Available in PDF, EPUB and Kindle. Book excerpt: About the book Law relating to Wills has evoked curiosity amongst Judges, lawyers and law students alike. This book offers exhaustive commentary on principles governing this law and illustrates them with contemporary case laws. The book does not contain many judicial authorities of colonial period which have lost relevance in current times, but it does examine the relevant pronouncements. The book discusses concepts which are fundamental to exercise of testamentary jurisdiction, in detail which often engages courts. Four chapters elaborate on law relating to execution and proof of Will. Three chapters are devoted to discussing law relating to grant of probate and letters of administration. Concept of revocation of Will and revocation of probate and letters of administration has been discussed in one chapter each. Other aspects of law, which do not much invite much attention of courts like construction of Will, jurisdiction of court, powers and duties of executors and administrators, void bequest, vesting of legacy, contingent bequest, conditional bequest etc. have also received their due share in the book. Authors have discussed novel concepts like 'Living Will' in this book.

Book The Common Law Treatment of Lost Wills

Download or read book The Common Law Treatment of Lost Wills written by Peter S. Spiro and published by . This book was released on 2017 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: The legal principles affecting lost wills are quite simple, but in practice they often raise difficult evidentiary issues. Judges need to infer something as elusive as the intentions of the deceased when a will disappears. The type of weighing of evidence that is involved is quite subjective, and different judges will read it differently. Some of the decisions appear quite surprising, if not perverse. Clients in lost will disputes may be well advised to seek mediation rather than go to trial. Governments should help mitigate the problem by encouraging people to participate in centralized wills registries.

Excerpt: ...the will, either expressly or necessarily implied.55 Where this principle is not expressed in such sweeping language, it is always held by the courts where the will is equally susceptible of two constructions, one in favor of the heirs and the other in favor of some more distant relative, that the one in favor of the heir will be preferred.56 So in construing a will, the courts, in case of doubt, lean toward a construction which conforms as nearly as possible to the Statutes of Descent and Distribution.57 Thus, in a devise to testator's children in existence at the time of his death, it will be presumed that testator intended an equality of distribution among them.58 In the case of the death of some of testator's children, the law will, unless the contrary appear on the face of the will, assume that a distribution per stirpes in accordance with the principle of lineal representation is intended,58 if lapse is prevented in any way.
