With a few notable exceptions, analysts have paid little attention to negotiations ending in failure. The essays in Unfinished Business show that as much, if not more, can be learned from failed negotiations as from successful negotiations with mediocre outcomes. Failure in this study pertains to a set of negotiating sessions that were convened for the purpose of achieving an agreement but instead broke up in continued disagreement. Seven case studies compose the first part of this volume: the United Nations negotiations on Iraq, the Middle East Peace Summit at Camp David in 2000, Iran-European Union negotiations, the Cyprus conflict, the Biological Weapons Convention, the London Conference of 1830–33 on the status of Belgium, and two hostage negotiations (Waco and the Munich Olympics). These case studies provide examples of different types of failed negotiations: bilateral, multilateral, and mediated (or trilateral). The second part of the book analyzes empirical findings from the case studies as causes of failure falling in four categories: actors, structure, strategy, and process. This is an analytical framework recommended by the Processes of International Negotiation, arguably the leading society dedicated to research in this area. The last section of Unfinished Business contains two summarizing chapters that provide broader conclusions—lessons for theory and lessons for practice.

Book excerpt: The 1990s heralded waves of spectacular forms of local resistance and globalized protest against oil exploitation and environmental pollution in oil-producing regions of the developing world. One of the most spectacular local uprisings against global oil multinationals was led by the Ogoni people who were protesting against the exploitation and marginalization of oil-producing ethnic minority communities in the Niger Delta region of Nigeria. However, the hanging on November 10, 1995 of nine Ogoni ethnic minority and environmental justice activists, including Ken Saro-Wiwa, only served to exacerbate protests in later years. Within a decade, dozens of locally rooted insurgent groups emerged in the Niger Delta and construed themselves as part of the social movement for ethnic minority rights and environmental justice which dates back to colonial times. However, the trajectory of the revolutionary momentum has changed over time, reflecting a mix of progressive, opportunistic and retrogressive trends. This book provides a critical study of the trajectory of struggles in the Niger Delta since 1995, paying attention to continuities and changes, including recent developments linked to the shift from local resistance, to the rupturing of the Presidential Amnesty peace deal (largely to the Movement for the Emancipation of the Niger Delta) and the resurgence low-intensity sporadic armed militancy--led by the Niger Delta Avengers militia among others. The contributors critically interrogate the nature of the region's political economy, socio-economic trends and trajectories over the past two decades. This collection also accentuates the lessons learnt, prospects for self-determination, socio-economic and environmental justice and peace in the aftermath of the hanging.

Tsars and Communist Party chiefs were in charge for so long some analysts claimed Russians had a cultural predisposition for authoritarian leaders. Yet, as a result of reforms initiated by Mikhail Gorbachev, new political institutions have emerged that now require election of political leaders and rule by constitutional procedures. Michael McFaul—described by the New York Times as "one of the leading Russia experts in the United States"—traces Russia's tumultuous political history from Gorbachev's rise to power in 1985 through the 1999 resignation of Boris Yeltsin in favor of Vladimir Putin. McFaul divides his account of the post-Soviet country into three periods: the Gorbachev era (1985-1991), the First Russian Republic (1991–1993), and the Second Russian Republic (1993–present). The first two were, he believes, failures—failed institutional emergence or failed transitions to democracy. By contrast, new democratic institutions did emerge in the third era, though not the institutions of a liberal democracy. McFaul contends that any explanation for Russia's successes in shifting to democracy must also account for its failures. The Russian/Soviet case, he says, reveals the importance of forging social pacts; the efforts of Russian elites to form alliances failed, leading to two violent confrontations and a protracted transition from communism to democracy. McFaul spent a great deal of time in Moscow in the 1990s and witnessed firsthand many of the events he describes. This experience, combined with frequent visits since and unparalleled access to senior Russian policymakers and politicians, has resulted in an astonishingly well-informed account. Russia's Unfinished Revolution is a comprehensive history of Russia during this crucial period.

The UN Charter mandates the global organization to seek four noble aspirations: international peace and security, rule of law among nations, human rights for all people, and social progress through development. On environmental issues, however, the UN has understood its charge much more narrowly: it works for "better law between nations" and "better development within them." This approach treats peace and human rights as unrelated to the world's environmental problems, despite a large body of evidence to the contrary. In this path-breaking book, a leading scholar of global environmental governance critiques the UN's failure to use its mandates on human rights and peace as tools in its environmental work. The book traces the institutionalization and performance of the UN's "law and development" framework and the parallel silence on rights and peace. Despite some important gains, the traditional approach is failing for some of world's most pressing and contentious environmental challenges, and has lost most of the political momentum it once enjoyed. The disastrous "Rio+20" Summit laid this fact bare, as assembled governments failed to find meaningful agreement on any of the most pressing issues. By not treating the environment as a human rights issue, the UN fails to mobilize powerful tools for accountability in the face of pollution and resource degradation. And by ignoring the conflict potential around natural resources and environmental protection efforts, the UN misses opportunities to transform the destructive cycle of violence and vulnerability around resource extraction. The book traces the history of the UN's traditional approach, maps its increasingly apparent limits, and suggests needed reforms. Detailed case histories for each of the four mandate domains flag several promising initiatives, while identifying barriers to transformation. Its core implication: the UN's environmental efforts require not just a managerial reorganization but a conceptual revolution-one that brings to bear the full force of the organization's mandate. Peacebuilding, conflict sensitivity, rights-based frameworks, and accountability mechanisms can be used to enhance the UN's environmental effectiveness and legitimacy.
