Interpretation must conform to Statute and Genera Rules.1?The decisions in each State must conform to its own mechanics' lien law.2 The federal tribunals, in matters of lien, are bound by the decisions of the highest court of a State in interpreting its own statute.3 There is no distinction to be observed in the construction of statutes creating these liens, and other expressions of legislative will. The general rules adopted to discover and interpret the intention of laws are also applicable.4 Thus, the whole law on the subject of mechanics' lien must be read together when interpreting the rights of parties under any of its provisions.5 Again, it has been declared that, as acts in relation to mechanics' liens establish a system altogether out of the course of the common law, when points arise evidently not foreseen by the legislature, and upon which the statutes have not spoken, the grounds of decision to be resorted to must be the general scope and spirit of the enactment, the analogy of cases which have already been settled, and such considerations of policy as may be supposed to have had the1r influence on the minds of the law-makers, and to aim at such results as will most effectually promote the interest and security of those classes of men whom the system was designed to favor.6 Upon a doubtful question of construction, the argument from inconvenience has great force.1 As when the whole of enactments are considered in connection, and it is impracticable to carry out a particular intent by any procedure provided by the statute, or where absurd consequences in many supposable cases would result, these circumstances are sufficient to determine the judgment of the Court.2 So where an injustice would result from the constructi...

(hoyt vs. Story, 3 Barb., From the common law lien on personal property is derived the principle of the mechanic's lien by special statutes which now exist in nearly all the States, by virtue of which mechan ics, material men or persons furnishing labor or materials for the erection, alteration or repairing of buildings, are entitled to perfect a lien therefor on such buildings and the land to a certain extent, which is a preference over other creditors in the payment of debts. This right, given and prescribed by special statute, is of a remedial character, merely providing a new rem edy without increasing the liability of the owner. Liens on lands in similar cases were given by the Roman Law, Domat's Civil Law, 1742, 1744, and by the Code Napoleon, p. 571. Great Britain has not yet any similar law relating to the subject. The policy of the system in its early stages among us has often seriously been questioned, and doubts have frequently been expressed as to whether, upon the whole, it works well even for those for whose benefit it was enacted. This is owing entirely to the imperfections of the statutes, or their construo tion by the courts under which the system was attempted to be carried out. Book excerpt: Excerpt from Treatise on the Mechanic's Lien Law, of California: Passed March 30, 1868; With an Appendix, Containing the Various Forms Required Under the Act, Together With a Copy of the Act, and an Ample Index The law passed at the last session of our Legislature on the subject of Mechanics' Lion has a most important effect as well upon the rights of mechanics, laborers, and persons furnishing materials for the construction and repairs of buildings and other superstructures, as upon the rights of those owning and making improvements on real estate. It has also an important effect on the rights of capitalists and loan societies lending money on mortgage. It is very clear, that without proper precautions, a real estate owner may, through this Act, be compelled to pay a much larger sum for improvements than he has contracted to pay, and may even be made personally responsible on demands for which he never contemplated a personal liability, while those having mortgages or other equitable claims upon the land may be seriously affected in their rights. The Act is a very crude and inconsistent piece of legislation, and requires many amendments for the benefit as well of the mechanic as the owner of real estate. Still, it will remain the law of the land till the year 1870, as no legislation is likely to be had on it till that time. It was thought by the author of this brief treatise, that in the meantime a work of this character, with the forms given in the appendix, might be useful to the community, and that when amendments are made by the next Legislature a second edition can be issued. Most of the States have Mechanics' Lien Laws, and decisions have been rendered under them in the Courts of the different States where they exist.
