The accession of new Member States creates the potential for a stronger and more powerful Europe. Realising this potential, however, will depend on the ability of the EU to develop functional and effective governance structures, both at the European level and at the level of the individual Member States. While the acquis communautaire will ensure that formal laws in the new Member States will be aligned with those of existing members, the question remains as to how effective institutions will be in implementing changes, and what effects the imposed changes will have on the legitimacy of the new legal framework. This book, containing the work of leading scholars in law and social sciences, examines the current and future legal framework for EU governance, and the role that new members will - or will not - play in the creation of that framework, paying particular attention to the specific challenges membership in the EU poses to the acceding states of Central and Eastern Europe. It is a book which will contribute to and influence debates over constitutionalism and legal harmonisation in the EU.

Foregrounding the experiences and perspectives of Roma living and working outside of their nation-states of ‘origin’ or ostensible citizenship, the book seeks to elucidate wider inequalities and hierarchies at stake in the ongoing (re-)racialisation of both Roma migrants and migrants in general. EU legislation requires Member States to introduce laws prohibiting racial discrimination in many aspects of everyday life, including employment, education, healthcare, and housing. Alongside legislation requiring action at national level, the EU institutions have also made periodic commitments to 'mainstream' racial equality: taking anti-racism objectives into account within all areas of EU law and policy. This book analyses the extent to which the objectives of combating racism and promoting ethnic equality have been effectively mainstreamed throughout a wide range of EU policy fields. It begins by considering what combating racism means in the contemporary context of the enlarged EU. Bell explores what mainstreaming ethnic equality objectives entails, and whether the priorities and instruments differ from those adopted in the earlier mainstreaming of gender equality, or those used on other discrimination grounds. By drawing on the EU’s intervention in human rights provision in Romania before 2007, it is demonstrated that the feedback effects of this intervention have led to the emergence of an EU child rights policy. Eastern enlargement has also raised the profile of Roma protection, international adoptions and mental health at the EU level. The impact of these developments has been further reinforced by the constitutional and legal provisions included in the Lisbon Treaty. It is argued that Eastern enlargement has led to the emergence of a more robust and well-defined EU human rights regime in terms of its scope and institutional clout. This book makes a substantial contribution to the scholarship on EU enlargement, Europeanisation and EU human rights policy by providing empirical evidence for the emergence and persistence of EU institutional and policy structures upholding human rights.
