Book excerpt: For over 10 years the European Community has strived to develop suitable and proportionate answers to the phenomenon of convergence in its audiovisual regulatory policy. This article outlines the regulatory process at an EU level since the early 1980s as far as media, telecommunications and Information Society services are concerned, and analyses some of the most relevant policy papers specifically related to the adoption of the EC legal framework for the media in the digital age, before focusing on the preparatory phase leading up to the adoption of the Commission proposal for a Directive on Audiovisual Media Services, issued in December 2005. In addition, the core of this proposal for a revised Television without Frontiers Directive, i.e. the extension of its scope to cover new media services provided in a non-linear manner and the introduction of a graduated regime of regulation with a lighter-touch approach in view of such services, is presented along with the main lines of debate among stakeholders.

Book excerpt: Audiovisual Media Services Directive (AVMSD), which provided a legal framework for traditional TV broadcasts and on-demand services, was revised in November 2018 in order to align with new developments in audiovisual technologies and on audiovisual markets. To facilitate the implementation of the AVMSD, this study looks at regulatory and business practices relating to three topics included for the first time in the EU media framework: video-sharing platforms (VSPs), media ownership and transparency, and signal integrity. Concerning VSPs, the study looks at the extent to which VSPs can and do take measures to protect minors and the public, as envisaged by the AVMSD. It also looks at developments in implementation at Member State level and the transnational dimension. The media ownership and transparency part explores approaches across the EU to constraining media concentration and promoting transparency, the extent to which current rules are sufficient and enforced, the related best practices, and whether action should be taken at EU or national level. The signal integrity part discusses the prevalence of problems with signal integrity and the conditions that need to be met for the successful implementation of the Directive.

However, it also gives rise to reflection concerning the Council of Europe's European Convention on Transfrontier Television (ECTT), a parallel regulatory instrument concerning cross-border broadcasting. At a time of major transformation of the European legal instruments which are applied to broadcasting and new audiovisual services, this new report from the European Audiovisual Observatory takes stock of recent and current problem areas in broadcasting regulation in the light of the challenges these will raise for the new extended regulation. The report analyses issues of the practical application of the TVwF Directive and the ECTT in their current form. It also raises the question of the future cohabitation of the two instruments following the completed revision of the TVwF Directive, not forgetting that there will clearly be a period where the two instruments will be "out of phase" with each other.

The study updates a 2011 report by capturing changes in the legislative and economic audiovisual landscape between 2011 and 2016. Furthermore, the study brings together the data collected from Member States fulfilling their reporting obligation on the application of Article 13 of the AVMS Directive for the period 2011-2014, and on the application of Articles 16 and 17 of the AVMS Directive for the period 2013-2014. The study covers the legislative measures which have been adopted by Member States in respect of linear broadcasting and on-demand audiovisual media services examining the methods and periodicity for the collection of data by competent authorities in order to monitor the application of the Art. 13, 16 & 17 of the AVMS Directive. It provides examples of methods to ensure the prominence of European works in on-demand service catalogues and evidence of correlation between prominent works and audience demand. The study includes a description and analysis of the market for audiovisual works in the European Union, analysing the production and the distribution side in terms of number of businesses, employment and potential drivers of change. It also includes an analysis of the content offer on both linear broadcasting and on-demand services. For the year 2016, the study analyses the content broadcast by 54 channels in 11 Member States and the catalogues of 50 non-linear service providers in 6 Member States. Finally, the study provides a set of performance indicators in view of carrying out future monitoring and assessment activities at periodical intervals and it assesses how the performance indicators and operational procedures shall evolve in the context of the new AVMSD legislative proposal adopted by the European Commission on 25 May 2016.
