Book excerpt: In November 1999, the United States and China concluded a bilateral trade agreement on issues related to China's joining the World Trade Organization. As a result, the administration has asked Congress to pass legislation that would allow the President to grant China permanent normal trade relations status, which would eliminate a potential conflict between U.S. law and U.S. obligations if China becomes a member of the World Trade Organization. However, China must complete further negotiations in the World Trade Organization before all the terms and conditions for its membership are known and are secure. China's World Trade Organization membership negotiations take place on two tracks-bilateral and multilateral negotiations. The bilateral negotiations, including those between China and the United States, are designed to obtain China's commitment to remove specific market access barriers and open China's domestic market to more foreign goods and services.

Book excerpt: "China's accession to the World Trade Organisation (WTO) in 2001 was hailed as the natural conclusion of a long march that started with the reforms introduced by Deng Xiaoping in the 1970s. However, China's participation in the WTO since joining has been anything but smooth, and its self-proclaimed "socialist market economy" system has alienated many of its global trading partners - as recent tensions with the United States exemplify. Prevailing diplomatic attitudes tend to focus on two diametrically opposing approaches to dealing with the emerging problems: the first is to demand that China completely overhaul its economic regime; the second is to stay idle and accept that the WTO must accommodate different economic regimes, no matter how idiosyncratic and incompatible. In this book, Mavroidis and Sapir propose a third approach. They point out that, while the WTO (as well as its predecessor, the General Agreement on Tariffs and Trade [GATT]) has previously managed the accession of socialist countries or of big trading nations, it has never before dealt with a country as large or as powerful as China. Therefore, in order to simultaneously uphold its core principles and accommodate China's unique geopolitical position, the authors argue that the WTO needs to translate some of its implicit legal understanding into explicit treaty language. Focusing on two core complaints - that Chinese state-owned enterprises (SOEs) benefit from unfair trade advantages, and that domestic companies (both private as well as SOEs) impose forced technology transfer on foreign companies as a condition for accessing the Chinese market - they lay out their specific proposals for successful legislative amendment"--.

Book excerpt: Pursuant to a congressional request, GAO discussed the relationship between China's most-favored nation (MFN) status and World Trade Organization (WTO) membership, focusing on the: (1) WTO accession process; and (2) legal framework affecting China's MFN status, its implications for WTO membership, and the role Congress plays in the process. GAO noted that: (1) China has the largest economy worldwide that is not covered by the WTO; (2) the WTO seeks to promote open and fair international trade through increased transparency, rules, and commitments to reduce barriers on foreign goods and services, and provide a binding system for resolving disputes; (3) China would like to join the WTO and is currently in the negotiation phase, which is the second of the four-stage process for becoming a member; (4) joining the WTO will require China to make substantial changes to its economy; (5) although Congress does not vote on China's WTO membership, the United States Trade Representative is required to consult with Congress before a WTO vote is taken; (6) the Administration plans to ask Congress to enact legislation to resolve a potential conflict between the conditional MFN afforded China under U.S. legislation and the unconditional MFN provided by the WTO agreements; (7) if China becomes a member and Congress has not enacted this legislation, the Administration intends to invoke a WTO provision that would permit the United States not to apply the WTO Agreements to China; (8) an important consequence of taking this exception is that China and the United States would not be obligated to provide each other all the WTO trade commitments that they would give to other WTO member states; and (9) in such a situation, U.S. business may not be able to benefit fully from the commitments China will make to open its markets to other WTO members.
