Book Advancing the Rule of Law Abroad

Download or read book Advancing the Rule of Law Abroad written by Rachel Kleinfeld and published by Brookings Institution Press. This book was released on 2012-11-28 with total page 296 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the modern era, political leaders and scholars have declared the rule of law to be essential to democracy, a necessity for economic growth, and a crucial tool in the fight for security at home and stability abroad. The United States has spent billions attempting to catalyze rule-of-law improvements within other countries. Yet despite the importance of the goal to core foreign policy needs, and the hard work of hundreds of practitioners on the ground, the track record of successful rule-of-law promotion has been paltry. In Advancing the Rule of Law Abroad, Rachel Kleinfeld describes the history and current state of reform efforts and the growing movement of second-generation reformers who view the rule of law not as a collection of institutions and laws that can be built by outsiders, but as a relationship between the state and society that must be shaped by those inside the country for lasting change. Based on research in countries from Indonesia to Albania, Kleinfeld makes a compelling case for new methods of reform that can have greater chances of success. This book offers a comprehensive overview of this growing area of policy action where diplomacy and aid meet the domestic policies of other states. Its insights into the practical methods and moral complexities of supporting reform within other countries will be useful to practitioners and students alike.

Book Constitutional Transition and the Travail of Judges

Download or read book Constitutional Transition and the Travail of Judges written by Marie Seong-Hak Kim and published by Cambridge University Press. This book was released on 2021-03-11 with total page 361 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book looks at the history of the courts in South Korea from 1945 to the contemporary period. It sets forth the evolution of the judicial process and jurisprudence in the context of the nation's political and constitutional transitions. The focus is on constitutional authoritarianism in the 1970s under President Park Chung Hee, when judges faced a positivist crisis as their capacity to protect individual rights and restrain the government was impaired by the constitutional language. Caught between the contending duties of implementing the law and pursuing justice, the judges adhered to formal legal rationality and preserved the fundamental constitutional order, which eventually proved essential in the nation's democratization in the late 1980s. Addressing both democratic and authoritarian rule of law, this volume prompts fresh debate on judicial restraint and engagement in comparative perspectives.

Book The Limits of Constitutional Democracy

Download or read book The Limits of Constitutional Democracy written by Jeffrey K. Tulis and published by Princeton University Press. This book was released on 2010-10-18 with total page 360 pages. Available in PDF, EPUB and Kindle. Book excerpt: Constitutional democracy is at once a flourishing idea filled with optimism and promise--and an enterprise fraught with limitations. Uncovering the reasons for this ambivalence, this book looks at the difficulties of constitutional democracy, and reexamines fundamental questions: What is constitutional democracy? When does it succeed or fail? Can constitutional democracies conduct war? Can they preserve their values and institutions while addressing new forms of global interdependence? The authors gathered here interrogate constitutional democracy's meaning in order to illuminate its future. The book examines key themes--the issues of constitutional failure; the problem of emergency power and whether constitutions should be suspended when emergencies arise; the dilemmas faced when constitutions provide and restrict executive power during wartime; and whether constitutions can adapt to such globalization challenges as immigration, religious resurgence, and nuclear arms proliferation. In addition to the editors, the contributors are Sotirios Barber, Joseph Bessette, Mark Brandon, Daniel Deudney, Christopher Eisgruber, James Fleming, William Harris II, Ran Hirschl, Gary Jacobsohn, Benjamin Kleinerman, Jan-Werner Müller, Kim Scheppele, Rogers Smith, Adrian Vermeule, and Mariah Zeisberg.

Chief Awolowo was a principled man, who by a Spartan self-discipline and understanding of himself, his accomplishments, failures and successes, was a fearless leader. He has set an example of leadership for a new generation of Nigerian politicians. He was not only a brilliant politician, but a highly cerebral thinker, statesman, dedicated manager, brilliant political economist, a Social Democrat, and a committed federalist. From all accounts, Chief Awolowo knew the worst and the best, laughter and sorrow, vilification and veneration, tribulations and triumphs, poverty and prosperity, failures and successes in life.

