Book excerpt: S2Vermonts Use Value Appraisal (UVA) property tax program was designed to slow the rate of development of rural land, encourage prediction from agricultural and forest lands, and conserve and preserve a working rural landscape by making taxation of underdeveloped land more equitable. In 1987, more than 669,000 acres were enrolled in the UVA Forest Land Program, 18 percent of the potentially eligible forest land. Forest inventory statistics were produced for these lands using data collected in the fourth forest survey of Vermont. UVA forest land comprises slightly more than a billion cubic feet of growing stock, including 2.2 million board feet of sawtimber. Forest inventory data indicate that timberland in the UVA program mirrors Vermont timberland in general. It does not appear that a disproportionate amount of poor sites or good sites are enrolled. Nor does the quantity or quality of the timber appear to be disproportionately representative. The projected net growth on UVA timberland could supply almost half the annual removals in the State. One of the most significant and least understood is preferential assessment of rural land under the real property tax, often called use-value assessment (UVA) or current-use assessment. This book explains and analyzes the critical questions raised by this fiscal tool for farmland preservation. Under UVA, the assessments of various parcels of land within a given state may vary tremendously from property to property. A tract that is zoned residential with access to a turnpike might be assessed at $7,865 per acre. In the very same neighborhood, though, an even larger tract of vacant land might be assessed at a mere $127 per acre, which is far below the market value. How can there be such dramatic differences in the assessment of land values within the same community or neighborhood? Has the town assessor failed to treat property owners fairly and equally, as required by state law? Not at all. Nearly all states across the country permit, and even require, local assessors to value some parcels of undeveloped land far below their fair market values for the purpose of levying local property taxes. Despite their stated purpose of preserving rural lands from urban development, UVA programs can have unintended negative consequences. One is erosion of the legal and constitutional principle of uniformity of taxation; another is shifting of the local tax burden to other property owners, perhaps in a regressive manner. Occasionally UVA programs generate political controversy and even legislative action concerning "fake farmers" who enjoy low property tax bills, but whose land might only be used to sell firewood or Christmas trees to a few friends and neighbors. This volume explains the origins, key features, impacts, and flaws of use-value assessment programs across the United States. It describes in detail the process and characteristics of UVA programs in 44 states and recommends reforms. This book serves as a road map for public officials, scholars, and journalists concerned with agricultural taxation and land use issues.

Beside the specific country's laws and regulations, investors have to follow various benchmarks applied by funding institutions as international standards. Together, these standards are designed to assure that adverse impacts on people, their rights, livelihoods, culture and environment are avoided or at least minimized, mitigated, offset and/or compensated. For these purposes, these projects are planned in remote rural areas, were there is a lack of land market because of limited transactions. A critical issue in this this process is a fair economic valuation of agriculture, pasture or forest land using non-marked based valuation methods for compensation purposes.This scientific monograph proposes some simple yet solid methods to value agriculture, pasture or forest land which could be applicable by the local or central administration without necessarily requiring on complex methodologies requiring data which are generally not available. More importantly, such methodologies are also difficult to understand by the landowners making the public consultation process non-transparent. The methods applied have been tested with success in several large-scale projects involving acquisition, easement or rental of land parcels in different soil and climatic conditions belonging to thousands of owners. A series of template will help the valuators to integrate all the variables and standardize data presentation. It can serve as a reference to comply with land easement and acquisition strategies and aforementioned international standards, for example, the Performance Requirements of the European Bank for Reconstruction and Development (EBRD), Performance Standards of the International Finance Corporation (IFC).
