Book excerpt: Expressivism - the sophisticated contemporary incarnation of the noncognitivist research program of Ayer, Stevenson, and Hare - is no longer the province of metaethicists alone. Its comprehensive view about the nature of both normative language and normative thought has also recently been applied to many topics elsewhere in philosophy - including logic, probability, mental and linguistic content, knowledge, epistemic modals, belief, the a priori, and even quantifiers. Yet the semantic commitments of expressivism are still poorly understood and have not been very far developed. As argued within, expressivists have not yet even managed to solve the 'negation problem' - to explain why atomic normative sentences are inconsistent with their negations. As a result, it is far from clear that expressivism even could be true, let alone whether it is. Being For seeks to evaluate the semantic commitments of expressivism, by showing how an expressivist semantics would work, what it can do, and what kind of assumptions would be required, in order for it to do it. Building on a highly general understanding of the basic ideas of expressivism, it argues that expressivists can solve the negation problem - but only in one kind of way. It shows how this insight paves the way for an explanatorily powerful, constructive expressivist semantics, which solves many of what have been taken to be the deepest problems for expressivism. But it also argues that no account with these advantages can be generalized to deal with constructions like tense, modals, or binary quantifiers. Expressivism, the book argues, is coherent and interesting, but false.

Investigations and trials in murder cases are guided by the important legal terms describing the mental states of defendants: intentionality, predisposition, and voluntariness. Unfortunately, statutes and dictionaries can provide only loose definitions, largely because mental states are virtually impossible to define. The meaning of these terms, therefore, must be adduced either by inferences and assumptions, or by any available language evidence-often the best window into a speaker's mind. Fortunately, this window of evidence exists primarily in electronically recorded undercover conversations, police interviews, and legal hearings and trials, all of which are subject to linguistic analysis before and during trial. In this book, Shuy explains how vague legal terminology can be clarified by analysis of the language used by suspects, defendants, law enforcement officers, and attorneys. He examines speech events, schemas, agendas, speech acts, conversational strategies, as well as smaller language units such as syntax, lexicon, and phonology, and discusses how these can play a major role in deciding murder cases. In his analysis, Shuy draws on his personal experience testifying at fifteen fascinating murder trials, focusing on the role that language played in each. He concludes with a summary of how his analyses were regarded by the juries as they struggled with the equally vague concept of reasonable doubt.

The murder, rape, and enslavement of thousands of Native people were legitimized by notions of democracy—in this case mob rule—through a discreetly organized and brutally effective series of petitions, referenda, town hall meetings, and votes at every level of California government. Murder State is a comprehensive examination of these events and their early legacy. Preconceptions about Native Americans as shaped by the popular press and by immigrants’ experiences on the overland trail to California were used to further justify the elimination of Native people in the newcomers’ quest for land. The allegedly “violent nature” of Native people was often merely their reaction to the atrocities committed against them as they were driven from their ancestral lands and alienated from their traditional resources. In this narrative history employing numerous primary sources and the latest interdisciplinary scholarship on genocide, Brendan C. Lindsay examines the darker side of California history, one that is rarely studied in detail, and the motives of both Native Americans and Euro-Americans at the time. Murder State calls attention to the misuse of democracy to justify and commit genocide.

Building on recent theorizing within the Minimalist Program and Distributed Morphology, the author proposes that much of what is traditionally attributed to syntax should be relegated to the interfaces, and adapts the late insertion theory of morphology to semantics. The resulting system forms sound-meaning pairs by generating hierarchical structures that can be translated into morphological representations, on the one hand, and semantic representations, on the other. The syntactic primitives, however, underdetermine both morphophonology and semantics. Without appealing to special stipulations, the theory derives constraints on the external argument of causative-alternation verbs, interpretive restrictions on nominative objects, and the optionally agentive interpretation of verbs denoting self-directed motion.
