Book The Torture of Children During Armed Conflicts

Download or read book The Torture of Children During Armed Conflicts written by Sonja C. Grover and published by Springer Science & Business Media. This book was released on 2013-10-24 with total page 238 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines selected legal complexities of the notion of torture and the issue of the proper foundation for legally characterizing certain acts as torture, especially when children are the targeted victims of torture. ICC case law is used to highlight the International Criminal Court’s reluctance in practice to prosecute as a separable offence the crime of torture as set out in one or more of the relevant provisions of the Rome Statute where children are the particularized targets as part of a common plan during armed conflict. Also addressed is the failure of the ICC to consider that the young age of the victims of torture (i.e. children) should be an aggravating factor taken into account in determining the ICC sentence for those convicted of the torture of civilians, including children, in the context of armed conflict as part of a common plan. The six UN-designated grave crimes against children (including child soldiering for State or non-State forces perpetrating mass atrocities, and sexual violence perpetrated on a systematic and widespread basis against children including child soldiers), it is argued, are also instances of the torture of children as part of a common plan such that separate charges of torture are legally supportable (along with the other charges relating to additional Rome Statute offences involved in such circumstances). Useful legal perspectives on the issue of the torture of children in its various manifestations gleaned from the case law of other international judicial forums such as the Inter-American Court of Human Rights and the ICTY are also examined.

Book Children Torture and Power

Download or read book Children Torture and Power written by Nathalie Man and published by . This book was released on 2000 with total page 107 pages. Available in PDF, EPUB and Kindle. Book excerpt: Children, Torture and Power is a call to the international community to place the torture of children onto the international human right agenda, and to start combatting this deep-rooted problem. The report shows how children in countries all over the world are being subjected to torture and ill-treatment at the hands of their own governments and armed opposition groups. Drawing on documentary evidence from the UN and inter-governmental bodies, as well as a wide range of NGO's this report indentifies the following factors which increase children's vulnerability to torture and ill-treatment: conflict with the law; poverty; discrimination (for example, ethnicity, religion, gender, social, origin, birth); family associations; political activism; and involvement in armed conflict. The report also considers: the international definition of torture and problems in its application to children the effects of torture on children mechanisms which exist to protect children from torture.

Book Children in War

Download or read book Children in War written by Everett M. Ressler and published by . This book was released on 1993 with total page 296 pages. Available in PDF, EPUB and Kindle. Book excerpt: The sad reality of children killed, tortured, imprisoned, and orphaned by war substantiates the need for renewed local, national, and international commitment to these children. This guide examines: (1) the impacts present-day armed conflicts have on children and their families; (2) what special needs of children should be anticipated and monitored; (3) which children in what circumstances are likely to have special needs that may require intervention; (4) what principles of program response might be expected; (5) what program strategies are being adopted around the world to meet children's needs; and (6) what literature and special resources are available to service providers. The first part of the book opens with a discussion of armed conflict, essential to comprehending the needs of children in these situations and to finding ways to assure their well-being. A photo essay then offers a forceful statement of how conflict affects children. The next chapter provides a conceptual framework for addressing war's negative effects on children. Six chapters in the second part of the book consider different impacts of conflict on children and what is being done to counter these impacts. The topics covered are: (1) loss of life; (2) injury, illness, malnutrition, and disability; (3) torture, abuse, imprisonment, and recruitment; (4) unaccompanied children; (5) psychosocial distress; and (6) educational disruption. The guide contains chapter references and a selected bibliography of over 1,000 items related to the provision of services to children in situations of armed conflict. (TJQ)

Book The Impact of Armed Conflict on Children

Download or read book The Impact of Armed Conflict on Children written by Carol Djeddah and published by . This book was released on 1997 with total page 117 pages. Available in PDF, EPUB and Kindle. Book excerpt: This article examines the contribution of WHO to the UN study on the impact of armed conflict on children. Armed conflicts cause direct or indirect effects on children's health, growth and development, leading to increased morbidity and mortality. This paper projects the numbers of children at risk in armed conflicts: between 117 and 138 million children could be indirectly vulnerable by the year 2000 ; and between 124-145 million children worldwide would be at risk by the year 2030. This report addresses the primary, secondary and tertiary prevention of the adverse impact of armed conflicts. A number of actions and approaches are also proposed. The public health examines the scope and nature of health aspects of children in armed conflicts. The delivery of health services to civilians, and especially to the needy and vulnerable groups such as children and women, is also very adversely affected. This occurs while the need for preventive, promotional and environmental health services increases. Gender-based inequity is usually exacerbated during situations of extreme violence such as armed conflict. The use of sexual and gender-based violence against women and girls as a weapon of war has too often been underreported. In view of these, health personnel have an important part in educating the general public, raising awareness and concern about the consequences of war, torture, disabilities, rape, nuclear and biological weapons, and encouraging governments and the media to follow-up these issues. This paper concludes with technical recommendations prior to, during, and after armed conflicts.

Book excerpt: First published in 1998, this book seeks to consider the application of international human rights standards to situations where children are at risk of torture and other forms of ill-treatment. Each of the contributors authoritatively examines torture, cruel, inhuman and degrading treatment and punishment from the perspective of their own discipline and experience. In exploring the issues, Childhood Abused, also helps to raise their profile, as invisibility, ignorance and secrecy contribute to the continuation of such practices. The subject is harrowing and complex, Childhood Abused, needs to be read so that we are better able to prevent and protect children against such abhorrent and prohibited forms of ill-treatment.

