Book A Treatise on the Law of Court Practice and Procedure Civil and Criminal and Procedure Preliminary and Incidental Thereto Under the Code Classic Reprint

Download or read book A Treatise on the Law of Court Practice and Procedure Civil and Criminal and Procedure Preliminary and Incidental Thereto Under the Code Classic Reprint written by Edgar B. Kinkead and published by Forgotten Books. This book was released on 2015-07-04 with total page 746 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on the Law of Court Practice and Procedure, Civil and Criminal, and Procedure Preliminary and Incidental Thereto Under the Code This volume, covering a new field for a book, local in its nature, is now offered as a companion to the authors "Code Pleading" and "Instructions and Entries." The language of Justice Ranney in Ellis v. Insurance Company, 4 Ohio State, 628, 645, to the effect that: If there is anything eminently and exclusively our own, it is our system of legal procedure, expresses the idea of this book. It treats upon all questions of Practice, from the filing of the first pleading, or from the formation of the issues to the termination of the action, in the nisi prius, and the appellate, or reviewing courts. It deals with matters preliminary, such as The Time of Commencing Actions, Jurisdiction, Process, c., following which is a discussion of the modes of trial considering all questions relating thereto. Then follows Judgment, Execution and Sale, c., Appeal and Error. The book is named "Court Practice," which embraces everything that is or may be done in court from the commencement to the final termination of a cause, and hence comprehends more than is usually understood by "Trial Practice." Book excerpt: Excerpt from A Treatise on the Principles of Pleading in Civil Actions Under the New York Code of Procedure Nor does the Code itself furnish the desideratum. It abolishes but it does not reconstruct it tears down an old system, but it does not build up a new and complete one in its place. It lays the foundation, it is true, simple, broad and strong, but it leaves the edifice to be erected; it sketches, boldly and dis tinctly the outlines, but does not fill out and com plete the picture. Book The Practice Special Actions Courts of Record

Download or read book The Practice Special Actions Courts of Record written by J. Newton Fiero and published by Forgotten Books. This book was released on 2018-02-16 with total page 818 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Practice Special Actions Courts of Record: State of New York, Under the Code of Civil Procedure and Statues, With Forms The aim of this work is to supplement the Special Proceedings which has been so favorably received by the Bar. As stated in the preface to that work, very many legal proceedings once termed special have, under the Code of Civil Procedure, become Actions. These actions are, so far as they are treated by the second part of the Code, special in the sense that the ordinary rules of practice are not applicable to them, and that to a greater or less extent specific rules are enacted relative to their conduct. Hence this work treats of special actions, including those treated by Mr. Crary in his work on Special Proceedings, together with all others which are defined and provided for by sections 1496 to 1990 of the present Code. Book The New York Civil and Criminal Justice

Download or read book The New York Civil and Criminal Justice written by H. S. McCall and published by Forgotten Books. This book was released on 2017-11-06 with total page 936 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The New York Civil and Criminal Justice: A Complete Treatise on the Civil, Criminal, and Special Powers and Duties of Justices of the Peace in the State of New York; With Numerous Forms, Adapted to the New Code of Civil Procedure, and the Criminal and Penal Codes The great favor with which the New York Civil and Criminal. Justice has been received has induced the preparation of the present edition. The rapid sale of two large editions has shown it to be a work well suited to the purpose for which it was designed. The preparation of the first edition was commenced by the late john S. Jenkins, Esq., and completed by Messrs. Christopher morgan, samuel blatchford and clarence A. Seward. The second edition was amended and enlarged by Messrs. Abbott brothers. The work having been for some time out of print, and there being a large call for it, both from Justices and members of the legal profession, it was thought advisable to review the whole work, make such alterations as the various changes in our statutes required, bring the citation of authorities down to the present time, and add quite a number Of forms to the already large number contained in the work. It will be seen that more than thirty pages have been added to the text, and the Index ren dered fuller and more complete. Book Practice and Pleading in Actions in the Courts of Record in the State of New York Under the Code of Procedure and Other Statutes When Applicable

Download or read book Practice and Pleading in Actions in the Courts of Record in the State of New York Under the Code of Procedure and Other Statutes When Applicable written by Henry Whittaker and published by Forgotten Books. This book was released on 2017-11-07 with total page 1066 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Practice and Pleading in Actions in the Courts of Record in the State of New York, Under the Code of Procedure, and Other Statutes, When Applicable: With an Appendix of Forms The author has, on the other hand, omitted from the present edition his former brief notice of independent special proceedings, and also the concluding chapter as to the retrospective effect of the Code. The latter subject has become practically obsolete; the former is, in fact, foreign to the plan of the work. That plan remains substantially the same as before. The progress of a suit in the higher courts of the state is traced, from its origin and preliminaries, down to its final determination; practical directions being given for its conduct and management, in each step which may be necessary or advisable during that progress. The provisions of the Code, of the Revised or General Statutes, and of the Rules of the Courts, which bear upon each particular division of the general subject, are, on the present occasion, cited in the body of the work, instead of being subjoined at its close. An appendix of forms is added, as heretofore, and each volume closes with an index of the subjects considered in it. The first embraces all matters connected, directly or indirectly, with the commencement and progress of a suit, down to the preparation and service of the complaint, inclusive; the second, all subsequent stages of procedure, in that suit, down to its close. Book excerpt: Excerpt from The Code of Procedure of the State of New York, as Amended to 1870: With Notes on Pleading and Practice, Rules of the Courts, and a Full Index I am grateful for the opportunity to present to my professional brethren a Tenth Edition of my Notes to the Code of Procedure. By the teachings of a'long experience, industrious] y applied, 1 flatter myself I have exhausted every resource in producing a complete and useful work. My first edition of these Notes was published in 1851, and I have edited every subsequent edition. If not the first to conceive, I was at least the first to execute, the idea of an Annotated Code. The favor the work has found with the profession evidences that it met a general want. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Digest of the New York Code of Civil Procedure: Being a Synopsis of the Chapters of the Code Relating to General Practice, in a Concise and Readable Form The first edition of this work met with a very favorable reception by the law students of New York State. Many unsought testimonials have been received testifying to its value, both in explaining difficult passages of the Code to the student unfamiliar with the technical language of the law, and in bringing together in their proper order, and in a concise form, all sections relating to the same subject, but widely separated in the Code. A great deal of time and thought has been expended upon this work. It is needless to state that its value depends inversely upon its size. The aim has been, not to make a substitute for the Code, but to make a reference book to go with the Code which will show at a glance all of the provisions relating to any subject.
