Book excerpt: Women migrant domestic workers (WMDWs) constitute 7.7 percent of migrant workers worldwide, of whom more than a quarter live and work in the Arab region. In Lebanon, as in other Arab countries, WMDWs are recruited through the sponsorship system, Kafala. Under this system, a potential migrant worker can only obtain legal residency and a work permit in the country of destination if she is sponsored by a specific employer. Once in the destination country, the worker cannot transfer to a new employer unless granted permission by the original sponsor. The system heightens the social, economic, and legal vulnerability of WMDWs and has been described as unfree or bound labor and a system of racialized servitude. Yet, Kafala is not a written policy but rather a collection of administrative procedures, customary practices, and socially acceptable norms that are maintained by various players throughout the migration process. The question then arises as to whether advocacy efforts that focus on abolishing Kafala as a legal term would mitigate employers’ exploitative practices that violate the workers’ rights and freedoms, particularly in a country like Lebanon. This policy brief is based on a study carried out under the International Labour Organization’s (ILO) Work in Freedom project designed to mitigate the exploitation and forced labor of women migrating from South to West Asia to work in the domestic and garment sectors. This brief explores knowledge, awareness and attitudes to Kafala by employers in Lebanon.

Book excerpt: Worldwide, women migrant domestic workers (WMDWs) occupy a weak position in the global economy due to intersections of gender, race, and global economic inequalities. Lebanon hosts more than 250,000 WMDWs who are recruited and employed through the infamous Kafala system that binds a worker to one employer. With Lebanon’s economic crisis, a large number of WMDWs are currently working as freelancers whereby giving and receiving support from other workers plays a crucial role in their adaptation and economic survival. This study is a component of an international evaluation of the Work in Freedom Project carried out by the International Labour Organization. It focuses on Lebanon and aims to assess the impact of the project on the ability of WMDWs in Lebanon to maintain viable social networks and organize collectively. Its main objective is to investigate the different ways in which WMDWs have maintained social networks and engaged in collective organizing efforts (at the individual, meso- and macro-levels), to improve their lives and to ensure non-exploitative work conditions.

While cases of extreme physical abuse by the Lebanese women who hire housemaids - Madames - are an exception, what has become normalised are more insidious patterns of domination used to control each and every aspect of their employees' lives. For their part, Sri Lankan housemaids are not merely passive victims. Away from direct provocation and first-hand repercussions, they try to deflect what Pierre Bourdieu has called 'symbolic violence'. These attempts at 'everyday forms of resistance', as defined by James Scott, can help loosen their employers' grip. Yet, as this unprecedented study shows, the Madame/housemaid relationship and the rules that govern it remain under the managerial hold of the Madame.

The Syrian crisis and its political, economic and demographic consequences on Lebanon have increased these tensions. This atlas sheds light on these new challenges and adds new data that complete the analyses already published in the Atlas du Liban. Territoires et société (Atlas of Lebanon. Territories and Society) released in 2007 by the same research team. Some of its components are included in this edition. Beyond the international regional crisis and the population movements, it takes into account Lebanon’s socio-economic dimensions, the environmental issues linked to uncontrolled urbanization and to natural risks, as well as conflicts due to local territorial management. This atlas is the result of a collaborative endeavor between French and Lebanese researchers. It uses a geographical approach that puts in the foreground a spatial analysis of social and natural phenomena. Public sources are scarce in Lebanon, especially at the local scale. They are sometimes less reliable and difficult to access. It is particularly the case for the Lebanese census data, conversely data are abundantly available on the refugees population, which is less known than the population of refugees. International data help compare Lebanon to its neighbors. Thematic data produced by some ministries are helpful to provide a detailed view regarding specific domains. Analyses processed on aerial and satellite images have produced essential data on urbanization and environment. Local thematic fieldwork surveys have provided additional data. The book consists of seven chapters. The first one deals with the territorial state-building seen in the light of regional geopolitics, and emphasizes internal violence and the reemergence of militias and armed groups that fight each other and the state army. Lebanon is once again perceived as a territory divided between multiple allegiances. The second chapter is devoted to the analysis of population dynamics, despite the lack of reliable data whose sources are subject to discussion. Based on original research, it looks at the racialisation of paid domestic labour in the North - a phenomenon which challenges feminsim and political theory at a fundamental level. The book opens with an exploration of the public/private divide and an overview of the debates on women and power. The author goes on to provide a map of employment patterns of migrant women in domestic work in the North; she describes the work they perform, their living and working conditions and their employment relations. A chapter on the US explores the connections between slavery and contemporary domestic service while a section on commodification examines the extent to which migrant domestic workers are not selling their labour but their whole personhood. The book also looks at the role of the Other in managing dirt, death and pollution and the effects of the feminisation of the labour market - as middle class white women have greater presence in the public sphere, they are more likely to push responsibility for domestic work onto other women. In its depiction of the treatment of women from the South by women in the North, the book asks some difficult questions about the common bond of womanhood. Packed with information on the numbers of migrant women working as domestics, the racism, immigration or employment legislation that constrains their lives, and testimonies from the workers themselves, this is the most comprehensive study of migrant domestic workers available.

The Philippines and Sri Lanka are two of the leading labour-sending states of women domestic workers in Asia, and their economies have become increasingly dependent on the remittances they send back home. Drawing on extensive original research this book argues that these two sending states are guilty of structural violence by sustaining a network of institutions, policies and practices, which serve to systematically disadvantage and discriminate against women migrant domestic workers. The research covers the entire migration process, from pre-departure, through to overseas employment, followed by return and reintegration. This book’s innovative application of structural violence theory as a way to investigate the role of state institutions in labour-sending countries in the Global South will be of interest to researchers from across the fields of migration studies, gender studies, human rights law, and Asian Studies.
