Book excerpt: Excerpt from Work-Accidents and the Law The Slavs from Austro-Hungary, the Latins from the Mediterranean provinces, the Germans or the British-born, who come to Pittsburgh to do the heavy work of manufacture (and for Pittsburgh read the United States), come from a region of law and order to a region of law-made anarchy so far as the hazards of industry are concerned. For there is scarcely a country of modern Europe but has brought its statutes abreast of industrial progress and wrought out for itself, as we have not, some sensible adjustment between civil rights, human needs, and the ceaseless operations in which groups of men and powerful appliances are joined in producing what the world wants. Laggard as the American states have thus been in what Mr. William Hard has called the "law of the killed and injured," it is ours to profit by the experience of the countries which have from five to fifteen years' headway in this field. An American system should, none the less, be grounded firmly in American conditions. Toward the understanding of these conditions, of the common causes of accidents, and their consequences in the actual household experience of working people, this book is contributed. Miss Eastman presents the findings of the first systematic investigation of all cases occurring during a representative period in a representative American district. No such body of facts has hitherto been available, and the investigation could scarcely have been better timed in relation to constructive efforts towards the establishment of industrial justice. The field work was carried on during 1907-08 as part of the Pittsburgh Survey and the results were published in brief in "Charities and the Commons" in March, 1909. During the past year state commissions have been appointed in Minnesota, Wisconsin and New York for the purpose of recommending legislation on this subject. In the seventeenth century the idea of insuring individuals against accidents seems to have been first contemplated in France. But not until the middle of the nineteenth century was the first English company formed for this purpose. The first American company was not organized until about 1860. In England the policies were framed for the purpose of paying definite indemnities for specific injuries, such as the loss of a limb, blindness, etc., The earliest American policies were based on their English prototypes. They were not adapted to the newer country, with its different customs and habits of life, its varied occupations and risks, and the companies which had embarked in the business met with disaster and failure. Shortly the pioneers in the industry undertook the scientific construction of a system of accident insurance, evolving new tables of rates, new classifications of risks, and new methods of business, based upon conditions in the United States. In a short time it was demonstrated that by a statistical and mathematical calculation a table of risks could be prepared on the same principle employed in the construction of mortality tables by life insurance companies, upon which could be based a reliable and equitable system of accident insurance. In the United States accident insurance was inaugurated with the sale of so-called "accident tickets" to travelers on railroads covering only risks of travel, and in most instances good only for periods of twenty-four hours or the duration of specific trips. These tickets were sold at railroad stations. It soon became manifest that only a small percentage, not above ten per cent., of accidents resulted from traveling. Book excerpt: Excerpt from Employers Liability for Personal Injuries to Their Employees The legislature at its last session directed an investigation of the subject of the liability of employers to workmen for injuries received while in the discharge of their duty, and a consideration of what changes, if any, are needed in the existing laws relative to such liability. A careful investiga tion of the law and facts which bear upon the subject has been made, and it has been fully considered in its various phases, with especial care, for the first time, so far as known in this country. It is a subject which, in all its varied relationships, is by no means easy of comprehension. It is fruitful of embarrassments. And hedged about with difficul ties, but at the same time of no inconsiderable consequence to the welfare of the community. During the nine years ending with 1881 there were, according to the Railroad Gazette, persons killed, and injured, in the United States, on the railroads alone; and of these, were killed and injured on the railroads of this Com mon wealth. A large majority of both the killed and injured were employees. Of those killed in this Commonwealth, 358 were of this class, while of those injured there were (553. During the year 1881 alone, 72 employees were killed and 128 injured in this Commonwealth. \vhen one single branch of employment causes such an annual sacrifice as this, it seems to be time to consider whether something cannot be done to prevent it. Book excerpt: In the five decades after the Civil War, the United States witnessed a profusion of legal institutions designed to cope with the nation’s exceptionally acute industrial accident crisis. Jurists elaborated the common law of torts. Workingmen’s organizations founded a widespread system of cooperative insurance. Leading employers instituted welfare-capitalist accident relief funds. And social reformers advocated compulsory insurance such as workmen’s compensation. John Fabian Witt argues that experiments in accident law at the turn of the twentieth century arose out of competing views of the loose network of ideas and institutions that historians call the ideology of free labor. These experiments a century ago shaped twentieth- and twenty-first-century American accident law; they laid the foundations of the American administrative state; and they occasioned a still hotly contested legal transformation from the principles of free labor to the categories of insurance and risk. In this eclectic moment at the beginnings of the modern state, Witt describes American accident law as a contingent set of institutions that might plausibly have developed along a number of historical paths. In turn, he suggests, the making of American accident law is the story of the equally contingent remaking of our accidental republic.
