Book excerpt: Excerpt from Woman and the Law His work is designed to serve the pur poses of a general view of the legal con dition of the women of the United States at the present time, and is more especially for the reading of women. It is a general state ment and not an exhaustive analysis; it is not designed for the practising lawyer, man or woman, for though it deals with legal prin ciples, it does not apply them to concrete cases; and least of all is it an attempt to make every woman her own lawyer. Book Witches Wife Beaters and Whores

Download or read book Witches Wife Beaters and Whores written by Elaine Forman Crane and published by Cornell University Press. This book was released on 2011-10-15 with total page 289 pages. Available in PDF, EPUB and Kindle. Book excerpt: The early American legal system permeated the lives of colonists and reflected their sense of what was right and wrong, honorable and dishonorable, moral and immoral. In a compelling book full of the extraordinary stories of ordinary people, Elaine Forman Crane reveals the ways in which early Americans clashed with or conformed to the social norms established by the law. As trials throughout the country reveal, alleged malefactors such as witches, wife beaters, and whores, as well as debtors, rapists, and fornicators, were as much a part of the social landscape as farmers, merchants, and ministers. Ordinary people "made" law by establishing and enforcing informal rules of conduct. Codified by a handshake or over a mug of ale, such agreements became custom and custom became "law." Furthermore, by submitting to formal laws initiated from above, common folk legitimized a government that depended on popular consent to rule with authority. In this book we meet Marretie Joris, a New Amsterdam entrepreneur who sues Gabriel de Haes for calling her a whore; peer cautiously at Christian Stevenson, a Bermudian witch as bad "as any in the world;" and learn that Hannah Dyre feared to be alone with her husband—and subsequently died after a beating. We travel with Comfort Taylor as she crosses Narragansett Bay with Cuff, an enslaved ferry captain, whom she accuses of attempted rape, and watch as Samuel Banister pulls the trigger of a gun that kills the sheriff's deputy who tried to evict Banister from his home. And finally, we consider the promiscuous Marylanders Thomas Harris and Ann Goldsborough, who parented four illegitimate children, ran afoul of inheritance laws, and resolved matters only with the assistance of a ghost. Through the six trials she skillfully reconstructs here, Crane offers a surprising new look at how early American society defined and punished aberrant behavior, even as it defined itself through its legal system.

Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Woman Before the Law T is not attempted in the following pages to give a complete compendium of the law relating to mar ried women, so as to make it a work of reference it is hoped that the subject will be so presented as to give to intelligent readers outside of the legal pro fession a reliable summary 'of the law free from the usual technicalities. Still, the subject is so far treated in a legal point of view, as to afford, it is hoped, some assistance to the law-student. I have studiously avoided the part of a doctri naz'ra; Ihave only considered the law as it is; and have not introduced questions of a debatable charac ter upon which decisions differ. To carry out the subject properly, I was compelled to treat of the law pertaining to the married relation. I have only to request that you will bear in mind certain established truths, which occasionally escape your memory when you are reading a work of fiction. Be pleased, then, to remember (first): That the actions of human beings are not invariably governed by the laws of pure reason. (secondly): That we are by no means always in the habit of bestowing our love on the objects which are the most deserving of it, in the opinions of our friends. (thirdly and Lastly): That Characters which may not have appeared, and Events which may not have taken place, within the limits of our own individual experience, may nevertheless be perfectly nat ural Characters and perfectly probable Events, for all that. Having said these few words, I have said all that seems to be necessary at the present time, in presenting my new Story to your notice. W. O. Book excerpt: Excerpt from Woman's Rights Under the Law: In Three Lectures, Delivered in Boston, January, 1861 There seems, at first sight, a certain presumption in offering to an American public, at this moment, any book which does not treat of the great interests which convulse and perplex the United States. But experience has shown, that neither the individual nor the national mind can remain continually upon the rack; and both author and publisher have thought that a book upon a serious subject, popa lar in form and low in price, would find, perhaps, a more hearty welcome, under present circum stances, than in those prosperous days, when ro manees and poems, travels and biographies, are scattered over every table by the score. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Woman and the Law: A Comparison of the Rights of Men and the Rights of Women Before the Law No one, except reviewers for newspapers, whose whole idea of a volume is drawn from this uncer tain source, ever reads a preface. It furnishes a cozy little nook into which the snugly ensconced author may hide and say just what he pleases, without danger of discovery. Anice little retreat it is, surely and the writer has slyly crept into this hiding-place just to talk it all over to him self. Shall the old and worn manuscript be ex changed for type? Will the volume bear the searching criticism of dear friends and respected acquaintances? Will the cause of human equal ity and the happiness of the race be advanced thereby? Will the distinguished leaders in the Woman's Suffrage Party shout in derision, or will they discover a co-working spirit? What will Mrs. Livermore, or Miss Dickinson, or Mrs. Stowe say about it, if a stray Copy should be placed in their laps by the newsboy, when there is nothing else to command their attention? What would those bright angels over there say. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. The most fortunate of them have been cruelly obstructed by the large remainder of barbarism which exists in every community, and they have done their work in the teeth of every conceivable disadvantage. They have had to snatch it from a cross-fire of hostile circumstances. That they should have been able to exercise their rare talents at all, and so triumphantly, is a kind of miracle, at which we can but stand amazed. To avoid the risk of any possible misconstrue tion I shall offer here a short explanation of my locus standi as regards the whole subject in ques tion.
