Book excerpt: Le droit à la sûreté, en tant que composante fondamentale de la liberté individuelle, est un principe de valeur constitutionnelle et internationale. Ce droit protège l'individu contre toute arrestation et détention arbitraire ou illégale. Ainsi, les privations de liberté opérées dans les enquêtes policières se justifient par les nécessités liées au bon déroulement des investigations judiciaires et par la continuité du procès pénal. Par ailleurs, le maintien de l'ordre public autorise l'autorité administrative à prendre des mesures attentatoires à la liberté individuelle. Dans ce contexte, le droit à la sûreté assure la conformité de la détention avec les conditions légales. L'irrespect de ces dispositions constitue un détournement de pouvoir ou de procédure. L'autorité judiciaire gardienne de la liberté individuelle, devrait sauvegarder le droit à la sûreté à travers un contrôle réel et effectif des pouvoirs coercitifs confiés à la police. Le législateur prévoit des mesures punitives, disciplinaires et réparatrices contre les agents dotés de fonctions judiciaires éventuellement auteurs des arrestations et des détentions arbitraires. La responsabilité pénale pose le dilemme entre d'une part, la protection de leur statut et de leur fonction et d'autre part, la volonté de garantir une justice égalitaire et exemplaire. Parallèlement, le droit disciplinaire garantit le respect des règles déontologiques et professionnelles de chaque profession par l'intermédiaire de sanctions dont l'efficacité repose sur la transparence et l'accroissement du rôle des victimes dans la procédure. Enfin, l'État garant du fonctionnement des services judiciaires prend en charge toutes les fautes de services et les fautes personnelles commises par ces agents sans être en mesure d'exercer une action civile directe à leur encontre. En outre, le refus par l'État d'exercer l'action récursoire contre ses agents fautifs apparaît comme une protection démesurée accordée à ces derniers.

Censorship was abolished, and France appeared to be on a path towards tolerance, pluralism, and civil liberties. A mere four years later, the country descended into a period of political terror, as thousands were arrested, tried, and executed for crimes of expression and opinion. In Policing Public Opinion in the French Revolution, Charles Walton traces the origins of this reversal back to the Old Regime. He shows that while early advocates of press freedom sought to abolish pre-publication censorship, the majority still firmly believed injurious speech--or calumny--constituted a crime, even treason if it undermined the honor of sovereign authority or sacred collective values, such as religion and civic spirit. With the collapse of institutions responsible for regulating honor and morality in 1789, calumny proliferated, as did obsessions with it. Drawing on wide-ranging sources, from National Assembly debates to local police archives, Walton shows how struggles to set legal and moral limits on free speech led to the radicalization of politics, and eventually to the brutal liquidation of "calumniators" and fanatical efforts to rebuild society's moral foundation during the Terror of 1793-1794. With its emphasis on how revolutionaries drew upon cultural and political legacies of the Old Regime, this study sheds new light on the origins of the Terror and the French Revolution, as well as the history of free expression.

Members of the Wahhabi sect have perfected a rhetoric that appeals to the wounded pride of these young Arab men, Moussaoui writes—for example, offering funds to help them complete their education. Moussaoui deplores the route taken by his brother. He is not in any way an apologist for terrorism. Even so, he shows convincingly that normal young men can end up terrorists, and suggests how and why this happens. Moussaoui shows with gripping clarity how Wahhabism distorts true Islamic faith and the threat it poses to Islam. And his book strongly suggests that the best defense against terrorist groups like the Wahhabi sect in the future is anything people can do to end racism.
