Book excerpt: On 2 and 3 December 2021, the European Commission, in partnership with the European Disability Forum, hosted its annual conference to celebrate the European Day of Persons with Disabilities. The 2021 edition of the conference was held online. It brought together more than 400 politicians, high- level experts and disability advocates to discuss current challenges, specifically in access to healthcare and in the digital transformation. The conference also focused on the experiences and needs of children with disabilities. Across Europe, persons with disabilities still face considerable barriers in their daily life: - 4 times more persons with disabilities report unmet healthcare needs than those without disabilities; - Only 64% of persons with disabilities have an internet connection at home, compared to 88% of persons without disabilities; - Over 1 in 5 young people with disabilities leave school early, compared to 1 in 10 of those without disabilities. As pointed out in the new EU Strategy for the Rights of Persons with Disabilities 2021-2030, it is important to scale up action to remove obstacles for the full and equal participation of persons with disabilities in society. Several solutions and initiatives were discussed to remove barriers and create equal opportunities for persons with disabilities. The conference provided an opportunity to exchange knowledge and ideas on how different stakeholders can work together towards a Union of Equality. This report summarizes the key messages and challenges highlighted during the European Day of Persons with Disabilities 2021 conference (EDPD2021) by the different speakers.

Chapter 1 contains results of a comparative study presented tabularly and narratively covering all handicaps in Belgium, Denmark, Germany, France, Ireland, Italy, Luxembourg, Netherlands, and the United Kingdom. Issues covered include administrative responsibility, private schools, financing, compulsory education laws, early childhood education, and integration of handicapped with nonhandicapped children. Nine trends in special education are identified in the brief second chapter. The third chapter provides a summary of special education for each nation and includes addresses of ministers and associations dealing with the handicapped. The questionnaire used in compiling the report is appended. The second section consists of the conference program, summaries of addresses, and summaries of the six discussion groups. A synthesis report notes differences in methods of achieving the goal of integration of the handicapped. (DB)

Along the lines of the integration of fundamental rights within the common market, the EU has indeed progressively adopted meaningful regulation to advance disability rights, which are now essentially shaped by the CRPD. The research considers the interaction between law and policy at the international, EU and Member States’ level, focusing on three essential elements, including the sources of disability law, institutional mechanisms and substantive regulation. Grounded in the distinction between primary rules on law-making and secondary norms on enforcement, the analysis unfolds against the background of the ‘twin’ transitions on sustainability and digitalisation and encompasses the Council of Europe system, particularly in the light of the foreseeable accession of the EU to the European Convention on Human Rights. Arguably, following the progressive development it has facilitated in other regulatory areas, the Court of Justice of the European Union can provide a decisive contribution to advancing inclusiveness for people with disabilities in the Union. The book is a useful resource for practitioners, policymakers, academics, students, researchers and anyone interested in EU and international disability law and politics.
