The 12th section of said act says, "It shall be the duty of the Commissioner to make to the Governor, on or before the first day of January of each year, a full and accurate report of the condition and affairs of all the railroad and telegraph companies having lines in this State; also of all accidents resulting in injuries to persons, and the roads upon which they occurred, and the circumstances and cause thereof, and such other information, suggestions and recommendations as he may deem of advantage to the State." In compliance therewith, I have caused, to be prepared copies of reports from the several railroad and telegraph companies doing business in the State June 30th, 1872, with abstracts, compilations and tabulated results, exhibiting in some degree, the condition and magnitude of these important and growing interests. The death of my immediate predecessor, the late Hon. E. D. Harrison, occurred on the 22d day of April last. He was prostrated by disease while laboring with his accustomed energy, to secure such legislation, as in his judgment would inure to the best interests of this department, and in accumulating plans and facts for the more efficient discharge of his official duties; but before these plans were matured, or the facts so arranged as to be of service to his successor, he was called to his final account. Book excerpt: Excerpt from Annual Report of the Commissioner of Railroads and Telegraphs to the Governor of the State of Ohio: For the Year 1867 Sir: - In obedience to the requirements of the law, I have the honor of submitting my first annual report of the condition and affairs of Railroad and Telegraph companies in the State of Ohio. The law creating the office of Commissioner was passed on the 5th of April, 1867, and requires a report to be made on or before the first day of January following. In so short a time it will hardly be expected that the first report of the Commissioner will be as perfect, the statistics as complete, or the matter as fully and clearly presented as the magnitude of the subject demands. I must content myself with giving briefly such information and facts as I have been able to gather in the time allowed. As soon after entering upon the duties of the office as it could be prepared, I issued Circular Number I., of May 1st, 1867, which will be found in the appendix to this report. I attempted in this to give my understanding of the law, and the duties and obligations imposed by it To this circular I received prompt response from most of the railway companies of the State, and, from all who expressed any opinion on the subject, cordial approval of its terms. Upon the general plan laid down therein I have acted, seeking every opportunity to gain information and acquaint myself, as far as possible, with the condition and wants of railway companies, their defects and failures to comply with the laws in force intended for their regulation, and the necessities of the public growing out of their construction and use in the State as a mode of transportation. To this end I have hastily passed over nearly every railroad in Ohio and, as far as possible, conferred with the officers, making such general inquiries and examination of the lines as would enable me to understand their geographical position and general character. This specific duty was not imposed by the law, but I have found it highly beneficial, and I trust not without some advantage to the public. I have been cordially received and courteously treated by all the officers, and the information derived from these visits will, for the most part, be found in the brief history and condition of the roads, given in another part of this report. I have, at the same time, been in correspondence and communication with the people living on the lines of the several roads, and investigated as far as possible, every complaint made to me.
