Book excerpt: This short, friendly, technical guide especially for legal professionals examines both the rising professional demand and the tools available which will allow attorneys to become more technically savvy. The acquisition, authentication, management and presentation of technological evidence are given a through overview. Part I dissects the related San Bernardino County California cases involving Katie Tagle and Stephen Garcia. This techno-legal case study reviews ten different types of technological evidence unexamined by three separate Superior Court judges and the resulting tragic consequences. The Plaintiff approached law enforcement, as well as both civil and criminal sectors of the legal system for an order of protection. She was unable to gain protection from through the courts. Judges presumed that the technological evidence presented was manufactured. Yet, a technological examination of the evidence clearly demonstrates the legitimate threat to the Plaintiff and their son. The actions of the court resulted in the murder-suicide by Defendant Stephen Garcia and their nine month old son, Wyatt. The case study thoroughly examines the chain of events, evidence, legal and social implications upon the San Bernardino County community and across the United States. Part II of the book provides an introductory overview of technology in conjunction with the essential considerations pertinent to legal professionals. Potential methods of authentication are reviewed. Twenty different types of technology are presented affording legal professionals the ability to expand their understanding of the evidence litigants present, including: Table of Contents: Acknowledgments Special Acknowledgments The Need for Legal Professionals to Understand Technology: What's the difference between "technological evidence" and "electronic evidence"? This book was released on 2014-11-30 with total page 384 pages. Available in PDF, EPUB and Kindle. Book excerpt: "We cannot solve our problems with the same thinking we used when we created them" (Albert Einstein) The past decade has seen many breakthroughs in communications and computers. Social networks, Wi-Fi, the transformation of the mobile phone into what is essentially a computer have changed society and influenced inter-personal, global communications. Everyday activities are being replaced by online applications, digital documents and virtual servers. Geographic boundaries are blurred and communication methods and technologies are not necessarily located within the user's country. The communications revolution has placed personal information into the public domain and made it vulnerable. Technical faults, a virus or a power failure, could disrupt our daily routine and cause economic damage to the individual, the state and labor economics. Computers are an integral part of everyday life. Herein lies the problem: change is rapid and ignorance exceeds knowledge. Commonly used jargon is perceived as difficult to understand and in many cases attitudes towards the technological world are effected by traditional though processes that aren't adapted to modern needs. Representatives of the legal system - judges, lawyers and jurists are victims of this new reality. The world of justice is conservative and traditional and relies upon laws that often fail to keep pace with technological change. Judgments have created precedents that have influenced and set methodologies that don't necessarily take into account the world we live in. Judges, defendants and plaintiffs aren't computer and technology experts and the new reality puts many complicated, new and unanswered issues before the legal system and those involved in it. This can be seen daily: jurists and judges are required to deal with issues of justice and technology and find themselves helpless. Their task should include representation, giving advice or making a judgment but they often lack the knowledge or tools to do this. Judge Michal Agmon-Gonen stated that "The courts shouldn't have to deal with this..." Another judge admitted that he doesn't know how to deal with technological issues and another asked for a computer expert's opinion saying that the expert's decision will be binding and final. "Between justice and technology - digital evidence in practice" integrates four aspects common to all legal issues: facts, evidence, expert data and forensic analysis. It is based on years of experience and of providing advice in hundreds of complicated cases, both civil and criminal. As well as an in depth legal analysis of earlier cases, the book presents legal research from around the world - mainly research from the United States and England. The book deals with complex issues of man and technology. The aim is to remove barriers between legal and technological spheres, to reduce knowledge gaps and present a clear picture and only to provide justice - but justice based on knowledge and true understanding. I provide detailed but simple explanations to assist the reader in understanding technological processes and a forensic analysis of the facts. I examine issues through legal eyes - including comparative law - and propose alternatives for a suitable legal solution. This book is the result of years of research and experience and is based on a deep awareness of the law and legal systems of the United States, England and Israel. It presents the issues thoroughly and in a friendly, convenient and easy to understand manner even for those for whom technology is a foreign language. "Between justice and technology - digital evidence in practice" deals with many issues including: Digital evidence Evidence credibility and acceptability Computerized output and institutional evidence Email Laptops, tablets and Smartphones Storage medium and telecommunication Communication channels Virtual servers Security cameras and CCTV Computer crime and evidence fabrication Digital

Book Imperatives for Legal Education Research

Download or read book Imperatives for Legal Education Research written by Ben Golder and published by Routledge. This book was released on 2019-08-28 with total page 245 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the last few decades university teaching has been recognised as an activity which can be studied and improved through educational scholarship. In some disciplines this is now well established. It remains emergent in legal education. The field is rich with questions to be answered, issues to be raised. This book provides the first overall review of legal education scholarship. The chapters outline the history of legal education research and provide a detailed analysis of the trends in areas of publication. Beyond this, the book suggests a typology for further conceptualising the field and a series of suggested paths for future research. The book originated from the 2017 UNSW conference "Research in Legal Education: State of the Art?" It features internationally respected authors who bring their perspectives on how legal education – as a field of research – should be conceptualised. The collection is arranged into three themes. First, a historical view is taken of the emergence of legal education scholarship and its roots that predate modern educational theory. Secondly, the book provides overviews of the extant field of publications, highlighting areas of interest and neglect, and delineating the trends in current publication. Thirdly, the book provides a set of suggested typologies for describing legal education research and a series of essays for future directions which both critique current approaches and provide inspiration for future directions. The State of Legal Education Research represents an authoritative introduction to the field, a set of conceptual tools with which to describe it, and inspiration for researchers to expand and grow research into legal education.
