For most people, punishment in the criminal justice system is synonymous with imprisonment. Yet, both in Europe and in the USA, the numbers of people under some form of penal supervision in the community far exceeds the numbers in prison, and many prisoners are released under supervision. Written and edited by leading scholars in the field, this collection advances the sociology of punishment by illuminating the neglected but crucial phenomenon of ‘mass supervision’. As well as putting criminological and penological theories to the test in an examination of their ability to explain the evolution of punishment beyond the prison, and across diverse states, the contributors to this volume also assess the appropriateness of the term ‘community punishment’ in different parts of Europe. The last section is about efforts to reform prisons and prison masculinities, including support groups for men. Book excerpt: In Spain, the five-year period following the proclamation of the Republic in April 1931 was marked by physical assaults upon the property and public ritual of the Spanish Catholic Church. These attacks were generally carried out by rural and urban anticlerical workers who were frustrated by the Republic's practical inability to tackle the Church's vast power. On July 17/18, 1936, a right-wing military rebellion divided Spain geographically, provoking the radical fragmentation of power in the territory which remained under Republican authority. The coup marked the beginning of a conflict which developed into a full-scale civil war. Anticlerical protagonists, with the reconfigured structure of political opportunities working in their favor, participated in an unprecedented wave of iconoclasm and violence against the clergy. During the first six months of the conflict, innumerable religious buildings were destroyed and almost 7,000 religious personnel were killed. To date, scholarly interpretations of these violent acts were linked to irrationality, criminality, and primitiveness. However, the reasons for these outbursts are more complex and deep-rooted: Spanish popular anticlericalism was undergoing a radical process of reconfiguration during the first three decades of the 20th century. During a period of rapid social, cultural, and political change, anticlerical acts took on new - explicitly political - meanings, becoming both a catalyst and a symptom of social change. After July 17/18, 1936, anticlerical violence became a constructive force for many of its protagonists: an instrument with which to build a new society. This book explores the motives, mentalities, and collective identities of the groups involved in anticlericalism, during the pre-war Spanish Second Republic and the Spanish Civil War. It will be is essential reading for all those interested in 20th-century Spanish history.

Drawing on fieldwork conducted in three penal establishments in England, it analyses how women manage the restrictions of imprisonment and the manner in which they attempt to resist institutional control. It is proposed that power is negotiated on a private, individual level, as women often resist the institution simply by trying to maintain an image of control over their own lives. However, their image of themselves as active, reasoning agents is undermined by institutional regimes which encourage traditional, passive, feminine behaviour at the same time as they deny the women their identities and responsibilities as mothers, wives, girlfriends and sisters. Femininity is, therefore, both the form and the goal of women’s imprisonment. Yet paradoxically, femininity also offers the possibility of resistance, because women manage to rebel by appropriating and changing aspects of it.

However, the emergence of mass supervision in the community has largely escaped the attention of legal scholars and social scientists more concerned with the mass incarceration reflected in prison growth. As well as representing an important analytical lacuna for penology in general and comparative criminal justice in particular, the neglect of supervision means that research has not delivered the knowledge that is urgently required to engage with political, policy and practice communities grappling with delivering justice efficiently and effectively in fiscally straitened times, and with the challenges of communicating the meaning, legitimacy and utility of supervision to an insecure public. This book reports the findings from a survey of European research on this topic, undertaken during the first year of a European research network that spans twenty countries. As such, it provides the first comprehensive review of research on offender supervision in Europe, opening up an important new field of enquiry for comparative social science, and offering the prospects of better informed democratic deliberation about key challenges facing contemporary justice systems, policymakers and practitioners, and the societies they seek to serve.
