Book excerpt: O Brasil é um dos países com maior biodiversidade do planeta e, em função da indispensabilidade de um ambiente que proporcione qualidade de vida saudável a todos, diversas classes científicas encampam, aqui e em todo o mundo, com razão, a luta pela diminuição de agravos aos bens ambientais. Por vontade política expressa do legislador constituinte originário de 1988, o meio ambiente foi erigido à categoria de bem jurídico autônomo de extrema relevância, constituindo-se em um direito fundamental de terceira dimensão – o mais importante – a ser protegido nas esferas cível, administrativa e penal, consolidando-se na atual ordem constitucional brasileira a expansão dos mecanismos de sua salvaguarda, revestindo-se, inclusive, da condição de cláusula pétrea, consoante o disposto no inciso IV do § 4o do art. 60 da Constituição, o que impede que seja objeto de deliberação qualquer proposta de emenda tendente a aboli-lo ou mesmo vulnerá-lo em seu núcleo essencial. Nesse contexto, numa postura crítico-reflexiva, aborda-se na presente obra, desde o bem jurídico meio ambiente e sua proteção constitucional – com as nuances em torno do próprio conceito de meio ambiente e sua condição de direito fundamental – até a responsabilização por danos ambientais nas esferas penal, administrativa e cível, a natureza propter rem da obrigação de reparação por danos ambientais, a necessidade e importância da tutela penal ambiental, em confronto com a administrativa e a cível, e a questão pontual da responsabilidade penal da pessoa jurídica por danos ambientais no país como novo paradigma do Direito, bem como o acerto ou desacerto do legislador com sua previsão constitucional e regulamentação legal e sua valia como mecanismo efetivo de proteção ambiental. Ainda, analisa-se a Lei Ambiental em seus aspectos penais, a responsabilidade penal da pessoa jurídica no direito comparado, na jurisprudência do STF e STJ e no projeto do novo Código Penal brasileiro e a culpabilidade da pessoa jurídica no Direito Penal contemporâneo, enfrentando-se a temática da capacidade real dos sistemas jurídicos em tornar responsáveis efetivamente no âmbito penal as pessoas físicas e, sobretudo, as jurídicas pelos atos considerados criminosos relativos ao meio ambiente, que se constitui em um direito difuso, fundamental e indisponível, já que o debate acerca da possibilidade de responsabilização penal da pessoa jurídica ganhou novos ares e contornos a partir da atual Carta Constitucional.
