Download or read book Bills of Rights and Decolonization written by Charles Parkinson and published by OUP Oxford. This book was released on 2007-11-22 with total page 320 pages. Available in PDF, EPUB and Kindle. Book excerpt: Bills of Rights and Decolonization analyzes the British Government's radical change in policy during the late 1950s on the use of bills of rights in colonial territories nearing independence. More broadly it explores the political dimensions of securing the protection of human rights at independence and the peaceful transfer of power through constitutional means. This book fills a major gap in the literature on British and Commonwealth law, history, and politics by documenting how bills of rights became commonplace in Britain's former overseas territories. It provides a detailed empirical account of the origins of the bills of rights in Britain's former colonial territories in Africa, the West Indies and South East Asia as well as in the Atlantic and Pacific Oceans. It sheds light on the development of legal systems at the point of gaining independence and raises questions about the colonial influence on the British legal establishment's change in attitude towards bills of rights in the late twentieth century. It presents an alternative perspective on the end of Empire by focusing upon one aspect of constitutional decolonization and the importance of the local legal culture in determining each dependency's constitutional settlement and provides a series of empirical case studies on the incorporation of human rights instruments into domestic constitutions when negotiated between a state and its dependencies. More generally this book highlights Britain's human rights legacy to its former Empire, and traces the genesis of the bills of rights of over thirty nations from the Commonwealth.

Available in PDF, EPUB and Kindle. Book excerpt: Dr. Seigler has done a highly commendable job in producing a detailed biography on the life of Sir Ellis Clarke. His work, Sir Ellis Clarke: A Royal Son of the Soil is insightful, thought-provoking, and written in a reader-friendly style." Dr. Lawrence Rossow, Former Dean, University of Houston-Victoria. "Sir Ellis Clarke: A Royal Son of the Soil is an eloquent biography that introduces Americans to the life of Sir Ellis Clarke, a modern-day Founding Father of Trinidad and Tobago. Readers in the United States and around the world will be the likely beneficiaries of Dr. Seigler's insight into how Sir Ellis' struggle to devise a workable constitution for his own nation, might illuminate the constitutional jurisprudence of the United States." Download or read book How to Make Effective Legislative Proposals written by Bilika H. Simamba and published by AuthorHouse. This book was released on 2013-12-20 with total page 171 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book outlines the way in which legislative proposals in Trinidad and Tobago are conceived and processed. It also contains best practice suggestions on interfacing with Parliamentary Counsel regardless of the jurisdiction in which one is working. Those suggestions are based on the authors well-received earlier publication The Legislative Process: A Handbook for Public Officials (2009). That book was featured significantly in The Parliamentarian: Journal of Commonwealth Parliaments, 2010, Issue 1 XCI. In a review contained in The Loophole: Journal of the Commonwealth Association of Legislative Counsel (August, 2010), the reviewer wrote, In these times of recession I commend this book to anyone in Government wishing to improve processes to enable the production of legislation with improved efficiency and cost effectiveness. And in the Statute Law Review (April, 2010), 31(2), with reference to its suggestions for improved efficiency, it was said that . . . there is little that can be described as other than good advice here.
Download or read book Massa Day Done written by Lennie M. Nimblett and published by AuthorHouse. This book was released on 2016-01-08 with total page 150 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book describes the transition of Trinidad and Tobago from a British crown colony to an independent republic. Divided into two parts, the first sketches the constitutional developments from the Spanish capitulation of Trinidad in 1797 to changes associated with a British crown colony. It describes in greater detail the move, after 1956, towards republicanism and the debate about the 1976 constitution. Part I ends with a review of that debate. The second part examines some of the issues generated by the new constitution and, in particular, looks at problems associated with the president, the Privy Council, and representation.
Download or read book The Legislative Process written by Bilika H. Simamba and published by AuthorHouse. This book was released on 2009-11-24 with total page 272 pages. Available in PDF, EPUB and Kindle. Book excerpt: People are generally aware that legislation is introduced through Bills that are sent to the legislature, usually by the executive, and then passed into law. Few, however, are familiar with the processes that precede the submission of a Bill to the legislature. In fact, what eventually comes to the legislature is the product of long, often laborious processes, which go on for weeks, months and even years. To ensure that the civil servants and others who may be involved in shaping proposals are able to candidly express their views on policies that are being developed and refined, the deliberations on the executive side of government traditionally take place in secrecy. Mainly for that reason, the processes are not well known to the general public and even to some activists who lobby for or against legislation. This book, written by a lawyer who has long experience participating in these processes, gives rare insight into how legislative proposals are conceived, developed and finally written into the law. It also contains easy-to- understand technical information that explains the significance of certain features of statutes. Further, it deals with other matters that follow after enactment including publication, entry into force, application and much more.
Download or read book The Oxford Handbook of Caribbean Constitutions written by Richard Albert and published by Oxford University Press. This book was released on 2020-07-23 with total page 704 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Oxford Handbook of Caribbean Constitutions offers a detailed and analytical view of the constitutions of the Caribbean region, examining the constitutional development of its diverse countries. The Handbook explains the features of the region's constitutions and examines themes emerging from the Caribbean's experience with constitutional interpretation and reform. Beginning with a Foreword from the former President of the Caribbean Court of Justice and an Introduction by the lead editor, Richard Albert, the remainder of the book is divided into four parts. Part I, 'Caribbean Constitutions in the World', highlights what is distinctive about the constitutions of the Caribbean. Part II covers the constitutions of the Caribbean in detail, offering a rich analysis of the constitutional history, design, controversies, and future challenges in each country or group of countries. Each chapter in this section addresses topics such as the impact of key historical and political events on the constitutional landscape for the jurisdiction, a systematic account of the interaction between the legislature and the executive, the civil service, the electoral system, and the independence of the judiciary. Part III addresses fundamental rights debates and developments in the region, including the death penalty and socio-economic rights. Finally, Part IV features critical reflections on the challenges and prospects for the region, including the work of the Caribbean Court of Justice and the future of constitutional reform. This is the first book of its kind, bringing together in a single volume a comprehensive review of the constitutional development of the entire Caribbean region, from the Bahamas in the north to Guyana and Suriname in South America, and all the islands in between. While written in English, the book embraces the linguistic and cultural diversity of the region, and covers the Anglophone Caribbean as well as the Spanish-, French-, and Dutch-speaking Caribbean countries.
