Available in PDF, EPUB and Kindle. Book excerpt: Organised Crime and the Law presents an overview of the laws and policies adopted to address the phenomenon of organised crime in the United Kingdom and Ireland, assessing the changes to these justice systems, in terms of the prevention, investigation, prosecution and punishment of such criminality. While the notion of organised crime is a contested one, States' legal responses treat it and its constituent offences as unproblematic in a definitional sense. This book advances a systematic doctrinal critique of these domestic criminal laws, laws of evidence and civil processes. Organised Crime and the Law focuses on the tension between due process and crime control, the demands of public protection and risk aversion, and other adaptations. In particular, it identifies parallels and points of divergence between the different jurisdictions in the UK and Ireland, bearing in mind the shared history of subversive threats and counter-terrorism policies. It also examines the extent to which policy transfer is evident in the UK and Ireland in terms of emulating the United States in reacting to organised crime.

Book Reforming Bribery

Download or read book Reforming Bribery written by Great Britain. Law Commission and published by The Stationery Office. This book was released on 2008 with total page 216 pages. Available in PDF, EPUB and Kindle. Book excerpt: Most people have an intuitive sense of what "bribery" is. However, it has proved hard to define in law. The current law is both out-dated and in some instances unfit for purpose. The Commission proposes the repeal of the common law offence of bribery, the Public Bodies Corrupt Practices Act 1889, Prevention of Corruption Act 1906 and Prevention of Corruptoin 1916 Act as well as a number of other statutory provisions. These offences will be replaced by two general offences of bribery, and one specific offence of bribing a foreign public official. In addition there will be a new corporate offence of negligently failing to prevent bribery by an employee.

Available in PDF, EPUB and Kindle. Book excerpt: If you could change one part of the criminal law, what would it be? The editors put this question to nine leading academics and practitioners. The first nine chapters of the collection present their responses in the form of legal reform proposals, with topics ranging across criminal law, criminal justice and evidence – including confiscation, control orders, criminal attempts, homicide, assisted dying, the special status of children, time restrictions on prosecution, the right to silence, and special measures in court. Each chapter is followed by a comment from a different author, providing an additional expert view on each reform proposal. Finally, the last two chapters broaden the debate to discuss criminal law reform in general, examining various reform bodies and mechanisms across England, Wales and Scotland. Criminal Law Reform Now highlights and explores the current reform debates that matter most to legal experts, with each chapter making a case for positive change.
