Large troves of data generated by new information technologies-often termed "big data"-are growing ever more important to a range of military functions. Military forces and other actors will increasingly need to acquire, evaluate, and utilize such data in many combat contexts. At the same time, those forces can gain advantages by targeting adversaries' data and data systems. And a multitude of actors within armed conflict, including humanitarian and human rights organizations, can also use big data to deliver aid or identify atrocities. Such myriad uses of big data raise challenging interpretive questions under international humanitarian law (IHL), the jus ad bellum, and international human rights law. This book is the first of its kind to examine how these bodies of international law might apply to the uses of big data specifically. This book offers the first comprehensive and systemic analysis of the law mandating such assessments – Article 36 of the 1977 Additional Protocol I to the Geneva Conventions. Underpinned by empirical research, the book explores the challenges the weapons review authorities are facing when examining emerging military technology, such as autonomous weapons systems and (autonomous) cyber capabilities. It argues that Article 36 is sufficiently broad to cover a wide range of military systems and offers States the necessary flexibility to adopt a process that best suits their organisational demands. While sending a clear signal that law should not simply follow technological developments, but rather steer them, the provision has its limits, however, which are shaped and defined by the interpretative decisions made by States.

There is an ongoing debate over the extent to which online black markets on the so-called "dark web," the part of the Internet not searchable by traditional search engines and hidden behind anonymity software, facilitate arms trafficking. Details have emerged in the media following the Munich shooting in 2016 linking the weapons used by the attacker to vendors on dark web marketplaces (also known as cryptomarkets). Some media reports have also linked the Paris terrorist attacks in November 2015 to these platforms. While these reports appear to have raised concerns about the role of such dark web markets in arms trade, evidence on the subject is largely anecdotal, based on secondary data as reported after events such as terrorist attacks or successful law enforcement operations.