Book The Politics and Policies of Sub Saharan Africa

Download or read book The Politics and Policies of Sub Saharan Africa written by Robert A. Dibie and published by University Press of America. This book was released on 2001 with total page 382 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book attempts to correct the impression created by Western media that Sub-Saharan Africa is in a state of anarchy. The text analyzes and shows that while many Sub-Saharan African nations are experiencing the worst time of their history, others are enjoying their best times. Thus, the text argues that although some parts of Africa are experiencing crisis, the continent is also a fine region of major new experiments in governance, peace building and free market transformation programs. Finally, the text focuses some of its analyses on the colonial legacy, economic and ethnic transformation, indigenous institutions and other forces that seem to influence the governance of Sub-Saharan African nations.

Book African Political and Economic Philosophy with Africapitalism

Download or read book African Political and Economic Philosophy with Africapitalism written by Ephraim-Stephen Essien and published by Lexington Books. This book was released on 2024-03-06 with total page 221 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book creates (on the one hand) and explores (on the other hand) philosophies of African development suitable for Black sub-Saharan African countries. As an academic discipline focused on thought informed by indigenous moral values among Black peoples in the sub-Saharan region, African political philosophy involves philosophizing normatively about government by traditional Black African people with the aim of advancing a better African society. African political philosophy does not mean that its themes, views, concepts, and approaches are exclusively African. It also does not mean that only thinkers in Africa could hold these concepts, nor does it mean that all African thinkers hold the same views. “African” is used geographically in African political philosophy to demarcate certain perspectives that are unique to sub-Saharan African thought and practice that tend not to be the case elsewhere. An African political and economic philosophy should address the origin and method of political power, the guarantee of human and civil liberties, and how economic goods are generated and distributed in African societies. Africapitalism, as a new economic philosophy, obviates the inadequacies in Afrisocialism and offers an option for an African economic philosophy. Edited by Ephraim-Stephen Essien and Frank Aragbonfoh Abumere, the contributors to African Political and Economic Philosophy with Africapitalism: Concepts for African Leadership ask the question: can a neo-Afrisocialism offer anything good for the Africa?

Book The Challenges of Democratic Governance in Nigeria s Fourth Republic

Download or read book The Challenges of Democratic Governance in Nigeria s Fourth Republic written by Stanley Naribo Ngoa and published by Cambridge Scholars Publishing. This book was released on 2024-10-14 with total page 275 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is a collection of scholarly essays from some of Nigeria’s most notable social science scholars on the character, contours, and peculiarities of democratic practices in Nigeria’s fourth attempt at constitutional rule after years of brutally absolutist military regimes. The Fourth Republic began in 1999 and continues to this day. It is coterminous with the restoration of constitutional rule after 16 years of sustained military rule, which represents the longest stretch of democratic self-rule since Nigeria won independence from British colonialism in 1960. The chapters in this book contain scholarly insights into the pitfalls of governance, institutional dysfunctions and foundational woes that continue to threaten the vitality of the Fourth Republic. Contributors to the book offer critical theoretical lenses to gaze at the decline in democratic citizenship, weakening of faith in the promises of democracy, loss of critical media engagement with the state, and deterioration of the socio-political fortunes of the state in Nigeria.

Book Yor b Elites and Ethnic Politics in Nigeria

Download or read book Yor b Elites and Ethnic Politics in Nigeria written by Wale Adebanwi and published by Cambridge University Press. This book was released on 2014-03-31 with total page 319 pages. Available in PDF, EPUB and Kindle. Book excerpt: Yorùbá Elites and Ethnic Politics in Nigeria investigates the dynamics and challenges of ethnicity and elite politics in Nigeria, Africa's largest democracy. Wale Adebanwi demonstrates how the corporate agency of the elite transformed the modern history and politics of one of Africa's largest ethnic groups, the Yorùbá. The argument is organized around the ideas and cultural representations of Ọbáfemi Awólowo, the central signifier of modern Yorùbá culture. Through the narration and analysis of material, non-material and interactional phenomena - such as political party and ethnic group organization, cultural politics, democratic struggle, personal ambitions, group solidarity, death, memory and commemoration - this book examines the foundations of the legitimacy of the Yorùbá political elite. Using historical sociology and ethnographic research, Adebanwi takes readers into the hitherto unexplored undercurrents of one of the most powerful and progressive elite groups in Africa, tracing its internal and external struggles for power.
