  • ISBN :
  • Pages : 490 pages

Book excerpt: The second edition builds on the analysis of the 1988 Act, by considering the significant and ongoing impact of the European Union on the question of performers' rights. It contains analysis of the implementation of the Directives developed from the Copyright and the Challenge of Technology Green Paper. Particular attention is paid to the Rental and Lending Rights Directive, which was implemented in the United Kingdom at the end of 1996. Performers' Rights also discusses future European Union initiatives and the WIPO Performances and Phonograms Treaty. It remains the only text exclusively devoted to the subject of performers' rights. The practical and comprehensive approach, which looks at those weapons available to litigants and the implications of drafting performers' contracts, makes this a vital source of information. All legal advisers to the entertainment industry, and lawyers dealing with copyright in general, will find this book a valuable asset.

Book Security Rights in Intellectual Property

Download or read book Security Rights in Intellectual Property written by Eva-Maria Kieninger and published by Springer Nature. This book was released on 2020-06-11 with total page 711 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book discusses the main legal and economic challenges to the creation and enforcement of security rights in intellectual property and explores possible avenues of reform, such as more specific rules for security in IP rights and better coordination between intellectual property law and secured transactions law. In the context of business financing, intellectual property rights are still only reluctantly used as collateral, and on a small scale. If they are used at all, it is mostly done in the form of a floating charge or some other “all-asset” security right. The only sector in which security rights in intellectual property play a major role, at least in some jurisdictions, is the financing of movies. On the other hand, it is virtually undisputed that security rights in intellectual property could be economically valuable, or even crucial, for small and medium-sized enterprises – especially for start-ups, which are often very innovative and creative, but have limited access to corporate financing and must rely on capital markets (securitization, capital market). Therefore, they need to secure bank loans, yet lack their own traditional collateral, such as land.

Book Bordering Britain

    Book Details:
  • Author : Nadine El-Enany
  • Publisher : Manchester University Press
  • Release : 2020-02-11
  • ISBN : 1526145448
  • Pages : 331 pages

Download or read book Bordering Britain written by Nadine El-Enany and published by Manchester University Press. This book was released on 2020-02-11 with total page 331 pages. Available in PDF, EPUB and Kindle. Book excerpt: (B)ordering Britain argues that Britain is the spoils of empire, its immigration law is colonial violence and irregular immigration is anti-colonial resistance. In announcing itself as postcolonial through immigration and nationality laws passed in the 60s, 70s and 80s, Britain cut itself off symbolically and physically from its colonies and the Commonwealth, taking with it what it had plundered. This imperial vanishing act cast Britain's colonial history into the shadows. The British Empire, about which Britons know little, can be remembered fondly as a moment of past glory, as a gift once given to the world. Meanwhile immigration laws are justified on the basis that they keep the undeserving hordes out. In fact, immigration laws are acts of colonial seizure and violence. They obstruct the vast majority of racialised people from accessing colonial wealth amassed in the course of colonial conquest. Regardless of what the law, media and political discourse dictate, people with personal, ancestral or geographical links to colonialism, or those existing under the weight of its legacy of race and racism, have every right to come to Britain and take back what is theirs.

Book Customs Modernization Handbook

Download or read book Customs Modernization Handbook written by Luc De Wulf and published by World Bank Publications. This book was released on 2005-01-03 with total page 356 pages. Available in PDF, EPUB and Kindle. Book excerpt: Trade integration contributes substantially to economic development and poverty alleviation. In recent years much progress was made to liberalize the trade regime, but customs procedures are often still complex, costly and non-transparent. This situation leads to misallocation of resources. 'Customs Modernization Handbook' provides an overview of the key elements of a successful customs modernization strategy and draws lessons from a number of successful customs reforms as well as from customs reform projects that have been undertaken by the World Bank. It describes a number of key import procedures, that have proved particularly troublesome for customs administrations and traders, and provides practical guidelines to enhance their efficiency. The Handbook also reviews the appropriate legal framework for customs operations as well as strategies to combat corruption.
