Book The Admissibility of Human Rights Petitions

Download or read book The Admissibility of Human Rights Petitions written by Tom Zwart and published by Martinus Nijhoff Publishers. This book was released on 2022-06-08 with total page 264 pages. Available in PDF, EPUB and Kindle. Book excerpt: Both global and regional human rights treaties have established international institutions offering recourse if a State party fails to comply with its obligations under the treaty. Many of these institutions have jurisdiction to consider complaints brought by individuals claiming that a State party has violated the rights enumerated in the treaty. However, these same institutions appear no longer merely to confine themselves to considering individual petitions. Due to the growing number of complaints, they have become increasingly preoccupied with managing their workload. The present volume focuses attention on two international institutions, one regional (the European Commission on Human Rights), and one global (the Human Rights Committee). It thoroughly examines the admissibility conditions of both the Commission and the Court by means of their case law and discusses possible changes which might reduce this case load. Chapter 2 discusses the procedural aspects of both systems, in particular, the division of labour and the various stages of the proceedings. Chapters 3-9 explore the case law of both organs concerning admissibility conditions, and such topics as competence ratione personae (including standing, the victim requirement and State responsibility), competence ratione temporis, competence ratione materiae, inadmissibility pendente lite and the exhaustion of local remedies.

Book Yearbook of the International Commission of Jurists

Download or read book Yearbook of the International Commission of Jurists written by Ian Seiderman and published by Intersentia nv. This book was released on 2004-06 with total page 456 pages. Available in PDF, EPUB and Kindle. Book excerpt: During the past year, the ICJ has proceeded to tackle vigorously several of the manifold challenges currently confronting the international human rights movement. To name just a few: the threat to the primacy of fundamental rights posed by counter-terrorism measures, the failure of many States to honour their human rights obligations they have undertaken; the struggle to preserve a rule of law upheld by an independent and impartial judiciary; and the tendencies towards the overall weakening of universal and regional systems of human rights protection. This Yearbook is intended to serve as a conduit for dissemination of information, analysis and guidance to jurists, governments, NGOs and the wider human rights community as they in their own right to strive to meet these challenges. The International Commission of Jurists was founded in 1952 to promote understanding and observance of the rule of law throughout the world. The ICJ is dedicated to the legal promotion and protection of human rights and fundamental freedoms in all parts of the world .In 1978, the ICJ created the Centre for the Independence of Judges and Lawyers (CIJL) with the task to inform lawyers of the plight of their colleagues in other countries who are persecuted for their professional work and to mobilise lawyers organisations to take action in support of them. The ICJ Yearbook 2004 contains reports of fact-finding missions and country monitoring (e.g Swaziland, Nepal, Tunisia, Criminal Justice Reform in India and trial observations in Turkey and Malaysia) it also includes several articles on human rights and judicial independence as well as a number of judicial documents.

Book excerpt: This title was first published in 2003. The series of volumes prepared by UNESCO for teaching human rights at higher education level comes to a conclusion with the publication of this volume. "Human Rights: International Protection, Monitoring, Enforcement" takes an institutional approach to the international protection of human rights, examining first the United Nations system, which may be seen as universal, and then analysing regional systems of protection. A useful source of information on the protection of human rights, the volume can also be employed as a practical guide to the use of existing procedures in the defence of human rights.

Book excerpt: Human Rights between Idealism and Realism presents human rights in action, focusing on their effectiveness as legal tools designed to benefit human beings. By combining conceptual analysis with an emphasis on procedures and mechanisms of implementation, this volume provides a multidimensional overview of human rights. After examining briefly the history of human rights, the author analyses the intellectual framework that forms the basis of their legitimacy. In particular, he covers the concept of universality and the widely used model that classifies human rights into clusters of different 'generations'. The volume then moves on to analyse of the activities of the political institutions of the United Nations, the expert bodies established by the relevant treaties, and the international tribunals specifically entrusted at the regional level with protecting human rights. The author explains how and why ithe classical array of politically inspired informal devices has been enriched by the addition of international criminal procedures and by endeavours to introduce civil suits against alleged individual violators of human rights. Finally, the volume is rounded off by a consideration of the importance of humanitarian law as an instrument for the protection of human life and dignity and an exploration of the future of human rights.
