Book excerpt: The "typical" DWI case usually begins with a police officer pulling someone over for a traffic violation such as speeding, swerving, or even something as serious as a traffic accident. DWI police officers usually will then "notice" that the driver has an odor of alcohol on their breath, bloodshot and watery eyes, and slurred speech. You are asked to step out of their car to perform field sobriety tests. You are now a suspect in a DWI investigation. Normally, three roadside field sobriety tests are given: 1) The Horizontal Gaze Nystagmus test, 2) the Walk-and-Turn test, and 3) the One Leg Stand test. As the suspect is doing these tests, the police officer is keeping score, but never reveals the criteria used to score the performance. The suspect also does NOT get credit for doing something correctly. The suspect is not given to a practice run. Just when you think you passed the 3 tests with flying colors, the police officer arrests you and takes you downtown where you either give a breath test or a blood test. Now you are being charged with a DWI. Upon being booked, you now have criminal records that are available to the public. How did this happen? And what do I do now? Well, you go get yourself a lawyer. And you need a damn good one because your career, your record, and your reputation are on the line.

Book Grace and Justice on Death Row

Download or read book Grace and Justice on Death Row written by Brian W. Stolarz and published by Skyhorse. This book was released on 2016-10-25 with total page 228 pages. Available in PDF, EPUB and Kindle. Book excerpt: A Washington Post bestseller! A chilling and compassionate look at how close an innocent man was to being put death with a foreword by Sister Helen Prejean, author of Dead Man Walking. What is worse than having a client on Death Row in Texas? Having a client on Death Row in Texas who is innocent and not knowing if you will be able to stop his execution in time. Grace and Justice on Death Row: A Race Against Time to Free an Innocent Man tells the story of Alfred Dewayne Brown, a man who spent over twelve years in prison (ten of them on Texas’ infamous Death Row) for a high-profile crime he did not commit, and his lawyer, Brian Stolarz, who dedicated his career and life to secure his freedom. The book chronicles Brown’s extraordinary journey to freedom against very long odds, overcoming unscrupulous prosecutors, corrupt police, inadequate defense counsel, and a broken criminal justice system. The book examines how a lawyer-client relationship turned into one of brotherhood. Grace And Justice On Death Row also addresses many issues facing the criminal justice system and the death penalty – race, class, adequate defense counsel, and intellectual disability, and proposes reforms. Told from Stolarz’s perspective, this raw, fast-paced look into what it took to save one man’s life will leave you questioning the criminal justice system in this country. It is a story of injustice and redemption that must be told.

Book The Science of Drinking

Download or read book The Science of Drinking written by Amitava Dasgupta and published by Rowman & Littlefield Publishers. This book was released on 2011-04-16 with total page 277 pages. Available in PDF, EPUB and Kindle. Book excerpt: Scientific research has clearly established that drinking in moderation has many health benefits, including maintaining a healthy heart. Yet, many people do not know that drinking red wine protects the heart more than white wine, while beer, margaritas, and hard liquor are less effective in providing such protection. And while alcoholism is a serious problem requiring medical and psychological treatment, for those who are not addicted, drinking alcohol is not necessarily a bad habit. The problem is to distinguish between drinking sensibly and drinking insensibly. Dasgupta clearly outlines what constitutes healthy drinking and its attendant health benefits, offers advice on how to drink responsibly, and provides insight into just how alcohol works on the brain and the body. After reading this book, readers will enjoy their next drink with a fuller and safer understanding of why they're enjoying it.

Book The Machinery of Criminal Justice

Download or read book The Machinery of Criminal Justice written by Stephanos Bibas and published by Oxford University Press. This book was released on 2012-02-28 with total page 320 pages. Available in PDF, EPUB and Kindle. Book excerpt: Two centuries ago, American criminal justice was run primarily by laymen. Jury trials passed moral judgment on crimes, vindicated victims and innocent defendants, and denounced the guilty. But since then, lawyers have gradually taken over the process, silencing victims and defendants and, in many cases, substituting plea bargaining for the voice of the jury. The public sees little of how this assembly-line justice works, and victims and defendants have largely lost their day in court. As a result, victims rarely hear defendants express remorse and apologize, and defendants rarely receive forgiveness. This lawyerized machinery has purchased efficient, speedy processing of many cases at the price of sacrificing softer values, such as reforming defendants and healing wounded victims and relationships. In other words, the U.S. legal system has bought quantity at the price of quality, without recognizing either the trade-off or the great gulf separating lawyers' and laymen's incentives, values, and powers. In The Machinery of Criminal Justice, author Stephanos Bibas surveys the developments over the last two centuries, considers what we have lost in our quest for efficient punishment, and suggests ways to include victims, defendants, and the public once again. Ideas range from requiring convicts to work or serve in the military, to moving power from prosecutors to restorative sentencing juries. Bibas argues that doing so might cost more, but it would better serve criminal procedure's interests in denouncing crime, vindicating victims, reforming wrongdoers, and healing the relationships torn by crime.
