Book excerpt: Almost fifty years have passed since the adoption of the Convention Concerning the Protection of the World Cultural and Natural Heritage (the UNESCO World Heritage Convention). With its 194 States Parties, it is the most widely ratified convention within the family of UNESCO treaties on the protection of cultural heritage. The success of this Convention and its almost universal acceptance by the international community of states is due to the great appeal that recognising certain properties as "world heritage" has for national governments. Since the publication of the first Commentary, new problems have arisen in the management of world heritage sites. It has become increasingly difficult to properly monitor the conservation of the ever-growing mass of sites inscribed in the World Heritage List, and to resolve disputes over the formal designation of contested world heritage properties - a problem that has led to the withdrawal of the United States and Israel from UNESCO. New frontiers are now being explored for the expansion of the world heritage idea over marine areas beyond national jurisdiction, and the monopoly of the State in the identification, delineation, and presentation of world heritage properties is being increasingly challenged in the name of indigenous peoples' rights and by local communities claiming ownership over contested cultural sites. At the same time, the regime of world heritage protection has infiltrated other areas of international law, especially international economic law, investment arbitration, and the area of international criminal law. This second edition critically examines the World Heritage Convention against this dynamic evolution of international heritage law to help academics, lawyers, diplomats, and officials interpret and apply the norms of the Convention after half a century of uninterrupted implementing practice by State Parties and Treaty Bodies.

In doing so, they turned their hands into miniature flags that flew with even a casual wave. Red Mitten Nationalism investigates this shift in Canadians’ displays of patriotism by exploring how common understandings of Canadian history and identity are shaped at the intersection of sport, commercialism, and nationalism. Book excerpt: Despite the impressive performance of the Foreign and Commonwealth Office in representing the UK's interests across the globe with what is, in Governmental terms, a particularly small budget, the Foreign Affairs Committee believes that the FCO is under-funded. This situation has been exacerbated by the Spending Review 2010 and the lack of detail provided by the FCO and the BBC World Service as to exactly how the spending reductions target will be met is disappointing. There are concerns about the steps taken by the FCO to adjust to its reduced budget: reductions in the deployment of UK-based staff overseas and the optimistic planned programme of property sales will have a detrimental impact on the ability of the UK to protect its interests overseas. The establishment of the European External Action Service (EEAS) will place a further strain on the FCO's resources. The Committee welcomes the appointment of Lord Williams of Baglan to the post of "International Trustee" with responsibility for the BBC World Service, but reiterates its belief that a formal concordat governing the World Service's budget and output should be drawn up setting out the World Service's independence from budgetary pressures elsewhere in the BBC. The budget cuts faced by the British Council will lead to the Council becoming a substantially different organisation by the end of the Spending Review period. The greater emphasis that the British Council will place on commercial activity risks a diminution of the UK's influence and soft power.

Book excerpt: This report considers the Fixed-term Parliaments Bill which would remove the Prime Minister's power to call an election at the time of his choosing, and sets a five year fixed term, subject to the possibility of early dissolution following a vote by the House of Commons. It examines the key issues of the Bill's principals as well as the process by which it was brought forward. The Committee takes the view that the origins and content of the Bill owe more to short-term considerations than to a mature assessment of enduring constitutional principles or sustained public demand. In the view of the majority of the Committee, the shift from a five year maximum to five year norm would inconsistent with the Government's stated aim of making the legislature more accountable; with existing constitutional practice; and with the practice of the devolved institutions and the clear majority in international legislatures. However the Committee does accept that an elected government should have a full term in which to develop their policies and take their legislative programme through Parliament. It considers a four year term should be adopted for any fixed-term arrangement at Westminster. Potential date clashes with elections to the devolved institutions should also be avoided. Some form of safety valve which would allow for an early election in circumstances such as the government losing the confidence of the Commons or where a political or economic crisis has affected the country is also necessary. The report also makes several specific recommendations for amendments for the Bill.

Book excerpt: As of the end of 2015, there were 40.8 civilians who had been internally displaced by conflicts and effects of natural disasters in various parts of the world. Internally displaced persons (IDPs) are currently the largest group of persons receiving assistance from some of the main international humanitarian organisations. With the largest concentration of internally displaced persons (IDPs), the African continent has been the worst affected region. While previously IDPs have largely been neglected under international law, the first-ever continental binding treaty on internal displacement, the African Union Convention on the Protection of and Assistance to Internally Displaced Persons (the Kampala Convention), entered into force on 6 December 2012. As of January 2016, 25 states have ratified the instrument while 40 states have become signatories. This book significantly contributes to the study, policy making and practice on managing internal displacement by presenting the first major systematic examination of the evolution, elements and implementation of the Kampala Convention. It explores the responsibility of the state for the protection of IDPs particularly those who are most vulnerable during armed conflicts, internal strife, natural disasters, human rights violations and other circumstances. The status of ratification of the Convention is reviewed as well as the steps currently being undertaken by governments to implement the Convention. It also analyses the contribution by human rights mechanisms, inter-governmental bodies and UN peace-keeping missions in the implementation of the Convention. The book casts the Kampala Convention in broader institutional and normative developments in Africa and beyond. It demonstrates how concepts such as ‘responsibility to protect’ and ‘sovereignty as responsibility’ have begun to make inroads; influencing some of the more progressive instruments adopted by the African Union. It also sheds light on the relationship between the Convention and some regional instruments. In assessing the effectiveness of the Kampala Convention Allehone Abebe argues that the link between the Convention and initiatives on development, human rights and governance in Africa should be fully fostered.
