the prevention of cyberattacks on a nation's important computer and communications systems and networks is a problem that looms large. Given the demonstrated limitations of passive cybersecurity defense measures, it is natural to consider the possibility that deterrence might play a useful role in preventing cyberattacks against the United States and its vital interests. At the request of the Office of the Director of National Intelligence, the National Research Council undertook a two-phase project aimed to foster a broad, multidisciplinary examination of strategies for deterring cyberattacks on the United States and of the possible utility of these strategies for the U.S. government. The first phase produced a letter report providing basic information needed to understand the nature of the problem and to articulate important questions that can drive research regarding ways of more effectively preventing, discouraging, and inhibiting hostile activity against important U.S. information systems and networks. The second phase of the project entailed selecting appropriate experts to write papers on questions raised in the letter report. A number of experts, identified by the committee, were commissioned to write these papers under contract with the National Academy of Sciences. Commissioned papers were discussed at a public workshop held June 10-11, 2010, in Washington, D.C., and authors revised their papers after the workshop. Although the authors were selected and the papers reviewed and discussed by the committee, the individually authored papers do not reflect consensus views of the committee, and the reader should view these papers as offering points of departure that can stimulate further work on the topics discussed. The papers presented in this volume are published essentially as received from the authors, with some proofreading corrections made as limited time allowed.

In the first part, the authors explain the background and origins of the CPT, its membership and modus operandi, as well as how it interacts with other bodies, such as the UN’s Subcommittee on Prevention of Torture (SPT) and the national preventive mechanisms (NPMs). In the second part, the authors describe the CPT’s key findings and standards in the main situations of deprivation of liberty (police, prison, immigration detention, mental health and social care). It gives a full scientific account of a research project carried out amongst Flemish learners of German. The focus of the research was on the relationships between the culture teaching approaches adopted in textbooks and the pupils' learning of culture. Although the sub-title refers to a particular group of pupils learning a particular language, the study has more general bearing and constitutes a substantial contribution to the literature, and in particular empirical research, on the development of intercultural competence in and through foreign language education.The composition of the volume reflects the affective, cognitive and contact dimensions of the culture learning process. It also gives space to the theoretical platform on which the research was built, and to the research methodology adopted. Chapter 1 sets out to contextualise and define the research topic. It clarifies the study's position within the field of culture-and-language learning-and-teaching theory, practice and research. It also situates the investigation into the specific context of teaching and learning foreign languages-and-cultures in Flanders. In chapter 2 the theoretical framework informing the study is developed. Chapter 3 provides an overview of the techniques of data collection and analysis employed, of the kinds of data collected, and of the chronology of data collection. Chapters 4, 5 and 6 provide an interpretative description and analysis of the investigation's key concepts. Chapters 4 and 5 focus on the pupils' culture learning processes and analyse relationships between attitude, contact and perception data. In chapter 6 the culture teaching approaches adopted in the investigated textbook series are described and evaluated with regard to their potential for promoting the pupils' learning of culture. Chapter 7, finally, provides a summary overview of the study's main findings and presents the main conclusions that can be drawn from the evidence presented in earlier chapters. It estimates the value of the study's research methodology and theoretical framework. It also reflects on how the research findings can find application and implementation.
