Book excerpt: " To protect its national security and commercial interests, the United States has implemented an export control system to limit sensitive technologies from falling into the wrong hands. The Department of State regulates U.S. defense exports and the Department of Commerce regulates dual-use exports that have commercial and military applications. Each agency uses a separate control list of items that may require a license to export. Agencies use compliance activities to prevent the diversion or misuse of exported items against U.S. interests or allies. Misuse can occur through illicit transshipment, the diversion of items from their origin through an intermediary country to an unauthorized destination. In 2010, the President announced reforms to the export control system. This review examines (1) agencies' compliance activities to address transshipment risk and (2) the extent to which U.S. agencies assessed the impact of export control reforms on the resource needs for compliance activities. GAO analyzed U.S. licensing data for 13 transshipment countries and visited Hong Kong, Singapore, and the United Arab Emirates. "

In considering the future of the U.S. export control system, Congress may weigh the merits of a unified export control system -- the end result of the President's proposal -- or the continuation of the present bifurcated system by reauthorizing the present Export Administration Act (EAA) or writing new legislation. In doing so, Congress may debate the record of the present dual-use system maintained by emergency authority, the aims and effectiveness of the present non-proliferation control regimes, the maintenance of the defense industrial base, and the delicate balance between the maintenance of economic competitiveness and the preservation of national security.

Book excerpt: The Institute for Science and International Security became interested in the results of President Obama's ECR Initiative in 2015, after hearing differing opinions about the impacts of the reforms. The reforms generated intense controversy among experts, officials, company officials, and practitioners who were involved in the initiative or had seen initial results regarding the control of proliferation-sensitive goods. The Institute decided to investigate the reforms and contact a wide range of officials and experts to better understand and assess the ECR Initiative. In Part I of this report, we explain the main elements of the ECR Initiative, including its goals, justification, intended impacts, and status. We also provide an overview of the U.S. export control system, including its licensing and enforcement functions. We describe how the ECR Initiative has impacted government functions more broadly based on preliminary data. Part II discusses the positive, negative, and neutral views of more than a dozen experts we interviewed about the effects of the reforms. In Part III we offer policy solutions for mitigating the potential threats identified in Parts I and II that may have been opened by the reforms. These solutions are aimed at better securing efforts to prevent the spread of proliferation-sensitive goods under a reformed U.S. export control system. We also suggest ways for the Trump administration and Congress to further implement and strengthen the reforms.

In 2010, the President announced reforms to the U.S. export control system to address weaknesses found by GAO and others. GAO was asked to address how the export control enforcement agencies allocate resources, as well as the challenges they face and the potential impact of export control reform on enforcement activities. GAO reviewed documents and met with enforcement agency officials as well as with U.S. and foreign government and company officials in Hong Kong, Singapore, and the United Arab Emirates, which have a high volume of trade and have been identified as potential hubs for illicit transshipments. Although the International Traffic in Arms Regulations (ITAR) do help prevent potential foreign adversaries from using U.S. arms against the United States and its allies, the Regulations, as enforced, can weaken U.S. national security in other important ways. For example, by excessively impeding defense exports, the ITAR makes it more difficult for U.S. firms to sustain core U.S. defense technological and industrial advantages, decreases U.S. military interoperability with allies that purchase ITAR-free weapons from other sources, and generates other undesirable effects for the U.S. Army and U.S. national security.