Book excerpt: "Child soldiers are among the most tragic victims of the war in Liberia. Although international law forbids the use of children under the age of 15 as soldiers, thousands of young children have been involved in the fighting since it began in December 1989. The main rebel forces, the National Patriotic Front of Liberia (NPFL) and the United Liberian Movement for Democracy in Liberia (ULIMO), have consistently used children under the age of 18, including thousands under 15. Children are also reportedly used by the other warring factions. As a consequence, thousands of children in Liberia have suffered cruelly during the war: many have been killed or wounded or witnessed terrible atrocities. Moreover, many children themselves have been forced to take part in the killing, maiming or rape of civilians. The use of children as soldiers presents grave human rights problems. Many of these children have been killed during the conflict, thus denied the most basic right -- the right to life. Others have been forcibly conscripted by the warring factions, and separated from their families against their wills. Many have joined warring factions to survive. All have been denied a normal childhood. Reintegrating these children into their communities is a task of immense difficulty. Some children's parents have been killed, their families have fled, and no relatives can be found. In others, families have refused to take children back because of the abuses they have committed. Human Rights Watch believes that 18 is the minimum age at which people may properly take part in armed conflict."--cover.

Book Monitoring State Compliance with the UN Convention on the Rights of the Child

Download or read book Monitoring State Compliance with the UN Convention on the Rights of the Child written by Ziba Vaghri and published by Springer Nature. This book was released on 2022-01-03 with total page 429 pages. Available in PDF, EPUB and Kindle. Book excerpt: This open access book presents a discussion on human rights-based attributes for each article pertinent to the substantive rights of children, as defined in the United Nations Convention on the Rights of the Child (UNCRC). It provides the reader with a unique and clear overview of the scope and core content of the articles, together with an analysis of the latest jurisprudence of the UN Committee on the Rights of the Child. For each article of the UNCRC, the authors explore the nature and scope of corresponding State obligations, and identify the main features that need to be taken into consideration when assessing a State’s progressive implementation of the UNCRC. This analysis considers which aspects of a given right are most important to track, in order to monitor States' implementation of any given right, and whether there is any resultant change in the lives of children. This approach transforms the narrative of legal international standards concerning a given right into a set of characteristics that ensure no aspect of said right is overlooked. The book develops a clear and comprehensive understanding of the UNCRC that can be used as an introduction to the rights and principles it contains, and to identify directions for future policy and strategy development in compliance with the UNCRC. As such, it offers an invaluable reference guide for researchers and students in the field of childhood and children’s rights studies, as well as a wide range of professionals and organisations concerned with the subject.

Book Protecting Children in Armed Conflict

Download or read book Protecting Children in Armed Conflict written by Shaheed Fatima KC and published by Bloomsbury Publishing. This book was released on 2018-09-20 with total page 601 pages. Available in PDF, EPUB and Kindle. Book excerpt: In armed conflicts around the world, children are being killed, raped, abducted and recruited to fight at a shocking scale. In light of this continuing general failure to protect children in conflict, it is questionable whether existing international law norms and institutions provide sufficient protection and accountability. Consideration needs to be given to whether international law can do more – practically and effectively – when moral lines are crossed. That is the purpose of this book. It reviews the position of children in armed conflict by reference to the 'six grave violations' as identified by the UN Security Council. It analyses the protection offered by international humanitarian law, international criminal law and international human rights law, and also assesses the related adjudicative accountability mechanisms. The analysis concludes with a number of recommendations and proposals for reform, with a view to enhancing accountability and deterring future violations. The book has been written by a team of lawyers, headed by Shaheed Fatima QC, and has drawn on the input of an expert advisory panel comprising leading academics, policy-makers and activists. It has been written as part of the Inquiry on Protecting Children in Conflict. The Inquiry has been sponsored by Save the Children and Theirworld and chaired by former UK Prime Minister, Gordon Brown.

Book Protection of Children During Armed Political Conflict

Download or read book Protection of Children During Armed Political Conflict written by Charles W. Greenbaum and published by Intersentia nv. This book was released on 2006 with total page 515 pages. Available in PDF, EPUB and Kindle. Book excerpt: The purpose of this book is to help researchers and professionals understand the possibilities for protecting children in violent political conflicts. This is the first book to be published on this important, complex and painful topic. Most other publications have concentrated on the effects of political violence on children and adults, but have little or nothing to say on prevention from the point of view of the social sciences. This book represents the beginnings of a new field of inquiry and policy. The book includes: research on the effects of exposure to political violence on children; reports by police and military experts of their experiences in protecting the public and children while keeping order; observations from people in human rights and childrens rights organizations on issues of attempting to report to and observe both sides in a conflict; and work by legal researchers on international law relating to the protection of children in political conflicts.

Book Hearts of Darkness

Download or read book Hearts of Darkness written by Henry A. Giroux and published by Routledge. This book was released on 2015-12-03 with total page 172 pages. Available in PDF, EPUB and Kindle. Book excerpt: George W. Bush's war on terror defended torture as a matter of official policy and furthered an already emergent culture of cruelty. As torture became normalized in the Bush era, it not only corrupted American ideals and political culture, it also passed over to the dark side in sanctioning the unimaginable and unspeakable: the torture of children. This shocking book documents cases of child torture by American military personnel, many of which have never been reported in the media. Giroux raises serious challenges the Obama administration must address in light of this shameful period in American history if it wants to restore democratic culture. Going further than simply blaming those at the top, Hearts of Darkness also raises questions about the collusion of the media, educators, the criminal justice system and other institutions that have enabled a culture that accepts the torture of children.
