Book excerpt: The Royal Financial Administration and the Prosecution of Crime in France, 1670–1789 explores the French monarchy’s role in financing criminal prosecutions in the royal courts of the realm—the payment of criminal frais de justice in the vocabulary of the ancien régime—between 1670 and 1789 (that is, from the codification of criminal judicial procedure in the early period of Louis XIV’s personal rule to the outbreak of the French Revolution). The subject brings together three areas of scholarly inquiry—criminal justice, royal administration, and the management of the crown’s finances. A central goal of the study is to provide factual information and interpretive insights on each of these topics and to explain the relationship of each to the others over a long time period. The book contributes to existing scholarship in four ways. First, although each of the major dimensions of the inquiry—the operation of the criminal justice system, the conduct of the royal administration, and the management of the monarchy’s finances—has a large and increasingly sophisticated historical literature, this is the first study to combine them in a systematic way. Second, the long time period covered in the book not only enables the historian to distinguish gradual from rapid change, but it also allows the reader to view how the system functioned in different historical contexts. Third, the study is based on archival sources throughout France. This comprehensive approach permits the identification of elements of a common experience without sacrificing attention to important aspects of regional diversity. Finally, with respect to the sources themselves, the range is broad, encompassing regulatory acts and decisions of the king’s councils; administrative correspondence at the central, regional, and in some cases local levels; financial accounts and related papers; and court records from the major appellate courts and from several lower courts as well. An appendix of 33 tables lists figures of annual expenditure and other pertinent financial operations for each of the major financial districts of the kingdom.

In these pages, French medievalist Franck Collard examines the perception of the crime of poisoning in the West from about 500 to 1500. His primary sources of information are chronicles that cover the entire medieval period and legal texts that are limited to the late medieval centuries. In order to portray the culture of murder by poisoning in the West, he takes into account Byzantine and Islamic documents, as well as ancient texts such as the Scriptures and the writings of Roman historians, both of which were widely known in the Middle Ages. The resulting volume is concerned with the criminal actions that involve poison and not poison as such. Poisonous substances as such are described only when necessary for an understanding of a crime. What is important here is an examination of the ways the alleged crime was perceived in contemporary minds. Poisoning avoids the use of violence. It was committed without a drawn weapon or bloodshed in a world in which wounds, swords, knives, and clubs represented aggression and in which the flow of blood determined the gravity of the crime. Necessarily involving preparation and secrecy, it was often perpetrated treacherously during a meal, a particularly heinous act in a universe that was united by the companionship of a meal and the sociability of drinking. The special horror associated with poisoning resulted from the treachery of those close to the victim-and a sudden death that prevented a final confession of sins.

In four months, they executed up to 80 women and men for the crime of witchcraft, causing a wave of suspects to flee into Spain and sparking terror there. Witnesses, many of them children, described lurid tales of cannibalism, vampirism, and demonic sex. One of the judges, Pierre de Lancre, published a sensationalist account of this diabolical netherworld. With other accounts seemingly destroyed, this witch-hunt – France's largest – has always been seen through de Lancre's eyes. The narrative, re-told over the centuries, is that of a witch-hunt caused by a bigoted outsider. Newly discovered evidence paints a very different, still darker picture, revealing a secret history underneath de Lancre's well-known tale. Far from an outside imposition, witchcraft was a home-grown problem. Panic had been building up over a number of years and the region was fractured by factionalism and a struggle over scarce resources. The Basque Witch-Hunt reveals that de Lancre was no outsider; he was a local partisan, married into the Basque nobility. Living at the Franco-Spanish border, the Basques were victims of geography. Geo-politics caused a local conflict which made the witch-hunt inevitable. The same forces eventually sent thousands of religious refugees from Spain to France where they, in turn, became new objects of popular fear and anger. The Basque witch-hunt is justly infamous. This book shows that almost everything historians thought they knew about it is wrong.
