Available in PDF, EPUB and Kindle. Book excerpt: Congress took action in the FY2007 National Defense Authorization Act (P.L. 109-364) to move the specialty metal provision from the Berry Amendment (Title 10, United States Code [U.S.C.] 2533a) into a separate section of Title 10 (10 U.S.C. 2533b). Section 843 of P.L. 109-364 directed the Secretary of Defense to establish a Strategic Materials Protection Board to determine, analyze, and recommend strategies to ensure the domestic availability of materials designated as critical to national security. The Board met in July 2007 and issued a report in September 2007. In July 2008, the Department of Defense (DOD) proposed to amend the Defense Federal Acquisition Regulation Supplement (DFARS) to implement Section 842 of the FY2007 National Defense Authorization Act and Sections 804 and 884 of the FY2008 National Defense Authorization Act, P.L. 110-181. The FY2008 National Defense Authorization Act (P.L. 110-181) contains several provisions which may impact the procurement of specialty metal. Section 803 requires the Strategic Materials Protection Board to perform an assessment of the viability of domestic producers of strategic materials; Section 804 changes the requirement that DOD procure all specialty metal from domestic sources. This provision does not apply to contracts or subcontracts for the acquisition of commercially available off-the-shelf items (with certain exceptions), as defined in the Office of Federal Procurement Policy Act, Section 35(c); and Section 884 requires DOD to publish a notice on the Federal Business Opportunities website before making any nonavailability determinations that would apply to multiple contracts.

Book excerpt: "The Berry Amendment [Title 10, United States Code (U.S.C.) 2533a] is an amendment to the 1941 Fifth Supplemental National Defense Appropriations Act, Public Law (P.L.77-29). It is the basis for a 65-year old procurement policy that prohibits the Department of Defense (DOD) from purchasing certain items or components of items, such as specialty metals, from foreign sources. The specialty metals clause has been part of the Berry Amendment since 1972. Congress took action in the Fiscal Year (FY)2007 National Defense Authorization Act to move the specialty metals provision from the Berry Amendment into a separate section, Title 10, U.S.C. 2533b."--Page 2

Book excerpt: CRS-3 materials; and to report the results of that analysis at the next SMPB meeting.4 FY2007 National Defense Authorization Act and the Enactment of a New Specialty Metal Provision Congress enacted provisions in the FY2007 National Defense Authorization Act that changed the statutory authority for the special metal provision. [...] Facing the dilemma of how to supply equipment needed to fight the war, the Senate drew upon the original intent and purpose of the specialty metal provision, as interpreted in a memorandum by then-Secretary of Defense Melvin Laird. [...] Second, what are the factors that contribute to the success or failure of the administration and enforcement of the specialty metal provision?. [...] The issue of reliability has been the cornerstone of why domestic source restrictions, like the specialty metal provision, are viewed by some as essential to the viability of the domestic defense industrial base. [...] This provision grants the Secretary of Defense the authority to give a "one-time waiver"of the specialty metal domestic source requirement, under certain conditions.31 Finally, the new specialty metal provision authorizes the creation of a Strategic Materials Protection Board.

Book The Berry Amendment

Download or read book The Berry Amendment written by and published by . This book was released on 2001 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: The Berry Amendment requires the Department of Defense (DOD) to give preference in procurement to domestically produced, manufactured, or home grown products, notably food, clothing, fabrics, and specialty metals. In order to protect the U.S. industrial base during periods of adversity and war, Congress passed domestic source restrictions as part of the 1941 Fifth Supplemental DOD Appropriations Act; these provisions later became the Berry Amendment. Since then numerous other items have been proposed and/or added. Congress modified the Berry Amendment in Section 832 of S. 1438, the FY2002 DOD Authorization Act, P.L. 107-107. The Berry Amendment is now part of the United States Code (10 U.S.C. ʹ 2533a. The Defense Federal Acquisition Regulation Supplement (DFARS) was amended to include exceptions for the acquisition of food, speciality metals, and hand or measuring tools when needed to support contingency operations or when the use of other than competitive procedures is based on an unusual and compelling urgency; it was revised in January 2005 to add new items, components, and materials covered under the Berry Amendment. In the spring of 2001, Congress revisited the Berry Amendment largely in response to a controversy involving the Army2s procurement of black berets. DOD had granted the Defense Logistics Agency authority to waive the Berry Amendment in order to purchase berets from foreign sources. However, it was reported that DOD had known for 25 years that no U.S. firm produced a solely domestic beret; this suggested that other violations of the Berry Amendment may have been overlooked or under-reported. This procurement event raised important questions: (1) If the U.S. does not produce a solely domestic item, should DOD procurement be restricted from access to foreign sources? (2) Do procurement policies under the Berry Amendment adequately provide the best value to DOD and the federal government? (3) To what extent do U.S. national security interests justify waivers of the Berry Amendment? Some policymakers believe that policies like the Berry Amendment contradict free trade policies, and that the presence and degree of such competition is the most effective tool for promoting efficiencies and improving quality. On the other hand, others believe that key U.S. sectors need the protections afforded by the Berry Amendment. These two views have been the subject of ongoing debate in Congress. In the debate over the passage of the FY2004 defense authorization bill, Representative Duncan Hunter, Chairman of the House Armed Services Committee, sought to strengthen and expand both the Berry Amendment and the Buy American provisions. In the 108th Congress, both the proposed FY2005 National Defense Authorization Act (H.R. 4200), and P.L. 108-287, the FY2005 Department of Defense Appropriations Act, (H.R. 4613), contain provisions that may affect domestic source provisions in the Berry Amendment and the Buy American Act. This report examines the original intent and purpose of the Berry Amendment, legislative proposals to amend both laws and regulations governing the application of domestic source restrictions, as well as options for Congress. The report will be updated as events warrant.

Book Transatlantic Defence Procurement

Download or read book Transatlantic Defence Procurement written by Luke R. A. Butler and published by Cambridge University Press. This book was released on 2017-03-02 with total page 563 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume constitutes the first ever attempt to establish a basis for comparative research on defence procurement regulation. For decades there has been repeated emphasis on the extent to which barriers to trade in Europe and the US prevent a more competitive defence market. Transatlantic Defence Procurement offers the first analysis of the potential impact of defence procurement regulation itself as a barrier to trade between the US and the EU. Part I examines the external dimension of a new EU Defence Procurement Directive, focusing on its implications for third countries, in particular the US. Part II examines foreign access and treatment under US law. Part III maps a future research agenda that is essential for a more systematic understanding of legal barriers to transatlantic defence trade. The book provides context for future initiatives, ranging from reformed market access arrangements to a Defence Transatlantic Trade and Investment Partnership and beyond.
