The trust as a business organization may easily be investigated under: First: The source of its rights and its status in the law. Second: The relation of trustee and beneficiary, and the rights and duties of each, and Third: The effect of legislation on the trust. In this connection it is of interest to note that the trust may engage and do all things which an individual may do; and so far the only restriction sought to be placed on the individual is in banking and insurance. In the preparation of this work, reports were examined and not reference works, and where possible the language of the decision is used, with the thought in mind that the busy lawyer is more interested in the law expressed by the court than the deductions of a law writer. By the other method, which has been employed, the editor has endeavored to present for each side, with something of the realism of actual debate, the strongest summarized argument that can be honestly framed out of the material furnished by all who have publicly contributed anything of value to the discussion or to the literature of the subject - leaving each reader to draw his own conclusions. In other words, while the book is non-partisan, these arguments are fairly bi-partisan. This method also gave opportunity for put ting a mass of unclaimed but valuable material through the editorial crucible and bringing it out in something like sym metrical shape. Book excerpt: Excerpt from Leading and Select Cases on Trusts This work has its origin mainly in two circumstances: First, in there being heretofore no special compilation of authorities on the subject of Trusts; and, secondly, a desire to economize labor in the preparation of the Covington and Lexington Railroad case for trial. In default of being beneficial in that case, it was desired to put the result of this work in such form as to renew, in the attention of the profession and the reading public, the great rules for the administration of trusts. In their actual application, they have recently been so disregarded as to lead, in many cases, to the erroneous opinion that practice had established these rules adversely to the principles. As is well known to many, the labor indicated has been made almost the exclusive business of the author of this compilation, from the inception of the suit, in 1864-5, to the present time. In the selection of Leading Cases, I have taken such as have been the result of the most deliberate consideration and labor of the judicial minds whose opinions have given shape and weight to the laws of England and America. In the choice of other cases, I have selected those especially lately decided, which, it is hoped, will prove of practical use to the profession, and still further illustrate the principles of those that have become leading, and are the productions of the "great masters," as it were. Book excerpt: Excerpt from Trusts and the Public This volume is not a treatise on trusts, but a collection of articles and addresses previously published, discussing the different aspects of the subject as they have arisen during the last twelve years. The first one appeared in 1887 as a series of editorials in the New York Commercial Bulletin, now the Journal of Commerce and Commercial Bulletin, and was published in revised form in the Political Science Quarterly issued by Columbia University, for September, 1888. This was really about the first attempt seriously to discuss the trust question in its economic and social aspects. It was followed in the next issue of the- Quarterly by an exhaustive article on the legal aspects of trusts, by Judge Theodore W. Dwight, then the head of the Columbia Law School. From that time on the subject has grown and attracted more and more of public attention, until it has now become an absorbing topic of public discussion. During this period I have also discussed the subject in the Social Economist its successor Gunton's Magazine, the New York Independent, and in various public addresses. The editions of the periodicals containing these essays and addresses have in many instances been exhausted, so that several of them are now out of print.
