Book excerpt: In many countries today there is a growing and genuinely-held concern that the institutional arrangements for the protection of human rights suffer from a 'democratic deficit'. Yet at the same time there appears to be a new consensus that human rights require legal protection and that all branches of the state have a shared responsibility for upholding and realising those legally protected rights. This volume of essays tries to understand this paradox by considering how parliaments have sought to discharge their responsibility to protect human rights. Contributors seek to take stock of the extent to which national and sub-national parliaments have developed legislative review for human rights compatibility, and the effect of international initiatives to increase the role of parliaments in relation to human rights. They also consider the relationship between legislative review and judicial review for human rights compatibility, and whether courts could do more to incentivise better democratic deliberation about human rights. Enhancing the role of parliaments in the protection and realisation of human rights emerges as an idea whose time has come, but the volume makes clear that there is a great deal more to do in all parliaments to develop the institutional structures, processes and mechanisms necessary to put human rights at the centre of their function of making law and holding the government to account. The sense of democratic deficit is unlikely to dissipate unless parliaments empower themselves by exercising the considerable powers and responsibilities they already have to interpret and apply human rights law, and courts in turn pay closer attention to that reasoned consideration. Book excerpt: Developed as an alternative to the American and Russian military systems, the Galileo programme is an independent European navigation satellite system designed specifically for civilian applications, primarily funded and controlled by the European Union and the European Space Agency. Galileo has potential uses across many sectors, though transport applications such as road and rail traffic monitoring, road pricing systems and air traffic control have been considered key areas of benefit. An earlier Committee report on the topic (HCP 1210, session 2003-04, ISBN 9780215020550), published in November 2004, recognised the potential benefits of the programme for the UK and Europe, but raised concerns over its cost and funding sustainability unless rigorous cost-benefit analyses were undertaken. The programme is currently in its development phase, with the second of two experiemental satellites due to be launched at the end of 2007. It is not expected to be fully operational until 2013-14 (originally this phase was meant to have commenced in 2008), and until Galileo becomes operational, Europe is largely reliant on the American and Russian systems. The Committee's report examines i) the costs, funding and value for money of the programme, including the delays encountered, the UK share of costs, the collapse of the public-private partnership (PPP) negotiations and the governance and procurement strategy; and ii) the impact of the complexity of the EU decision-making process on the programme's future funding and management.

More specifically, it presents the historical evolution, the main institutional legislative and policy steps, the position of, and interactions among, the different actors, and the factors impeding the formation of a common policy at EU level. On this basis a critical analysis is provided of the main institutional problems, the current policy framework, the overarching rationale as well as of the content and quality of the nascent EU migration law. The book is divided into three parts. The first two parts provide a comprehensive study of the institutional framework and the substantive EC/EU law respectively. The third and final part provides a more general analysis of the policy-making process. Since the major achievements in the field of migration are recent, the book focuses to a great extent on the post-Amsterdam era. However, for reasons of coherence and in order to better evaluate recent developments, a concise overview of the origins of this policy is provided. Moreover, special emphasis is placed on the Schengen acquis, since its mark on European affairs has been and remains pronounced. Overall the attempt has been to provide an account, which is up to date with extensive historical references and combines both an academic and practical perspective to the legal and political issues involved. The approach based on the above elements will contribute to a new understanding of the main aspects of EU migration law and its policy ramifications andwill be of use to both academics and practitioners alike.

The Committee's concerns arise from the meaning of "public function" and "public authority" in the Human Rights Act. It believes it was clear that Parliament intended the Act's requirement of public authorities to act compatibly with the European Convention on Human Rights to cover private-sector providers of publicly-funded services, and is disappointed that the Government has deferred a decision on a new statute to reinstate the original intention of the Act.

Book excerpt: Although road accident deaths have halved between 1958 and 2007 whilst the number of licensed motor vehicles and vehicle mileage covered increased by 400 per cent, the current rate of 3,000 deaths and 250,000 injuries is still an unacceptably high level. Road accidents are the largest single cause of death for people between the ages of 5 and 35 in Britain, and road accidents cost our economy some £18 billion each year. The number of deaths and injuries on roads far outweighs the deaths and injuries in other transport modes, and should be viewed as a major public health problem. The Government should establish a British Road Safety Survey to track overall casualty and safety trends, and review current methods for recording road-traffic injuries. The Committee recommends a systems approach to road safety: ensuring the vehicle, the road infrastructure, regulations and driver training are designed to similar safety and performance standards. Other recommendations include: more 20 mph speed limits; a more proactive approach to determining the safety benefits of new vehicle technologies; action on young drivers - who represent a disproportionate risk to road users - and vulnerable users: motorcyclists, elderly and child pedestrians and cyclists, horse riders; a higher priority given to enforcement of drink-drive and drug-drive offences. The Committee recommends the establishment of an independent Road Safety Commission with powers to work across the whole of government, ensuring that a high priority and adequate resources are given to road safety and that all government departments and agencies give active support. The Government should also establish a road accident investigation branch, like those in aviation, rail and marine.

The Committee's report considers domestic policy challenges relating to the promotion of innovation and improving the business environment and the skills base in the economy, and issues discussed include: the drivers of globalisation, trade and protectionism, global imbalances, as well as the beneficial and adverse effects of globalisation for the UK economy. The Committee recommends that, in order to promote understanding of the impact of globalisation on jobs and communities, the Government should publish an annual review of new developments affecting the impact of and prospects for globalisation. Given that protectionist sentiment is increasing, posing a threat to the progress of both developed and developing countries, the Committee supports the Government's promotion of a successful conclusion to the Doha trade round. Globalisation is also threatened by the risk of a disorderly unwinding of global imbalances and the success of a reformed International Monetary Fund will be judged by its performance in ensuring global imbalances are properly addressed.

Throughout that period, British officials have described UK operations there in various conflicting and often contradictory ways; as a counter-terrorism mission, a stabilisation mission, and a counter-narcotics mission, respectively. This book investigates how the war was ’sold’ to the British public and how Britain’s ’transnational’ foreign and defence policy impacted on the unfolding of UK strategy in Afghanistan and the way it was communicated. It argues that because the UK’s foreign and defence policy is transnationally-oriented - meaning that it is foundationally aimed at maintaining alliance with the United States and the institutional coherence of NATO - UK strategy is contingent upon collective security and, crucially, is fundamentally concerned with the means of policy (maintaining alliances) over the ends (using alliances to effect change). Explaining the inalienability of collective security systems to national security is no easy task, however, and, when faced with the adversities of Afghanistan, the UK state has since 2008 instead opted to describe the significance of Afghanistan in narrow, nation-centric, counter-terrorist concerns in order to maintain public support for collective security operations there whilst, paradoxically, framing the conflict in a manner that avoids talking about the transnational structure and purpose of the mission. This kind of ’strategic’ communication is increasingly becoming a focus of the UK state as it faces a transnational dilemma of maintaining its collective security bonds whilst facing a public increasingly sceptical of liberal interventionism.
