Book Union Discipline and Its Implications for the Individual and for Management

Download or read book Union Discipline and Its Implications for the Individual and for Management written by Jeffrey Lynch Harrison and published by . This book was released on 1970 with total page 400 pages. Available in PDF, EPUB and Kindle. Book excerpt: Unions are, or at least are presumiod to be, democratic institutions. The concept of democracy implies the existence of certain individual "rights." Hov/ever, it is critical for a union to present a united front; hence, the need for discipline. This study is concerned with the freedom of unions to exercise disciplinary power and the implications of this discipline for tlie union member and for management. As bases for discussion three hypotheses were formulated. First, it was hypothesized that the freedom of unions to exercise discipline has increased since 1935. The second hypothesis stated that union discipline has had the effect of decreasing individual liberty. In addition, it was hypothesized that union discipline has contributed to a decline in management's exercise of what in the past it assumed were its prerogatives. The methodology involved an examination of four separate but related areas v/hich affect the freedom of unions to discipline tlieir members. First, the relevant legislation was examined. Secondly, the contents of union constitutions were reviev7od. The third area of investigation involved an analysis of NLRB and court decisions. Finally, the impact of arbitration and decisions by review boards were considered. In the area of legislation, it was found that there has been increased regulation of union discipline. Union discipline is specifically regulated by Section 101(a)(5) of the Landrum-Griff in Act. Sections 7 and 8(b)(1)(a) of the Taft-Hartley Act also seemed to have the possible effect of curbing union discipline. The contents of union constitutions were foupd to be generally vague. In addition, the constitutions tended to place a great deal of disciplinary power in the hands of the unions. The constitutions usually did not provide for many of the procedural safeguards which are required in federal courts. The attitude of the NLRB and the courts has generally been to avoid involvement in union disciplinary matters unless a job loss is involved or the disciplinary action is flagrantly arbitrary. This is a result of two factors. First, the courts view the union constitution as a contract between the union and the union members. Secondly, the NLRB has interpreted Section 8 (b)(1) (a) of the Taft- Hartley Act in such a way that an individual seems to lose his rights as guaranteed by Section 7 when he joins a union, Arbitration was found to have a limited impact on union discipline because it concerns primarily the union management relationship rather than the union-member relationship. The decisions of review boards were also found to have limited relevance because the boards usually play the role of an appellate body within the union. It was concluded that the freedom of unions to exercise discipline has not increased. At the same time, though, it was concluded that the effect of union discipline has been to greatly reduce individual freedom. The individual not only loses his status as an individual bargaining unit, but he must face disciplinary action without the protection of many procedural safeguards. Finally, it was concluded that union discipline has contributed both directly and indirectly to the decline in management's exercise of what in the past it assumed were its prerogatives. Nevertheless, it was recognized that in certain situations management might favor greater union disciplinary power.

Book Deregulating Union Democracy

Download or read book Deregulating Union Democracy written by Samuel Estreicher and published by . This book was released on 2012 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: I argue that union democracy regulation is misguided for a number of reasons. First, the regulations do not do a good of reducing agency costs of union leadership because internal union elections are not salient to most union members who rationally do not make the investments in time and information to participate. Second, they are misguided because the franchise is limited to full-fledged union members. Employees, therefore, must expose themselves to the risk of union discipline in order to have any say in critical economic decisions concerning the terms of their collective representation. Finally, the rules artificially limit the supply of representation service providers to non-profit membership organizations whose structure conforms to federal requirements. I propose in place of existing regulations a legal regime that is indifferent to the form that bargaining agencies take. They can be for profit or nonprofit, oligarchies or democracies. The Landrum-Griffin Act model is only one option. What federal law should require is that employees in a bargaining unit have statutory rights, irrespective of membership, to cast secret ballots on whether (i) they want collective representation, (ii) who the collective representative shall be, (iii) dues structure, i.e., costs of representation, (iv) employer's last offer in bargaining, (v) strike authorization, (vi) contract ratification, and (vii) reauthorization or deauthorization of the bargaining agency. These "critical voting opportunities" should be made available irrespective of whether the employee is a union member and should be available without any prior showing of interest by represented employees. What the bargaining agent does with union dues and other income is its business, subject to the usual rules for enforcement of contracts and prohibition of fraud. Because the proposal envisions an "easy out" approach to deauthorization, consideration might also be given to an "easy in" approach to authorization of the bargaining agency without elections and on the basis of card signatures, although this is not necessary to the proposal. The government's job is to facilitate these elections by regularizing the format for ballots and perhaps using the Internet to give potential competitors information about upcoming election dates, etc. The proposal should promote a better functioning marketplace for representational services, and give employees a greater set of options in deciding whether to pursue (or retain) collective representation.

Book Disintegrating Democracy at Work

Download or read book Disintegrating Democracy at Work written by Virginia Doellgast and published by Cornell University Press. This book was released on 2012-02-17 with total page 272 pages. Available in PDF, EPUB and Kindle. Book excerpt: The shift from manufacturing- to service-based economies has often been accompanied by the expansion of low-wage and insecure employment. Many consider the effects of this shift inevitable. In Disintegrating Democracy at Work, Virginia Doellgast contends that high pay and good working conditions are possible even for marginal service jobs. This outcome, however, depends on strong unions and encompassing collective bargaining institutions, which are necessary to give workers a voice in the decisions that affect the design of their jobs and the distribution of productivity gains. Doellgast's conclusions are based on a comparative study of the changes that occurred in the organization of call center jobs in the United States and Germany following the liberalization of telecommunications markets. Based on survey data and interviews with workers, managers, and union representatives, she found that German managers more often took the "high road" than those in the United States, investing in skills and giving employees more control over their work. Doellgast traces the difference to stronger institutional supports for workplace democracy in Germany. However, these democratic structures were increasingly precarious, as managers in both countries used outsourcing strategies to move jobs to workplaces with lower pay and weaker or no union representation. Doellgast's comparative findings show the importance of policy choices in closing off these escape routes, promoting broad access to good jobs in expanding service industries.

Book Comparative Union Democracy

Download or read book Comparative Union Democracy written by J. David Edelstein and published by Transaction Publishers. This book was released on with total page 404 pages. Available in PDF, EPUB and Kindle. Book excerpt: A major empirical study of thirty-one British and fifty-one American national trade unions provides the background to this presentation of a new, organizationally oriented theory of union democracy. Supported by in-depth studies of the political process in the British Mineworkers' Union and the Engineers' Union, the book develops and illustrates a general theory of how, in a country with democratic norms, formal organization itself can constrain a tendency toward oligarchy by stimulating union competition among full-time officers attempting to rise in the union hierarchy. The broad theoretical framework also has implications for democracy in other types of large organizations and should be indispensable for students seeking to understand the political life of such organizations and their potential for democracy. "Comparative Union Democracy is a stimulating work of original scholarship which all involved or interested in union affairs, all those in any way concerned about the prospects for industrial democracy, should read." -Walter Kendall, Institute of Manpower Studies, University of Sussex. "Comparative Union Democracy is easily the best work on the subject that has appeared in years. It should be required reading for all those interested in organizational government, participatory democracy, generally, as well as in the labor movement." -Seymour Martin Lipset "For anyone seeking a better understanding of the workings of trade unions, it is both seminal and revelatory, and hence is required reading." -Nigel Nicholson "Overall, the book is theoretically insightful, methodologically sound, and exceptionally well-written." -J. David Lewis, University of Notre Dame
