Book Intellectual Property Strategy

Download or read book Intellectual Property Strategy written by John Palfrey and published by MIT Press. This book was released on 2011-10-07 with total page 260 pages. Available in PDF, EPUB and Kindle. Book excerpt: How a flexible and creative approach to intellectual property can help an organization accomplish goals ranging from building market share to expanding an industry. Most managers leave intellectual property issues to the legal department, unaware that an organization's intellectual property can help accomplish a range of management goals, from accessing new markets to improving existing products to generating new revenue streams. In this book, intellectual property expert and Harvard Law School professor John Palfrey offers a short briefing on intellectual property strategy for corporate managers and nonprofit administrators. Palfrey argues for strategies that go beyond the traditional highly restrictive “sword and shield” approach, suggesting that flexibility and creativity are essential to a profitable long-term intellectual property strategy—especially in an era of changing attitudes about media. Intellectual property, writes Palfrey, should be considered a key strategic asset class. Almost every organization has an intellectual property portfolio of some value and therefore the need for an intellectual property strategy. A brand, for example, is an important form of intellectual property, as is any information managed and produced by an organization. Palfrey identifies the essential areas of intellectual property—patent, copyright, trademark, and trade secret—and describes strategic approaches to each in a variety of organizational contexts, based on four basic steps. The most innovative organizations employ multiple intellectual property approaches, depending on the situation, asking hard, context-specific questions. By doing so, they achieve both short- and long-term benefits while positioning themselves for success in the global information economy.

Download or read book From Assets to Profits written by Bruce Berman and published by John Wiley & Sons. This book was released on 2008-10-03 with total page 320 pages. Available in PDF, EPUB and Kindle. Book excerpt: Innovation is a fight for survival. When it comes to cashing in on new ideas, the right business model can make the difference between success and failure. Today's well-equipped managers and investors must learn how and when intellectual property rights like patents and trade secrets become business assets, and which strategies provide the best return on them. Edited by IP communications expert Bruce Berman, and with contributions from the top names in IP management, investment, and consulting, From Assets to Profits: Competing for IP Value & Return provides a real-world look at how intellectual property assets work and the subtle and not-so-subtle ways in which they are used for competitive advantage. Bruce Berman's acclaimed From Ideas to Assets: Investing Wisely in Intellectual Property introduced IP as a business asset; his follow-up book, Making Innovation Pay: People Who Turn IP into Shareholder Value, looked at patent licensing as a strategy for business owners large and small. Now, From Assets to Profits: Competing for IP Value & Return reveals how a deeper awareness of intellectual assets is forcing many businesses to rethink their approach to capturing innovation and generating profit. Visionary and focused, this important book demonstrates how you can identify valuable intellectual assets and discover the most effective business models for them--especially those that are appropriate for particular IP holders. Not all IP rights are assets, but identifying which ones are--and then appropriately monetizing them--is a challenge, whether you are an IP manager, senior executive, investor, entrepreneur or a so-called patent "troll." Authoritative and insightful, From Assets to Profits reveals the most relevant ways to generate return on innovation, with advice and essential guidance from battle-tested IP pros.

Book Intellectual Property

Download or read book Intellectual Property written by Paul Goldstein and published by Penguin. This book was released on 2007-11-08 with total page 256 pages. Available in PDF, EPUB and Kindle. Book excerpt: The definitive guide to intellectual property for business managers How can a product of the mind—an innovation, a song, a logo, a business secret—become the subject of precise property rights? No idea is entirely original; every innovative business borrows, sometimes extensively, from its competitors and others. So how do we draw the line between fair and unfair use? Billions of dollars ride on that question, as do the fates of publishers, software producers, drug companies, advertising firms, and many others. It’s also a key question for individuals—for instance, if you quit your job after mastering the company’s secrets, what can you do with that information? With the growth of the internet and global markets, having a smart IP strategy is more essential than ever. Intellectual Property is the ideal book for non-lawyers who deal with patents, trade secrets, trademarks, and copyrights—all essential business issues that have changed rapidly in the last few years. Goldstein draws on dozens of fascinating case studies, from the Polaroid vs. Kodak battle to Kellogg’s surprising trademark suit against Exxon to whether a generic perfume is allowed to smell exactly like Chanel No. 5. Every business decision that involves IP is also a legal decision, and every legal decision is also a business decision. Lawyers and managers need to work together to navigate these murky waters, and this book shows how.

Book excerpt: In today’s turbulent global economy, companies establish competitive advantage by creating the most exciting ideas and taking them to market. To sustain this competitive advantage and thrive long term, innovative companies must use intellectual property to protect their valuable ideas. iProperty explores the intellectual property strategies and tactics used by successful companies to protect ideas. It answers the question, "If I’m serious about strategically deploying intellectual property in a way that benefits my bottom line, what should I do on Monday morning to make that happen?" Too often, books dealing with strategy remain high-level and vague, while intellectual property books frequently bog the reader down in the intricacies of patent laws and regulations. Avoiding these extremes, iProperty emphasizes the concrete details involved in actual implementation and provides executives, managers and attorneys with practical advice for developing and executing a strategic intellectual property plan that will yield a measurable return on investment.

Download or read book Protect Or Plunder written by Vandana Shiva and published by Zed Books. This book was released on 2001-11 with total page 164 pages. Available in PDF, EPUB and Kindle. Book excerpt: The kinds of ideas, technologies, identification of genes, even manipulations of life forms that can be owned and exploited for profit by giant corporations is a vital issue for our times. The author argues that this Western-inspired, unprecedented widening of intellectual property concepts does not in fact stimulate human creativity and the generation of kowledge. Instead, it is being exploited by transnational corporations to increase their profits at the expense of the health of ordinary people and of the age-old knowledge and independence of the world's farmers. Intellectual protection is being transformed into corporate plunder. Little wonder popular feeling runs so high against the WTO that polices this new intellectual order, and the pharmaceutical, biotech and other corporations that benefit from it.

Book Employees Intellectual Property Rights

Download or read book Employees Intellectual Property Rights written by Sanna Wolk and published by Kluwer Law International B.V.. This book was released on 2016-04-24 with total page 872 pages. Available in PDF, EPUB and Kindle. Book excerpt: In today’s knowledge-based global economy, most inventions are made by employed persons through their employers’ research and development activities. However, methods of establishing rights over an employee’s intellectual property assets are relatively uncertain in the absence of international solutions. Given that increasingly more businesses establish entities in different countries and more employees co-operate across borders, it becomes essential for companies to be able to establish the conditions under which ownership subsists in intellectual property created in employment relationships in various countries. This comparative law publication describes and analyses employers’ acquisition of employees’ intellectual property rights, first in general and then in depth. This second edition of the book considers thirty-four different jurisdictions worldwide. The book was developed within the framework of the International Association for the Protection of Intellectual Property (AIPPI), a non-affiliated, non-profit organization dedicated to improving and promoting the protection of intellectual property at both national and international levels. Among the issues and topics covered by the forty-nine distinguished contributors are the following: • different approaches in different law systems; • choice of law for contracts; • harmonizing international jurisdiction rules; • conditions for recognition and enforcement of foreign judgments; • employees’ rights in copyright, semiconductor chips, inventions, designs, plant varieties and utility models on a country-by-country basis; • employee remuneration right; • parties’ duty to inform; and • instances for disputes. With its wealth of information on an increasingly important subject for practitioners in every jurisdiction, this book is sure to be put to constant use by corporate lawyers and in-house counsel everywhere. It is also exceptionally valuable as a thorough resource for academics and researchers interested in the international harmonization of intellectual property law.
