The focal point of discussion in each of these areas is a prosecutor's ethical responsibilities under the American Bar Association's Model Rules of Professional Conduct (through 2019) drawing frequent comparisons to significant state variations on the Model Rules, and supplemental guidance provided by the ABA's Criminal Justice Standards: Prosecution Function; the National District Attorneys Standards; and, the Justice Department Manual. The authors also examine constitutional constraints on prosecutorial discretion (particularly under the 5th and 6th Amendments) that at times may deviate from or supplement ethical norms. For the purposes of brevity and ease of reference, the book deviates from the traditional casebook format by summarizing rather than reprinting significant case decisions. Each chapter concludes with practical problems designed to promote class discussion about the appropriate exercise of prosecutorial discretion in hypothetical situations. In this analytic investigation, Martin Peterson articulates and defends five moral principles for addressing ethical issues related to new and existing technologies: the cost-benefit principle, the precautionary principle, the sustainability principle, the autonomy principle, and the fairness principle. It is primarily the method developed by Peterson for articulating and analyzing the five principles that is novel. He argues that geometric concepts such as points, lines, and planes can be put to work for clarifying the structure and scope of these and other moral principles. This geometric account is based on the Aristotelian dictum that like cases should be treated alike, meaning that the degree of similarity between different cases can be represented as a distance in moral space. The more similar a pair of cases are from a moral point of view, the closer is their location in moral space. A case that lies closer in moral space to a paradigm case for some principle p than to any paradigm for any other principle should be analyzed by applying principle p. The book also presents empirical results from a series of experimental studies in which experts (philosophers) and laypeople (engineering students) have been asked to apply the geometric method to fifteen real-world cases. The empirical findings indicate that experts and laypeople do in fact apply geometrically construed moral principles in roughly, but not exactly, the manner advocates of the geometric method believe they ought to be applied.

This failure to face up to these challenges has meant that no matter how successful traditional ethics has been at dealing with the problems it recognizes, it has failed to deal with the possibility that its solutions to these problems are biased in favour of humans, biased in favour of men, and biased in favour of Western culture. Failure to deal with these challenges has clearly put the justification of traditional ethics into question. Thus those concerned with the justification of traditional ethics have no alternative but to try to determine how these challenges can be met. To meet the challenges, Sterba argues that traditional ethics must incorporate conlfict resolution principles that favour nonhumans over humans in a significant range of cases, must rule out gendered family structures and implement an ideal of androgyny, and must endorse an ethics that is secular in character and one that can survive a wide-ranging comparative evaluation of both Western and non-Western moral ideals and cultures.
