Book excerpt: Surveying three decades of land reform efforts in Latin America, Peter Dorner draws upon his broad experience as both a policy maker and a researcher specializing in land tenure systems. He argues that the failures of Latin American land reforms are due to a lack of political will and commitment exacerbated by inadequate capital resources. Avoiding polemics, Dorner evaluates the many competing theoretical and ideological positions in the ongoing debates over land reform, from structuralist economics to liberation theology. He then looks at a range of actual reform experiences, including local peasant initiatives and international aid projects. Emphasizing the growing complexity of Latin American economies, Dorner demonstrates that solutions successful in one country may fail in another. He concludes that aid and political pressure from the international community can play only a peripheral role. Recognizing that change must come from within, Latin American countries must develop multifaceted approaches to meet objectives based on their own individual experiences. Dorner warns that "romantic" expectations for future land reform relying on any one solution will continue to lead to disillusionment. If opportunities for the landless population were actually a top priority of governments and power-brokers, Dorner believes, they could be achieved through agrarian reform policies that set clear goals and criteria for implementation. Nevertheless, the potential gains from such a program are, in most cases, more limited now than thirty years ago.

Book excerpt: In large Latin American cities the number of dwellings in informal settlements ranges from one-tenth to one-third of urban residences. These informal settlements are caused by low income, unrealistic urban planning, lack of serviced land, lack of social housing, and a dysfunctional legal system. The settlements develop over time and some have existed for decades, often becoming part of the regular development of the city, and therefore gaining rights, although usually lacking formal titles. Whether they are established on public or private land, they develop irregularly and often do not have critical public services such as sanitation, resulting in health and environmental hazards. In this report from the Lincoln Institute of Land Policy, author Edesio Fernandes, a lawyer and urban planner from Latin America, studies the options for regularization of the informal settlements. Regularization is looked at through established programs in both Peru and Brazil, in an attempt to bring these settlements much needed balance and improvement. In Peru, based on Hernando de Soto's theory that tenure security triggers development and increases property value, from 1996 to 2006, 1.5 million freehold titles were issued at a cost of $64 per household. This did result in an increase of property values by about 25 percent, making the program cost effective. Brazil took a much broader and more costly approach to regularization by not only titling the land, but improving public services, job creation, and community support structures. This program in Brazil has had a cost of between $3,500 to $5,000 per household and has affected a much lower percent of the population. The report offers recommendations for improving regularization policy and identifies issues that must be addressed, such as collecting data with baseline figures to get a true evaluation of the benefit of programs established. Also, it shows that each individual informal settlement must have a customized plan, as a single approach will not work for each settlement. There is a need to include both genders for long-term effectiveness and to find ways to make the regularization self-sustaining financially. Any program must be closely monitored to insure the conditions are improved for the marginalized, as well as be sure it is not causing new informal settlements to be established.

Most of the rural poor remain dependent on land-based livelihoods for their incomes and reproduction despite significant livelihood diversification in recent years. Land issue remains critical to any development discourse today. Market-led agrarian reform (MLAR) has gained prominence since the early 1990s as an alternative to state-led land reforms. This neoliberal policy is based on the inversion of what its proponents see as the features of earlier approaches, and calls for redistribution via privatized, decentralized transactions between ‘willing sellers’ and ‘willing buyers’. Its proponents, especially those associated with the World Bank, have claimed success where the policy has been implemented, but such claims have been contested by independent scholars as well as by peasant movements who are struggling to gain access to land. This book presents three thematic papers and six country studies. The thematic papers address issues of formalisation of property rights, gendered land rights, and neoliberal enclosure. These studies demonstrate the pervasive influence of neoliberal ideas on property rights and rural development debates, well beyond the ‘core’ question of land redistribution. The country cases bring together experiences from Brazil, Guatemala, El Salvador, Philippines, South Africa and Egypt. Common findings include the success of landowners in minimising the impact of reform, and a lack of post-transfer support, translating into marginal impact on poverty. The limitations of the market-led approach, and the implications of the studies presented here for the future of agrarian reform, are considered in the editors’ introduction. Despite the attempts of a number of Latin American republics to redistribute land resources and carry out agrarian reform programmes, ’the land question’ remains a vital political issue throughout the region. This book focuses on Bolivia, where government proposals to replace a radical agrarian reform law of 1953 with a neo-liberal Ley INRA provoked heated public debate and violent campesino clashes with the police (witnessed by the author) in September/October 1996. The first five chapters are largely concerned with theoretical aspects and a review of Bolivia’s agrarian reform legislation: the remaining six chapters are devoted to an analysis, from the viewpoints of participant campesinos and the researcher, of agricultural change in Aymara communities beside Lake Titicaca, where the author has conducted research over nearly 30 years. Currently lakeside farming is under severe threat as a result of land degradation, limited cash resources, rural-urban migration, tourism and commuterisation.
