Book excerpt: In 2012, the European Commission's Network of Legal Experts in the Non-discrimination Field authored a landmark report on discrimination motivated by sex, gender identity and gender expression. The report - drawing upon expert knowledge in 30 European jurisdictions - highlighted the significant levels of inequality which, despite promising developments in individual countries, trans and intersex people confronted across the European Union (EU) and the European Free Trade Association (EFTA). In the years since 2012, the attention paid to the human rights of trans and intersex people and to discrimination on the grounds of gender identity and sex characteristics has increased significantly. Across the various Member States, and at the regional, especially the European and inter-American, level, there is growing awareness of the lived experience of trans and intersex individuals and greater understanding of the social, legal and economic challenges that they face. Yet despite this welcome increase in public knowledge and appreciation of trans and intersex lives, discrimination based on gender identity and sex characteristics remains a disproportionate reality across the EU and EFTA. In its 2014 report, 'Being trans in the EU', which explores the trans-focused data obtained during an EU-wide survey of lesbian, gay, bisexual and trans communities, the European Union Agency for Fundamental Rights (FRA) observed 'serious and repetitive victimisation [throughout] the EU'. Discrimination and violence are also disproportionately experienced by intersex people in Europe who, as observed recently by the Commissioner for Human Rights of the Council of Europe, have historically been coerced - through cultures of shame and secrecy - into positions of marginalisation and invisibility. In 2015, the European Commission published the 'List of actions to advance LGBTI equality'. Two of the Commission's priorities, as set out in its List of actions are: (a) improving rights and ensuring legal protection; and (b) monitoring and enforcement of the existing rights of lesbian, gay, bisexual, trans and intersex (LGBTI) people and their families. In 2016, the Council of Ministers asked the European Commission to report annually on the implementation of the list of actions. Against this background, the European Commission requested the European Equality Law Network to carry out an overview of trans and intersex equality frameworks across the 28 EU Member States and three additional EFTA states (Iceland, Liechtenstein and Norway). This report is the end product of that request. Proceeding through nine substantive chapters, the report analyses whether and how trans and intersex communities enjoy equality guarantees across the EU and EFTA.

Intersex people are born with sex characteristics that do not fit typical notions of male or female bodies, as a result of which they are stigmatised, marginalised and denied the recognition of their fundamental rights. Often, they are subjected to involuntary and harmful sex “normalising” surgeries at birth, which violate their bodily integrity, self-determination and informed consent, so as to comply with societal and legal norms. Moreover, binary legal frameworks prevent them from enjoying the rights to access identification documents, start a family, or be free from discrimination in all areas including employment and sports. To elaborate on intersex violations that emanate from binary laws, this book examines the situation of intersex rights in regional jurisdictions worldwide and within the European Union in particular. In the process, it identifies current legal barriers and suggests how intersex people could be accommodated under legal frameworks and achieve sex/gender equality beyond binary definitions.

'Equality of Opportunity for Sexual and Gender Minorities' assesses the unique challenges that sexual and gender minorities face in six important areas: (i) Criminalization and SOGI (ii) Access to education (iii) Access to the labor market (iv) Access to public services and social protection (v) Civil and political inclusion (vi) Protection from hate crimes. It also seeks to inflŽuence legislative changes and support research on institutions and regulations that can ultimately lead to poverty reduction and shared prosperity. At the same time, it acknowledges that the mere existence of inclusive laws and regulations does not ensure that sexual and gender minorities are free from discrimination--the enforcement of those laws is crucial. This publication, the first in a series of studies, will be expanded from the 16 countries included here to a wider set of countries for more in-depth quantitative analysis and to identify possible correlations with socioeconomic outcomes. Schneider was asked by the Council of Europe to write this report in order to explain the key points made regarding the rights of trans and intersex children, but also to explore other aspects as well, and to provide guidelines for policy makers and examples of good practice that could be helpful to member states in framing policies and implementing activities to promote trans and intersex children?s rights. As the author had to work within a fairly limited framework, the report should not be regarded as exhaustive. Addressing the issue of trans children from the perspective of their right to gender identity is crucial, and has ramifications in every area of the children?s lives. The rights of intersex children, as opposed to trans children, received relatively little attention at the Sion conference. Recher (2013) has emphasised the need for more systematic efforts to examine the situation of intersex children and to find solutions to the specific problems they face. The focus in the case of intersex children must be on upholding their physical integrity and respecting their bodies as they are, even if they do not conform to the norms associated with their biological sex. Intersex adults often talk about having had a highly medicalised childhood and there are serious concerns about respect for the rights of intersex children in this context. Previously unpublished testimonies were gathered by the author from TRAKINE (Germany), SAIL (Northern Ireland), OUTrans (France) and from three restricted access forums on Facebook, in which trans children and their parents talk about their experiences. The testimonies from intersex individuals were provided by OII Belgium. The statements were collected between July and November 2013.
